Complaint filed by: schardell@satx.rr.com

I won 8 auctions, 7 between 7/29 and 7/30 and 1 on 8/16. I paid for the first 7 auctions on 7/30. I enquired if the first 7 auctions had shipped before I paid for the 8th hoping to combine shipping. I was told they had shipped. They hadn't, the seller shipped all 8 beanies together as Media Mail for a cost of $2.26. I paid a total of $19.10 in shipping charges. The beanies should not have been sent Media Mail as they are "not bound printed matter." The seller should not have charged me $5.95 for shipping plus $1.30 for insurance on the 8th beanie as his description stated that additional combined beanies would be $1 each. The seller should not have delayed shipping for 20 days without advising me. When I inquired about the delay on 8/15 the seller told me they had already shipped when in fact they were not shipped for another 5 days.

At the very least the seller owes me a refund of $6.15 This is based on his item descriptions; I think I deserve a refund of $16.84 based on the actual shipping charges, the seller did not state that there would be a handling fee. The Seller left rude negative feedback with personal comments which I would like to have removed.

Comments: After waiting 30 days for $352.00 in merchandise I paid for 8/15/02, I asked for a Shipment confirmation. I did not receive one! Instead, I was Insulted & Retaliatory Negative Feedback was left on Ebay! Also, He filed 11 separate 3 day reminders to pay your seller on the items which had been paid for OVER 30 days prior! Also, The phone Number Ebay provides as "contact info" states that "it has been de-activated" until payment is made! Since the seller has not shipped the items, I think we can assume HE DOES NOT HAVE the Items He is Selling! He has a History of Harassing the Buyers who "want what they paid for"! I have had emails from other "victims" and I hope some will come forward & post what they have gone through, also! This is a nightmare I will now have to "sort though" .... due to the False postings of the 3 day reminders and the FALSE NEgative Feedback! PLEASE BEWARE of this Seller! He keeps calling me a "psycho" in the feedback file ..... just because I wanted what I paid for!

I had a bad experience with 2000gifts on eBay recently. It was a pre-sell auction. Delivery was supposed to be in 30 days. He/she wrote & asked for an extension of time & promised a bonus, if I granted it. It told him/her it was okay with me. I sent an e-mail to him/her about 3 or 4 weeks later, because I hadn't heard any more. I was told the beanies would be shipped that Thursday & I should e-mail him/her, if I didn't receive shipping confirmation. I e-mailed him/her, but I didn't get a reply. I e-mailed again & still didn't get a reply. The third time I e-mail him/her I got a very nasty e-mail in return. I finally threatened legal action & the beanies arrived. I was so upset by the whole exchange I couldn't enjoy them, when they finally did come. I hope someone will let others know about this seller. EBay's policy told me to file with Federal/State agencies. I couldn't find a place on their website where I could complain to them about him/her. Maybe I just didn't find the right link on their site.

I have been told to contact you by another person that has had an experience with 2000Gifts of Dobxson, Ltd. 244 5th Ave. 2nd. Floor, Suite 2307 New York, NY 10001. (e-mail-d2000gifts@cs.com) I bought a pre-sell auction of 7 August release beanies from them that closed on 6-30-02 (item #1743929936) for $44.51 + $8.95 S&H and an identical second auction that closed on 7-02-02 (item #1745969854) for $32.05 + S&H. When asked they combined S&H to total $12.45 for the 14 beanies. Also, in this e-mail they had over 10 higher priced beanies that was for sale without going throught e-Bay. I sent a bank money order on 7-10-02 for $89.01. Their auction ad said the beanies would be shipped withing 30 days of auction closing. I began e-mailing to see what was happening after 7-05-02 and no answer. On 7-10-02, I e-mailed that I wanted a refund or shipment of order and that I had to know something by the 15th. They did e-mail now that they would be shipped before the 15th. I could not get any further answers and on 9-03-02 the beanies arrived in the mail. They had been put in the mail on 8-25-02 which they paid $3.10 for USPS Media Mail. They had to lie to the USPS. I have asked for a refund on the S&H but no answer. So, I got tired of messing with them and entered negative feedback on e-Bay for them and the next day they entered negative feedback on me at e-Bay. This being my very first negative feedback anywhere and of no fault or wrong doing on my part, I am wanting this feedback removed. I have contacted e-Bay but have no response yet. I have had contact from 3 others who have had a problem with them too. Not only do I think I deserve the feedback removed, but I also feel I am due a refund on the S&H. Besides the fact that this beanies were on the retail shelves at least 30 days before I got these, so I could have bought them retail cheaper and on the boards even cheaper. Also, on the e-mail that they sent me on the combined shipping, they had over 10 other higher priced beanies for sale, that would not go through e-Bay. I told e-Bay about this when I contacted them. So, I waiting. Any help or advise is welcome.
Thanks,
Charles

Note from Mediator:
This seller has charged buyers for Priority Mail (stated in auction), and shipped via Media Mail. This should be reported to the US Postal System using Postal Fraud Form #8165.

There have been repeated reports that this person is very late in shipping, and has left unwarranted negative feedback to buyers.

Won eBay auction #564113937 for 1/2 DOZEN (6)
BUCKINGHAM BEANIE BABIES, MWMT, Total (w/Priority
Mail+Confirmation)$395.99. Paid via PayPal March 27, 2001. When
he FINALLY sent them, via media Mail, about 5 weeks later, he sent
FAKES/COUNTERFEIT Buckinghams tush-tag #4DDB339J. ALL
*6* of them with the same number. I have since sent one to Peggy
Gallagher who confirms that the serial number is "invalid". I have emailed 2000gifts for a refund. NO response. So, I have filed a complaint at my Post Office with COPIES of emails, and the Post Master also insected one of the FAKE Buckinghams, witnessing the tag number on it. I have also filed a complaint with Internet Fraud, and will be in contact with the authorities in their area, to press charges. I *KNOW* at the time I bid on the auction, they also had several DOZEN Buckingham beanies up.
Dobxon, Ltd
244 Fifth Avenue Suite
2307 New York, NY 10001
OWES me $420.54. I have also contacted PayPal, but of course since it is past "30" days, they won't do anything but put a note in their file. ebay won't do anything as it is past "60" days. So, that is why 2000gifts wait soo long to send things, as nothing will be done by ebay or PayPal after 30-60 days. I suggest EVERYONE file a complaint with the Post Office Postal inspector, I have already. As well, as the Internet Fraud Complaint Center, the BBB, write ebay, and PayPal if you paid them that way. The MORE complaints, and REPORTS they get, the better.
Michelle

(Update: received a response from Phil yesterday, stating I was silly to think *I* could extort $420 from THEM!)

I purchaced 3 beanies on a 30-day presale. I had planned on them well in advance for a birthday present. They did not arrive for another 12 days. Needless to say, I had to attend the party without my present! Very slow delivery here. Check eBay for more negatives and it's amazing that some of their neutral and positive refs are actually negatives if you read them closely!

I won a presell auction from this buyer Jul 5, the shipping charge of $6.95 stated specifically it was for Priority shipping and tracking. I paid for it through Paypal on Jul 6. I then ordered a second set of the same Beanies and 1 Bam, which were paid for on July 24, including additional shipping $1.50 and insurance $3. On Sept 16, I wrote to ask the status and was told the Beanies had just arrived and would be mailed the next day. When they did not arrive within 4 days, I emailed back, I sent 4 emails before I received an answer on August 17 telling me the Beanies were shipped. They blamed the changeover to a new automated system as the reason for the delay. They said if I did not receive the items by Wednesday (Aug. 21) to write back and they would send me the tracking number. The Beanies did arrive Wednesday so I wrote and they sent me the tracking number. When I checked the USPS site, it said the package was in New Jersey (Aug 19, but the DC slip was printed on Aug 18) and had been there for 3 days. Since the package was supposedly shipped Priority, I contacted the Post Office t see what the hang up was. They told me the shipper would have to check from their end, so I wrote and told them on Aug 22 to see what the problme was. They sent an email that told me that couldn't control the Post office and "Unless this is a matter of life and death, I would say, just allow them a reasonable amount of time to delivery your package. I wrote back and told them that more than enough time had passed for a Priority shipment to arrive. I got a one line answer "We do not ship priority". I wrote them back and told them their listing specifically stated Priority. My package finally arrived on Aug. 28 and I saw immediately what took so long-they were shipped via Media Mail, not Priority and there was no insurance. I paid a total of $8.45 for Priority shipping plus $3 for insurance. I wrote several times requesting refunds for the overpayment of shipping and insurance. After several emails they did refund my insurance, but so far have refused all attempts to get them to pay the excess postage. They keep telling me it is Handling charges. I keep telling them that they violated eBay policy by changing the terms of the agreement after the auction closed, but they don't seem to understand.

eBay is finally looking into at least removing this guys Power Seller status, so that is a start. eBay also suggested that I use the feedback system to voice my problem. I worte them back and told them to read this guys amswers to negative feedback. He waits until feedback is posted before he posts his. Several people who paid for thier auctions within 4 hours of auction close now have negative feedback becuse he posted something very sarcastic or hateful in response to his negative feedback. He ha canned answers for everything we complain about. There are at least 5 others I know of who got the exact answers I did. In fact, he sent me the same one 4 times.

This guys Beanies are fine, it is his business practices. He claims his shipping cost are equal to or lower than 95% of the Power Sellers. I keep reminding him that they ship Priority, he doesn't. He has also violated Post office regulations so we are pursuing that also.

Please be very careful with this seller. He no longer lists the mode of shipping he uses so he can say you should have complained before you bid. Most of the people who buy on auction are well aware of shipping, so if someone wants to charge $5.95 to ship one Beanie, it usualy goes Priority. By not specifying the class of shipping, he gives himself an out. He made a mistake on mine though, it said PRIORITY SHIPPING ND TRACKING!

I have paid for two auctions via personal check and Paypal for a 30 day Presell which ended 08/06/02. I have not received anything but promises and now vulgar language from the seller. I have filed a complaint with eBay, the Internet Fraud Service and now with the Bad Trader's List. I also will be contacting the New York State Attorney General. He promised Priority with tracking, the number's status has not changed since the 29 of September, after my complaint to him that the number as no good. He is a bad person and I hope that everyone is made aware of his pratices and the type of person he is. I wish I had known, I would not have had this experience if I had.

I sold some Pompeys to Phil and he paid straight via paypal. When I received the payment it came from 2000 Gifts. It comes to light that he is the same person from Dobxon Ltd of New York city. He wanted the bears shipped UPS overnight but wasn't willing to pay the whole amount to ship as paypal charges a fee. Now I have told him that they bears will go normal airmail I received a threatening and abusive email: I have copied it below:

"You c***-hole. I'm the last person you wanna f*** with. The package will be declined and if the money isn't refunded I won't care spending twice as much as I sent you just to settle this matter face to face."

I just wanted to let people know what they are dealing with. I will be refunding his money and making sure he never deals with me again.

Won 2 pre-sale auctions with promised shippping dates of no later than 30days from end of auction. He didn't make it and then sent e mail saying they had the items but were behind on shiping so would be 3 more weeks but would include a free beanie. BIG WOO. Sent e mail saying that was not acceptable. Then I finally called my CC company to challenge the charge. In the mean time, I get an e mail from the idiot saying they shipped,. Well, that was just another one of his big fat lies. Just stay away from this loser.

This person is selling pre sales that in the ad says if not shipped in 30's you can request a refund. But when you request the refund he doesn't answer your emails. Don't buy from him. He has alot of good feed back but take note of the complaints. Ebay tells you three neg feedbacks and your done but this person keeps taking peoples money and not sending the product. Then when you leave neg feed back for him he makes it look like its all the buyers fault. Then the buyers can't respond to anything about him. There have been several people that he has taken money from but they never receive the product or money again.

I purchased 6 pre-sales on 8/8/03 from 2000gifts off of e-bay, he is located in NY, at the end of 30 days promised in the auction I tried to check in with the seller. He would not respond to my e-mails or my phone calls from CA to NY, which by the way were numerous. I finally filed a case with Square Trade and he closed the cases and I received a computed generated e-mail stating that my $150.00 worth of beanies were shipped on 9/15/03. On 10/3/03 there were still not here and all my attempts to contact the seller were to no avail. I was lucky enough to be within the 60 day deadline to file a Fraud Complaint with e-bay and re-filed all the auctions with SquareTrade when I realized that I could really have a prolblem here. I finally received the following responses that I will copy and paste that proved that he had never even sent my beanies even though he sent me e-mail stating he did:

E-MAIL #1

Keep been silly. People who insist on been total idiots get their items last.

In a message dated 10/3/2003 5:19:46 AM Eastern Standard Time, Cant8nkerous@msn.com writes:

I will be filing SquareTrade on the remaining 5 auctions tomorrow unless I hear from you with some good reason as to why I should not. I have been VERY PATIENT, and my patience has run short. I am sick of your form letters that do not address the problem at hand and we either need these beanies or a refund. You say you shipped on 9/15 well something is wrong with this picture. I will be checking my e-mail in the afternoon and I will be filing the remaining SquareTrade cases at that time if there is no word from you and a generic form letter will not cut it.

Sincerely,    Barbara

E-MAIL #2

And I'm sick of all the garbage you keep e-mailing us. The time I'm wasting reading all this garbage I could ship somebody else's order.

In a message dated 10/3/2003 5:14:08 AM Eastern Standard Time, cant8nkerous@msn.com writes:

After all of this, filing two Fraud Complaints with e-bay and mor Square Trade complaint he finally decided to send my auction winnings after calling me an idiot, etc, being verbally abusive. All of my e-mail were professional and polite. At the end he sent me and e-mail telling me that he hopes that when I get my beanies that I go out into the street and do jumping jacks and get hit by a big bus. It was not until I e-mailed him back and informed him that I am in my 4th month of a 48 week chemotherapy treatment fighting for my life for my 13 year old son so he can still have a mother that he realized how much of a jerk he was and apologized and agreed with me that the bus should hit him. This man needs Customer Service seminars as well as seminars on how to run a business. I HIGHLY ADVISE STAYING AWAY FROM HIS AUCTIONS, THEY CAN BE NOTHING BUT TROUBLE. IT DOES NOT MATTER HOW QUICKLY YOU SEND YOUR PAYMENT, HOW POLITE YOU ARE, HE WILL STILL BE VEREBALLY ABUSIVE TO YOU, LIE ABOUT YOUR AUCTIONS BEING SHIPPED, AND MAKE YOU GO THROUGH HAVING FILE WITH SQUARE TRADE AND E-BAY FRAUD BEFORE YOU CAN GET A RESPONSE. LIKE I SAID HE EVEN TOLD A 38 YEAR OLD SINGLE MOTHER FIGHTING FOR HER LIFE THAT HE HOPES SHE GETS HIT BY A BUS, HE DID APOLOGIZE, BUT THAT WAS TOO LATE. BUYER PLEASE BEWARE. TRADERLIST PLEASE POST THIS IS ALL TRUE AND THE E-MAILS THAT I POSTED ARE ALSO EVIDENCE THAT I POSTED IN MY FRAUD AND SQUARE TRADE CASES. THE EXTRA STRESS AND FATIGUE OVER A SIMPLE AUCTION HAS HAD NEGATIVE RESULTS IN MY IN MY LIFE AND FOR MY TREATMENT. STILL WAITING IN CALIFORNIA HOPING HE ACTUALLY SENT MY AUCTION WINNINGS.

Ordered several beanies on pre-sell. They were to have been shipped 30-days from the last auction date. I was told that they would be shipped by 9-4-03 or earlier. Then that they would be shipped on 9-15-03. On 9-29-03, it was another message. I filed a fraud complaint against this seller as my instinct told me that I might how receive my merchandise at all. I finally received my merchandise 62 days after I won the final auction.  He wrote me a very abusive email today, and even threatened me to get the fraud report removed. I don't take highly to threats - Powerseller or not. I did look up his feedback and saw that he had 229 negative and 327 neutrals. Many of those left recently. I don't like this seller, and he's verbally abusive to any complaints he receives. His ID on eBay is: 2000gifts. Buyer Beware of this seller.

there are honest traders, and one of them sent me this site today. It seems that this seller (2000gifts) has had stores on e-bay before and when he gets kicked off he just opens another store. I have tryed to be as understanding as I can, but I am new to e-bay, the year I have been trading, this is the first problem I have had with a bad seller.

This seller on e-bay is not to be trusted. finally received beanies after almost 3 month wait. Replied to emails with false info. NEVER do business with this person again. Complain, and he leaves vile feedback about you.

This seller has ripped off countless people on ebay, and ebay does NOTHING!!! I ordered a 30 day presell from him in July and still have not received the items, nor will he respond to my e-mails asking for a refund. The last I heard from him on my order was back in November, when I was told that Ty had not released these beanies yet. Does this not mean that the man is selling items that he DOES NOT have confirmation from Ty on?!?!? Is that not the same as fraud?!?! Give me a break ebay.....grow some balls and protect your asset....the customers!!!

9-26-03, I own an eBay auction (#3147087168), for a 30 day pre-sale Ty Beanie Willam(Germany). I paid rite away thru Paypal. 11-1-03, I sent eamils (which were never responsed to), I contacted eBay & Paypal, but they could not help me. With eBay, the $$ amount was too low. With Paypal, they can't get involved (and promise any results) on transactions over 30 days old. HENCE, pre-sales, are bad, using "Paypal"...use a regular credit card, so they can work w/u. 11-05-03, I contacted e-Bay, and got 2000gifts telephone number. I left messages, on their answering machine, but they did not return my telephone calls (what a surprise). 12-1-03, 2000gifts finally e-mailed me, made very rude comments and filed a claim on ME, w/e-Bay's Square Trade. 12-10-03, "Paypal" was able to give me credit, on my credit card. This company is not very professional, dependable and gives eBay a bad name. As u can see w/their feedback, if u leave a NF, they response w/retalitory NF on u. I just don't understand how their able to stay in business on eBay.

This seller is cheating unsuspecting e-Buyers out of beanies! He advertises 30 day pre-sales and then after upwards of 90 days all the buyer is left with is harsh words and negative feedback if they dare tell the truth about his trading practices. He needs to be stopped before others get ripped off as so many of us have! There have been complaints filed with Square trade and the BBB of New York!   Thank you for your time!

Hurrah, this jerk has been kicked off of eBay and Paypal. I guess they finally learned. Why did it take so long?

My 2/11/04 message to D2000gifts: Last chance - no refund check yet - no bear arrived. I hear from you - I no send info all these folks - otherwise I join all those others naming you on Bad Trader and in letters to authorities. It has been a bit more than 10 days. Do I really need to go to all those folks?

This came from you Jan 15th.  "Allow a week to 10 days to receive refund in the mail "

Do you intend to respond to me on this item or not. At this point I would just prefer a refund. I would rather not spend more time on this, but if I have to: Letters to attorney general, local PD fraud division, Ty Inc. ebay, paypal, and Yahoo. These folks don't need to be involved in out transaction, unless you want them to.

This was response to my message:   MAYBE IF WE DIDN'T HAVE TO ANSWER THE SAME BUNCH OF GARBAGE FROM YOU EVERY 5 MINUTE WE WOULD GET A CHANCE TO ACCOMPLISH OTHER THINGS. REFUNDS ARE PROCESSED ON A FIRST COME FIRST SERVED BASIS, WE'LL E-MAIL WHEN YOURS GO OUT.

I don’t think that anyone needs to use this form of response.  Thank you for any help/consideration of this matter.
