I'm not sure if I'm just frustrated and impatient or if I need help. On December 12, I won an eBay auction using the "Buy it now" feature. http://cgi.ebay.com/aw-cgi/eBayISAPI.dll?ViewItem&item=523843306. I immediately emailed the seller, explained that this was to be a Christmas present, asked that the item be shipped priority mail with delivery confirmation, and stating that I would pay by PayPal. I also asked if he had a different size he could substitute. He sent two replies, one stating "no problem," and the other stating "no problem paypal is fine i accept it under templeu22@aol.com or jerseystore2000". (Those are his responses in their entirety). I payed $18.54 that same day, via PayPal.

On the 18th, I emailed asking for the delivery confirmation number so I could track the package since it had not arrived. Before he had a chance to answer, I tracked him down on AOL and communicated through instant message. He said that the package had been mailed, but he didn't know when.

On the 19th I requested his contact information and sent another email asking about the shirt. The response I received was "its in route". (Again, that was the entire response).

I requested his contact information from eBay and received this:

E-mail: templeu22@aol.com
User ID: jerseystore2000
Name: All That Clothing
Company: Jerseystore2000
City: Philadelphia
State: PA
Country: United States
Phone: (215) 745-3300
Time/Date: Aug-12-99 04:42:51 PST

On the 20th  I telephoned him and his response to the question, "when and how was the shirt mailed," was "I have no clue." He did offer to send another shirt via overnight delivery if the original did not arrived the following day.

On the 21st I emailed him to let him know that the shirt still hadn't arrived, but that I would try to make other arrangements and he shouldn't bother to send another.

On the 26th I sent an email stating that the shirt never arrived and that he should refund my money. His response way "i sent it awhile ago please check your postoffice". (again, the entire response).

Following a couple more emails back and forth, on the 27th, he agreed to refund my money, but refused to send it back through PayPal, claiming his account is set up in such a way that he can't refund that way.

On the 28th, I informed him that the shirt had arrived and I refused shipment on it and it was on its way back. It was postmarked 12/15 and sent regular 1st class in a manila envelope.

On the 29th, I received an email stating, "i already sent you a refund yesterday". (In response to my request for a money order to be sent in a manner that could be traced and that I be given proof that it was mailed.)

On January 6th, in response to my email stating that the refund had not yet arrived he stated, "i sent it last week...if you dont have it by tuesday let me know".

On the 9th, after a couple of emails back and forth he stated, "i sent it to you on friday...i will make sure and let you know tomorrow". When I asked which Friday (the 29th or the 5th), he responded, "this past friday". The mail has already arrived today and there is no refund from him. I never got his real name and I haven't posted feedback for him. I am really sorry I broke my rule about buying from someone with negatives (and I broke it in a big way.... he now has 61 negatives, but I was hoping the his 6645 positives outweighed them).

I have kept all the email back and forth. I can forward anything you may need. I'm willing to wait a few more days if you think that's what I should do, but at this point, I have no reason to believe that a refund has actually been mailed. I know it's not a lot of money, but it's been a lot of aggravation. Let me know if you think I should just wait a while longer or if there is something else I should do. Thanks,   Linda S.

re: jerseystore2000

That's certainly and interesting "story." Amazing that the only 3 pieces of auction mail I've ever lost all came from him! I'd be willing to bet he has no documentation of when he sent anything. I did a search on Yahoo yellow pages this evening and found this:
All That Clothing
6416 Rising Sun Ave
Philadelphia, PA 19111
(215) 745-3300

That's the same phone number I called. I have emailed 3 people who left negatives and one person who left a neutral for auctions. I asked for his contact information and asked them to email you. From the information I gathered at eBay it seems my course of action with them should be to file a fraud report. Thanks,  Linda

Basically, he lied to me a number of times. He was terrible with communication. I ordered a jersey on October 20, thinking I had PLENTY of time before Christmas for it to arrive. But as November and then December came, he had already gotten my money and still no jersey. Usually he'd reply after four or five e-mails, telling me something like "Sorry, it was out of stock... we'll get it in on Monday." Then I'd e-mail back on Monday, and he'd say "Oh... maybe by Friday." Then, just a couple weeks before Christmas, he sent me an e-mail saying he sent out the jersey and that he threw in a hat for my trouble. Surprise, surprise. ... it never showed up. So when I went up to Seattle for Christmas I continued to pester him, and he finally sent a refund check, over two months after he got my money. I looked on e-bay and requested his contact information...

I honestly can't figure out how they get so much positive feedback, when the other people say "great communication", etc... cuz it was like pulling teeth getting the guy to reply to my e-mails.

Just want to let you know that you are not the first person to contact me about this person. The situation is we ordered a jersey back in oct, 2000. To date we have not yet recieved it. the person we contact states that the jersey was sent out multiple times, but yet cannot give me any tracking numbers for the items. In fact he has even went as far as trying to play the tough guy and wanting to meet personnaly. I would have obliged, but the wife said no. Well anyhow ill give you the email that he had just sent me today and youll understand the mentallity of what your dealing with. By the way, he cashed in our money order 2 days after recieving it. By accepting mail and cashing the contents he has also commited mail fraud, which i filed a complaint with the postal office also.  Please feel free to contact me at any time, and illl be glad to help you.  DARLA

I won an auction of his on Ebay for a Playstaion Game. I mailed him the money asap on the day after the auction closed. I recived the game like 17 days later. Way to long if you consider he would have had my money within 3-4 days at worst. To make matter worse he mailed the the completly wrong game.I asked that he ship the correct game and that i would send his back asap as well, but i didn't wanna wait 2-3 weeks to have him wait for the wrong game to get to him b4 he shipped. Notice I offered to pay the shipping for his mistake. He said no way that I had to ship it back and wait as long as it took. We argued alot and finally he said he would pay the shipping on top of a refund and we could just forget it if I would just ship the WRONg game he send back to him. I did this and when his check came it was a refund, but no extra for the shipping I paid. When asked about this he just stopped answering my email. I left him bad feedback and he had the nerve to leave me bad feed back and say I ordered the wrong game whick WAS NOT SO. Anywho . . .If thiers anything I can do to help you put this guy outta buisness let me know. I have attatched a copy of the pic i sent him to show him he sent the wrong game. I had ordered NASCAR 2001 and you can see in the pic he sent some soccer game.. the guy is a real loser    Frank Waller    Ebay Seller and Buyer

This is how my transaction went with this company. I sent the first attachment after they complained about negative feedback. After receiving it, they proceeded to whine about having many auctions going on at once. They also gave me the impression that they were a smite bit upset with this email. So I responded with the second attachment. Darin  Martinez

Subject: Re: derek jeter negative feedback...

LET'S PUT THIS ALL IN ORDER OF EVENTS AS THEY HAPPENED, SO MAYBE YOU CAN GET A BETTER PERSPECTIVE. AS YOU CAN SEE BELOW THE EVENTS THAT TOOK PLACE WERE NOT VERY CUSTOMER SERVICE ORIENTATED!! LET'S START FROM THE BEGINNING IN THE E-MAIL DATED 11/24/2000 IN WHICH I WROTE I HAD WON THE AUCTION.

ON 11/27/2000 I RECEIVED AN E-MAIL FROM YOU AS TO THE SPECIFICS OF WHAT NEEDED TO BE DONE TO EXPEDITE THE ORDER. PAYMENT WAS MADE 11/28/2000.  AS YOU CAN READ IN MY E-MAILS DATED 12/07/2000, TEN DAYS LATER, I HAD NOT RECEIVED A RESPONSE FROM YOU AS TO THE STATUS OF THE SHIPMENT.

YOUR RESPONSE ON 12/07/2000, WHICH I MIGHT ADD WAS NOT VERY PROFESSIONAL, WAS "IT'S ON ITS WAY." AS YOU CAN READ FROM MY RESPONSE ON 12/07/2000, I NEEDED MORE SPECIFICS; WHICH SHOULD HAVE BEEN PROVIDED TO ME WITHOUT HAVING TO ASK. AGAIN, NOT VERY "CUSTOMER SERVICE" ORIENTATED. EVEN AFTER ASKING FOR SPECIFICS, YOUR RESPONSE WAS STILL "item on its way tomorrow sorry for the confussion." NEED I REPEAT MYSELF ABOUT THE "CUSTOMER SERVICE".

NOW LET'S TALK ABOUT ORGANIZATION, ON 12/13/2000 I RECEIVED AN E-MAIL STATING THAT YOU HAD NOT RECEIVED PAYMENT FROM ME, BUT YET 6 DAYS PRIOR ON 12/07/2000 YOU STATED THAT THAT ITEM HAD BEEN SHIPPED. AS YOU CAN READ IN MY RESPONSE OF 12/13/2000, I WAS GETTING VERY IRRITATED AND RIGHTFULLY SO. IN ANOTHER E-MAIL SENT 12/13/2000 I HAD REQUESTED THE ITEM BE OVERNIGHTED OR AT THE VERY LEAST 2-3 DAY AIR, SINCE THE ITEM WAS SUPPOSE TO HAVE BEEN SHIPPED BY NO LATER THAN 12/01/2000.

IN YOUR UNPROFESSIONAL RESPONSE OF 12/13/2000 YOU STATED "relax it was an over sight and not done on purpose...it will be shipped out tomorrow via prioity mail...thanks and sorry for the problem". THERE'S THAT "CUSTOMER SERVICE" OR LACK THEREOF!!

SO ON 12/15/2000, YOUR COMPANY'S UNPROFESSIONALISM STOOD OUT AGAIN, BY YOUR MANAGER'S RESPONSE TO ME ATTEMPTING TO GET THE OWNER'S NAME. SO BEFORE YOU PROCEED TO GIVE ME NEGATIVE FEEDBACK, WHICH I BELIEVE IS UNJUSTIFIED, NOW YOU CAN READ WHY YOU RECEIVED NEGATIVE FEEDBACK. PLEASE JUSTIFY ANY NEGATIVE FEEDBACK YOU MAY WISH TO WRITE ABOUT ME. BUT AFTER READING THE COURSE OF EVENTS AND HOW THEY OCCURRED, I SEE NO NEED FOR THAT TO HAPPEN.  WE WILL BE KEEPING THIS E-MAIL ALONG WITH ANY PREVIOUS ONES ON FILE FOR FUTURE BUSINESS DEALINGS ON E-BAY. THANK YOU!

P.S. THE DATES IN QUOTES ARE YOUR RESPONSES.

Now I am starting to get irritated. I sent payment through PAYPAL November 28th. Never received any confirmation of any kind from you. I then emailed you Dec. 7th three times. You emailed me back the same day telling me you shipped it out the day I emailed you (coincidence?). I now am receiving an email to say that I have yet to pay for this item. This is after I emailed you ,from the beginning, asking you to ship this as soon as possible, as it was a gift for someone. It is now Dec. 13th, and still no package. Does anyone know where this item is? The PAYPAL verification # is: 1P933834BV754650E. The hope is that this item is received way before Christmas. Darin Martinez

************************************

12/13/2000

Ideally, I would like this item, if not next day air, then at the very least 2-3 day air. I held up my end of the deal and paid IMMMEDIATELY, yet am receiving this item almost 1 month after the auction closed.  Please let me know what you decide.

I then called and asked to speak to the owner and the manager said, "He is not in, but I am the manager can I help you with something?" I said, "I'd really like to speak to the owner, what is his name?" The manager's reply was, "I can't give you that." I then proceeded to say, "You can't give me the owner's name? You guys are a joke!"

Subject: Re: derek jeter negative feedback...

We can go back and forth as much as you would like. You are running auctions out of a business location. Thus, one can expect to be treated as a customer, and not as a "joe schmo" selling his comic collection. And we are not talking about one or two days; it had been over three weeks. If I never emailed, the package would have never been shipped. And I expect to be able to receive the business owner's name when I call a place of BUSINESS, not someone's home. I never harrased your manager. I asked for the owner's name. When he could not give me this information, I felt like this place was mob related or something. And the OWNER is whom I wanted to complain to. I did not think this is how the OWNER would treat cusomers. I was mistaken. This person does not seem to be customer friendly. And if you can't handle the volume now, how am I to expect to be treated if I were to order off of your future website(like that will happen now). I did not complain about the lateness of the first email you sent me, which was 4 days after my first one. You just show a total lack of respect all around. And when the package is this late, a little research would have been nice. Apparently, you receive these questions very often: "where's my jersey", and "did you ship it yet". Are you normally this sloppy with your paperwork? First you tell me I have won the auction, then you tell me you have shipped the item, then you tell me you haven't received the payment. What am I to think.  Next time do not complain when someone's payment is late. Who are you to complain? Hey, leave whatever feedback you want. All I know is I pay quickly, and by any means asked for. Hell, you received your money pretty quick. And so did all of the other sellers with which I have dealt. And I never asked you to kiss my ass, just ship my item within a reasonable amount of time. If you feel as if this was so, then my bad.  Again, great customer service. Good luck with the website.

It was not a pleasant transaction with temple2u@aol.com ... He did not answer questions directed to him and when he did it was very cryptic (i.e., "I'm so confussed"). He did not refund my overpayment of shipping charges. His auction page gave one amount, which I sent payment immediately via Paypal, and then when he contacted me it was $2.00 less and I attempted to explain this to him and several times requested he refund the difference, with no reply. I did finally receive my auction item (which was as promised). However, I debated whether to leave negative or neutral feedback after I felt he was trying to intimidate me with the following e-mail "before I give you a negative please let me know what i did to you to deserve a negative feedback." At that time I responded to him by saying if contacting him immediately upon auction end, paying him promptly and trying to contact him re: my dispute over shipping charges warranted negative feedback for me, go ahead. He sent me a final one saying "youre right, happy holidays." I was very angry that he was prepared to make something up for me as negative feedback. I did read some of his prior negatives and believed there was a problem, but I just wanted to be done with him. The address I have is: All That Clothing, 6416 Rising Sun Avenue, Philadelphia, PA 19111.

Thank you for your interest. My involvement with them was, I won the auction. I asked them if they accepted paypal payments, and I waited. I waited 2 weeks and I emailed again. I waited about another week, and then I gave them negative feedback on thier profile. They immediatley gave negative feedback back saying that they emailed me five times. I never once got one from them during that time. I emailed them again asking where they may have sent that, and wouldn't you know, they got that email and told me that yes they do accept paypal payments. My question was, they supposedly sent out 5 emails to me that I never received but had no problem receiving emails since from them. I paid them through Paypal and it's been over two weeks since that time, and I STILL have not gotten my product yet. Thanks again and let me know if I can help more. My dealings with Temple22u were almost a year ago. I recall he/she had used misleading statements in his/her auctions. I remember I got rather threatening emails in response to my bringing it up. I remember little else. Personally, I think his/her approximately 1% negative comment rate is rather good. And I'll never use that company again. Heat

I must tell you a few things or two about this jerk. First of all he doesn't kow a thing about ebay rules....You email him telling him that you had contact ebay and they said that he should have a receipt for anything he mailed out, and he MUST show proof, within a 24 hr turn around. And also tell him that if he doesn't comply with all the informatiuon that it can lead up to a law suit, for felony, and fraud, considering he'll dealing with ebay co, and the us mail. Go figure about this guy. Bel;ieve he's just a jerk that wants, and wants. I finally today 1/13/2001, just recieved my jersey after 3 months. Thats becuase I came into so much information, and I knoew I could sue him, I wasn't playing any more of his games.  If you need anymore info, please email me again and I will try to give you as much info as I can, cause even tho we did recieve ours item I'm still gonna continue my journey with this.  Darla

Cautionlist emailed him about the complaint and you can see his replies. The feedback was in the thousands on ebay. But it appears that when there has been a problem that is when he has not been a good trader. He also sends harassing emails and will send many IM's even when asked not to. He also does not send priority mail and this is what is paid for. And he does not send confirmed mail. So that those who have had problems with him have really had big problems.

I know you've already been investigation the templeu22@aol.com account. i wanted to give you an update. I still hadn't received my product from them by the time I had written you last. I asked them about it, and they sent it out "weeks ago" and to check my post office. Of course, I did. And of course, it wasn't there. I now have an email pending to them asking them to explain where my product is, then I looked at thier past feedback, and notice that at least 5 people within this last month are complaining that they "sent" things that never came, and never have proof of the "sending" when confronted. Anyway, thought I'd let you know for what it's worth. Thanks for the help in this.

He advertised an authentic NFL jersey on eBay. The jersey he sent was a cheap, no-name mesh jersey with sewn-on letters and insignia. It was also the wrong size. He lied twice about sending me a refund. When he finally sent it mover two months later, it did not include shipping. Now he says if I tell him what he still owes me, he will send it. Even if he does, it was still a terrible transaction and I would never do business with him again, whether as King of Jersies or JerseyStore 2000.
