I had a bad trade with BRANDY1127@aol.com I sent her 2 dvd's and she never sent anything in return. she says she never recieved my dvds so she filed a fraud complaint with her post office in order to stop her package and have it returned. however the USPS says that is not possible in any circumstance you can not stop mail that is already sent ever. there is a very, very rare case of recalling of mail which takes a form being sent to the receiving post office requesting an interception and return of mail in question, however my post office confirms no form was filed and none of my mail was intercepted. I have a receipt saying I mailed on 3/26/03 at 02:57:43 pm, but sadly I did not purchase insurance or confirmation #. I was realitively new to trading when I traded with her and way too trusting. I have learned my lesson. my early emails with her got deleted. her name is Bertha and her Email is BRANDY1127@aol.com. I do not have her last name or address except that she lives in New York. I wish I had kept it and sent her stuff with a confirmation # but I didn't. All I have is the sales receipt for mailing her package. I sent her 2 dvds and she was suppose to send 4 beanies. we were supposed to ship on the same day. I did check her feedback which was fine she has it all over. this was on one of her pages it says the sites she is on. {I have refs under old SC feedback as well as on KNK, CN, Ebay, A1- Traders. our deal was either arranged on TY BBOT or Smartcollecting.com. we had
discussed a trade weeks ahead of time then I never heard from her so I assumed
she was looking for new rather than used dvds. weeks later she sent me a
list of dvds she needed and we arranged a deal, so I don't remember the initial
site I met her on. I wish I had kept more info and taken more precautions
but I didn't think she would cheat me. I was naive and I have learned my
lesson. I keep copies of all correspondance until deals are complete now
and I ship with a confirmation #. I realize you might not be able to help
me because I don't have all the info you requested but thank you for anything
you can do. I have learned my lesson on that one. Bertha appearently never
shipped since it is unstopable and she claims she stopped it and got her
stuff back it is clear she never parted with it in the first place. I posted
a warning to others on smartcollecting.com and TY. she retaliated by lying
on my feedback. I just want my stuff back. Please help! I was referred here
by someone who saw my warning and reported she cheated them in the past too.

This was my situtation with her. It happened last year,she purchased a
little steiff stuffed animal with me off of knk she paid with paypal, then
after I mailed it she stated she never did recieve it. I checked with my
post office and they said they would check into it, stated she had a good
mailing address she should have recieved the package, anyway it was never
returned back to me. It was not a expensive transaction I think about 17.00
anyway's what I thought was strange was she didn't give it enough time to
arrive there, she went and placed the complaint right away. I don't think
I used delivery confirmation at that time I didn't know I had to with paypal.
I found out later she was using mult. email address's otherwards had more
than one account on knk and CN. I have no proof that she didn't recieve my
package but even if I used dc that only mean the package is delivered there,
It does help you if you use paypal to recover your funds at that time. I
refunded her fully. What she did tell me is that she didn't get the package
and that the postal carrier could have left it and nobody was home. I just
did the right thing. I was just suprised when I mailed the package and it
takes 3 to 5 days to get to new york from here and she had already filed
the complaint I did and still do feel like she recieved and either didn't
like it or she planned it.Due to the time-table factor. I hope the other
lady can get her beanies back. I bet she has accounts on Ebay. I know
she does paypal. The person I had the transaction with was

oh my, I DO remember clearly! It was the very first negative I got on
Ebay (plus I keep excellent back up) I have her full name and address but
you should be able to get that from Ebay . Exactly who and what are you
investigating? She said over and over she had mailed payment and it did finally
arrive a month after auction ended (my auction says payment to made within
10 days) . Then she sent me a check (auction also said a two week hold) and
I mailed out her item. In cases such as this, I usually let sleeping dogs
lie & just leave no feedback but this woman harassed me and kept emailing
me and insisting I leave her feedback (this is back in the day when you could
leave more then one feedback response) so I did leave her a neutral, mentioning
how long it took and the trouble I had and she in turn left me a negative.
Go figure! I am sorry about not being able to give you more info, Ebay has
pretty strict rules on personal information but I can give someone from Ebay
info if you would like to pass on my name. Good luck,

I appreciate you contacting me regarding this matter however Marci had
ample time to send proof to me on this trade. This was requested of her in
order to resolve this matter which she chose not to do so. However YOU claim
she has proof, then why wasn't this furnished to me when I asked for it.
She furnishes proof to you yet when I asked for it she refused to send and
gave a bunch of excuses. I tried various times to email her, forwarding past
email exchanges, inquiring about her end of trade in order to resolve this
matter. She was not even willing to work with me. I cannot be held responsible
for her package being lost or sent to wrong address if indeed it was mailed
out. That is why I shipped out with return receipt. I feel at this point
and time that it is a little too late for me to try and discuss the matter
with a mediator especially since she went on SC and left a negative feedback.
I never received anything from her even until this date. At one time I was
even willing to allow the beanies to be released to her just because I trully
believed the package might have been lost. Yet she didn't even care that
I hadn't received anything and wasn't even willing to work with me in any
way. I felt it to be totally cruel that she didn't offer any fair solution
and was only concerned about getting the beanies with no regard to my ending
up with nothing. It's not about the beanies, it's the principal of the matter.
The beanies are extras and it would have been no biggie for me to let her
have them and this was mentioned to her. All I asked for was proof that she
indeed shipped out for my own peace of mind. If she would have said something
like she was sorry the package got lost and offered to send two beanies back
or made any effort I probably would have said don't bother keep them and
just take the loss. Instead I got nothing... no proof, no empathy, nothing
and that's what made me leary on whether or not she really sent out. I fully
understand that she gave you her part of the story and I have no problem
with that. I however prefer to present my side & proof to the appropriate
legal authorities when the time comes for me to do so. I have been been trading
online for over 5 years and my feedback shows that I ship my end as agreed.
I had other trades during the same time as with her all successfully completed.
I have also successfully complete many other trades after her to this date
and can provide email exchanges from various people specifically stating
them receiving and them thanking me for the trade, I would gladly forward
them if interested. If you honestly believe that as a mediator you can resolve
this matter fairly, I'll be open to hearing your suggestions, if any. However
if you are only going to say things like: (and I quote) "Hopefully this has
just been carelessness on your part and you will return her dvd's or send
the beanies you were to have sent to her. thanks " then it seems you have
already come to a conclusion on this matter without my side ever being heard
and this concerns me! I suggest that you allow this matter to be fully resolved
by the neccessary authorities before placing my name and/or any personal
information on bad traders list or disclosing my information in any public
forum. Defamation of my character unjustly & disclosing my personal
information will not only bring charges against her but also against you
and any other site that does this. I appreciate fully what you are doing
however I feel it would be unfair to place me on lists and banned from auction
sites because I choose to resolve this matter with the proper authorities,
not based via internet and email exchanges. After all I do not know who you
are, nor what if any connection you may have to Marci. Hopefully you can
understand my point of view & will respect this decision. However as
mentioned before if you honestly believe that as a mediator you can resolve
this matter fairly, I'll be open to hearing your suggestions. I seriously
hope you avoid from disclosing my personal information on ANY site or in
ANY public forum until this matter has been fully resolved & handled
by the proper authorities, unless you have suggestions on other ways to resolve
it. I do thank you for contacting me as I will now begin to get my proof
in order and pursue further legal counsel regarding this matter. Thank you!
Cautionlist asked her for the proof that she had that she had shipped her
package. Also asked her for proof that she had retrieved a package which
is the story she had originally given to Marci and which the post office
has said was not true.

Some mediator you are, lol. It is quite evident that you have already
made a ruling prior to even hearing my side. As mentioned in my first email,
I have no intention of proving anything to someone hiding behind an email.
I do not know what connection if any you have to Marci. Also Marci had ample
time to provide proof to me which she did not when I asked for it. It's quite
ironic that you claim she provided proof to you yet she gave me nothing but
excuses of not having a scanner or any way of getting that proof to me when
I asked for it. She also never requested any proof from me until I asked
her. I would have been more than willing to exchange proof with her and mentioned
this to her via email contact. As for your comments on my feedback,
I feel that was totally uncalled for. I was not bragging, I just mentioned
it. Whether it has much to be desired is not for you to decide. You have
no right to even make a comment like that and to do so as a mediator shows
how unprofessional you are. You also mentioned there has been other
complains about me yet I have never been contacted by you or anyone else
regarding it. As mentioned before if any of my personal information is disclosed
in any public forum, it will be pursued legally. Having a disclaimer on your
site does not give you or anyone else the right to disregard MY right to
privacy. I'd appreciate it if you do not contact me again.

Cautionlist: While going thru her feedback on sc I clicked on the links she
has on her page for other feedback. And she has no feedback at those sites.
One of them is traderlist and she is not on our good traders list and has
no feedback with us. The other was Yahoo and she has no feedback listed at
that site also. Of course KNK and Cn cant be looked at now. she has since
changed her feedback on SC so that there are no links to traderlist or Yahoo

hi iam havin problems with bertha rivera. have you any advice. i hav sent
her my trade but shes says shes sent mine and i havent recieved it. i am
only 14 and did not know about feedback at the time any
advice
