I won a pre-sale for the 12 zodiac beanies. I paid through Paypal and
have no beanies and no money. The payment was made on Sept. 12th. I did receive
a letter from them stating that they had changed locations and were having
trouble keeping up with the orders. I asked for a refund and got no response.
I now see that they have been suspended from e-bay. Also, they have other
complaints on here. This is the third time in two months I have been scammed.

fraud. I Purchased 2 auctions from

ebay auctions 424912248 and 425622591. Both were paid on 9-7-00 Auction
#424912248 for 2 chinooks total of 84.90 AND Auction #425622591 for 2 sets
of zodiac beanies for total of 152.55. These were pre-sale auctions
and to date have not received anything. Of course they responded to my final
notice yesterday. Someone had called my house and my husband took the message
which said that the chinooks were on back order. They NEVER said anything
about the zodiac beanies or a refund. If these things retire, I need the
money to buy them and if they don't retire, why don't they just buy them
to fulfill their obligation? This whole thing is rediculous. Thanks

Well it's Dec.20th,due date on my auction was changed by breezeway from
Nov.30th and still nothing!!This is a joke they are not going to send anything!!
The problem with your order occurred for reasons beyond our control, but I want to spare you excuses as I personally consider any excuse unacceptable. You trusted us and you deserve to have your trust honored. I am very sorry if this has caused you any problem, and I will do my best to make it up to you.
While excuses are unacceptable, you still deserve an explanation for some of the difficulties you may have experienced. BreezeWay underwent a huge and unexpected growth in customer demand. Happily, this occurred because of a great reputation and performance beyond expectation for our many loyal customers. Unfortunately, we could not keep up with our growth and could not staff or equip quick enough to properly manage the influx of emails and phone calls. This is why too many (and for us one is too many) customers have not promptly heard from us.
Unfortunately, we are still understaffed and under-equipped. We need to devote all of our staff, resources, and time to fulfilling our obligations to you. Therefore, at this time, we cannot answer emails or phone calls. However, in an effort to maintain our communication with you, my partner and I will personally answer phone calls on Saturday, December 23, between 9am and 12pm PST (please call: 805.517.1844).
If you desire a cash refund, we will be happy to comply. Please be advised, however, that we will be unable to issue a check promptly. The funds allocated for the purchase of your order have already been used to obtain your order from our suppliers. We have not received those shipments yet or the money we paid for those shipments. This is of course not your fault, this is our responsibility and you will not lose your money. This does mean, however, in order to give you a cash refund we must build up funds for your refund. We hope to do this in a reasonably short time. We do not want to keep you waiting and are working very hard to see to it that this is done as soon as possible. Because of any inconvenience this may cause you, as of December 1, 2000 we will add 1% interest per month to your original purchase amount.
BreezeWay is a reputable California incorporated company. As such, any claim of fraud or improper business practices is taken seriously by us. We have already advised the proper authorities, including the California Attorney General's office, that in the event anyone has reported a concern about an unfulfilled order, we at BreezeWay are aware of our obligations and will follow through accordingly. These authorities have expressed appreciation for our acknowledgments, our good faith efforts, and our cooperation. While we believe anyone has a right to register a complaint, such complaints will ultimately cause further delays in our processing and delivering of any outstanding order. In this regard, we need your patience and understanding.
We truly understand that for those who do not know us, all you have to go on is our word. In a world where too many bad things happen and too many acts of dishonesty occur, it may seem that our word is not enough to reassure you. If you are still worried or concerned, I understand and I am very sorry. I can only say that for those who have patronized our company in the past, you know that you could always count on us; you know that we at BreezeWay are honest, decent, hard working people. I appreciate the many wonderful and supportive emails I have received from customers who know us. I will not let you down.
Please be assured that before we make available our latest products, we will adequately staff and equip our company to better serve you. I can only hope this message demonstrates our genuine good faith and assures you that we will not avoid our responsibility.
Sincerely,
Breeze

I purchased a Chinook Bear in a Dutch pre-sell auction which closed on

e-mails are unanswered. They sent out their form letter on 12/20 with all

they got too big and too greedy! At this point, all I would like is a refund.

Read on your complain page their reply which makes it "sound" like they
have done nothing wrong. I have called, Faxed, E-mailed and only time I even
reached person, she was just like that letter, nother was "their" fault.
Well, My winning bid was 8-24-2000 and they have filled same items for newer
auctions and not this one. Use excuses but I asked they contact their supplier
and get date or cancel orders and get money back (simple to me) she said
she won't do that! I was in business for 35 years and did that all the time!
I want my money and so do all the others, we're talking Grand Theft I believe
now from the amount of people who apparently have product due.

Tina Sinclair,
According to the information I learned today,
Breezeway Inc. does in fact exist at the address of:
5142 N. Commerce Avenue
Moorpark, CA 93021
USA
To date, the Moorpark Police Department has received approximately 50 complaints from persons who believe they have been defrauded by this company. All the complainants have said they attempted to purchase items through on-line aution companies such as "E-bay."
All complainants have been referred to "E-bay" investigators with their complaints. You should do the same. Our investigators have already been in contact with the owner of "Breezeway", who said he has not defrauded anyone. He said he has had many problems with back orders and intends to make good on all orders. Should E-Bay investigators discover a crime with this complany, they will turn their investigation over to us for prosecution in the courts.
I hope this answers any questions you may have. Please feel free to e-mail or call me with any questions or concerns.

This is an update on your outstanding order. As we reported in our
last notice to you, we are working very hard to deliver your order. We deeply
regret the delay, but we are committed to fulfilling our obligation to you!
Fortunately, we have just acquired a portion of the supply needed to complete
the orders for the 13 July beanies (we currently have limited quantity of
7 beanies out of the 13), 12 Zodiac beanies (we have limited quantity of
6-7 beanies out of the 12) and Lefty, Righty & Libearty Buddies (we have
both Libearty and Righty).
If you wish we can, at this time, offer to deliver that part of your order
and deliver the remaining part at a later time. We realize this may still
be disappointing, but you may consider this the next best thing to getting
your full order now, which unfortunately we cannot do.
As our in hand supply is limited, we can only deliver this offer until our supply runs out. So, if you are interested, please email us immediately to request your partial order. Due to the volume of orders we need to streamline the process. Therefore, your request should only include your full name, shipping address and what you ordered. Any additional information or comments will delay the processing of your request.
We can send out your partial order as soon as we receive your email.
Please be advised that if you desire a refund of your payment we will be
unable to issue it at this time. We assure you that all orders will be filled
or refunded.
Thank you for your patience and understanding,
BreezeWay

promised delivery of auciton by Dec 20, 2000. Have not received auction
or refund. They've not responded to emails.
I had the winning bid on ebay for a Nipponia on 9/20/2000. As yet I have not received it. It has been four months and still no sight of Nipponia. I contacted them and still no satisfaction. I have been taken for $73.89. Hope someone can do something about this scam artist.
Just thought I'd let you all know---I had filed a complaint with the USPS, and got a reply from them today. The names everyone has on the Breezeway owners are listed as Pamela & Howard Asher. The name on the letter I received from the USPS was given as Jason Lim, and included the correct original address for Breezeway---4428 Sky Glen Ct., Moorpark, CA. I don't know what's up with the different names, but thought you should know. Thanks. Libby
I would like to add to the list of complaints about Breezeway, Inc. Apparently the principals are Pam or Howard Asher at 5142 N. Commerce Avenue, Moorpark, Ca 93021, 805/529-5263
I won an eBay auction (#415880214) on August 24, 2000. I have yet to receive the merchandise or a refund. I would like to lodge a complaint about Breezeway, Inc., for possible fraud in an internet auction. The history behind this action is as follows:
August 24, 2000 - I received notice from Breezeway, Inc., that I had won one of their dutch auctions (ebay auction #415880214) for the set of Ty Zodiac Beanie Babies. These beanies were supposed to have been shipped by December 20, 2000. (If necessary, I can forward all email communications that I have had with Breezeway, Inc.) I responded that same day with my address as was requested for confirmation. I paid via Paypal the total of $78.85.
October 21, 2000 - I was somewhat concerned about seeing other auctions for the same item by Breezeway that would ship sooner than the ones that I had won, so I contacted them, via email, as to when they would ship.
October 23, 2000 - JamieLynn of Breezeway, Inc., responded, also via email, that the "pre-sale order is in good standing. As a reminder, the terms of the pre-sale arrangement specified that your order will be shipped by December 20th."
December 10, 2000 - I received a disturbing email from SFowler@prodigy.net stating that Breezeway, Inc., was no longer a member of ebay and that Breezeway was not responding to any email requests for information.
December 22, 2000 - After several emails sent to Breezeway I finally received their form letter stating that they'd had circumstances beyond their control and would definitely ship out the beanies or issue a refund, but did not know a date for either response.
December 26, 2000 - I sent an email requesting a refund, but have not heard anything back from them since, even though I've sent follows:

I am another sucker. I purchased 12 Zodiac beanies on 9-07-00,(presell) to be shipped by 12-20-00, so far I have emailed them, called them, and the only response I have gotten was the form letter that was posted on your site. I contacted the police in Moorpark, and was told basically the same thing that Sargent Nelson said in his post to the other person filing a complaint on this site. Isn't there anything anyone can do about these bad traders? Thanks for listening.
Another victim of their scam. Paid 61.00 for presell of 2 chinook beanies.
Auction closed on 9/9/00. Received 1 message on my answering maching in December
about a delay. No response to emails. What a rip-off. How can they be

traders_name: The Asher Group I have lost approximately $256.50 (not including
insurance) for beanies won in E-Bay auctions in August. The first auction
was for 12 zodiac beanies, the second was for Buckingham, and the third was
for Nipponia. All beanies and shipping costs have been charged to my charge
card in August. Although they have sent emails proclaiming their desire to
make good on at least a portion of the order (partial shipment of 12 zodiac
beanies), they have failed to follow through. They have not responded to
numerous emails nor have they answered their phone. The phone message is
an automated response stating that they are "helping" other customers or
are currently unavailable. When the automated message is completed, a tape
instructs the listener that the mailbox is currently full. This same tape
has been in existence since December. There has little, if any, effort on
their part to fulfil their obligation. These people need to be stopped and
forced to make full restitution.

Update from: Lady_Brighid_69@Yahoo.com
One of the fine people who was scammed by Breezeway was told by the Ventura Better Business Bureau that they will no longer handle Breezeway complaints. I don't know why they have stopped taking the complaints, maybe there have been too many, maybe Breezeway is not responding to them.
This person was told to contact the Ventura District Attorney's office which she did. Robin at the Ventura County DA's office has given her email address and said for victims to contact her. Everyone needs to send her a brief note and tell her that you are a victim of Breezeway. If you have given me your information already please tell her that so she can cross reference you with my list this will cut down on the amount of work that she has to do.
Here is her email address: Robin.Estes@mail.co.ventura.ca.us the phone number is 805/654-3180. Also, please send your name, address, phone number, acution number(s) and amount(s) paid to me at: Lady_Brighid_69@Yahoo.com
I am also going to give her all the information that I have in regards to Sgt. Nelson's investigation and the fact that the USPS has now begun an investigation. My list of victims is now 145 people long and totals $13,611.99.
We're doing well. We are definitly on the right path. If you have the
email addresses of other auction winners please contact them and send them
to the website! We want everyone to get their money or beanies when this
is all over!

Hi and H E L P, Your name was given to me by Carol Shickel of the 'Good
Breezeway'; she said you might could possibly help me in recovering my $159.55
that
BreezeWay, Inc,
4428 Skyglen Ct.
Moorpark, Ca 93021, charged my master card account last year, 8-31-2000.
I was a successful bidder of 4 Chinook beanie baby bears @ $36.50 each plus
shipping and postage at $13.55 totaling $159.55. This was a preauction that
was to have been shipped by December 2000, or in time to use for Christmas
gifts. I then heard from them in Dec. and Jan. 2001 saying their mdse. had
not come in to bear with them a little while and all mdse would then be shipped
as ordered. Well, I have tried unsucessfully since March to contact them
but get a non working telephone # and no answer to my e-mails, with the latest
one in July being returned --evidently they have changed their e-mail address.
I am at my wits end as I had ordered 1 of these beanies and 2 other ladies
the remainder, as I said for Christmas gifts. So, I not only feel cheated
out of my $, but I really feel bad that my 2 friends lost out due to trusting
my judgement. So, guess I am pleading for any help you might get me on this
group. As I said all other contacts I have are coming up dead ends; and since
I am in Texas it is hard to get much done in another state, thank you in
advance for any thing you might have,

I have filled out forms that the US post office sent, that was done in Sept. 2001 but I have heard nothing from them since.
This company is now on the bad traders list. They live in Moortown, Calif. I think it is Moortown, they have had complaints filed at their police department, but they feel they have done nothing wrong.
It may be to late but I thought I would make one last try. Thank You
Juanita

AND 1737373363, ($53.00) auction ended June 4, 2002 at 14:48:24 PDT. This one had e mails from the above e mail address and CustomerCare@TheToylet.com
My last communication from them was 07/03/2002 8:05:40 PM Central Daylight Time and reads as follows: both your orders were shipped on time. please do not email us anymore. any further communication will be considered harassment and treated as such through the legal system.
This was after telling us that they are refunding our money. Based upon
their e mail of 07/01/2002 1:30:04 PM Central Daylight Time which reads in
total: Hello, I just wanted to let you know that we have received your e-mail,

as wished. Sarah:) Customer Care --CustomerCare@The Toylet.com. - we bought
the items from the local Hallmark Store and want a full refund.

I wish to inform other traders of this RUDE and GREEDY SELLER. I won an
auction on June 3/02 for an Addison Buddy for $14.99- I go through the check
out process to find out that he/she considers Canada an International country(BUT
it wasn't listed in his auction information- defining Canada as an International
destination) and charges $18.00US to ship ONE buddy- or $28.00 Cdn dollars.
I have NEVER paid this exorbitant amount for shipping of any number of product.
So I asked to have the shipping recalculated- he/she was uncompromising and
very RUDE. Gave me negative feedback for being a DEADBEAT (which I'm not...I
have 40+ HIGH praise feedbacks for fast payment). And then retaliates further
with follow up comments. This immature behaviour has affected alot of people
with bad experiences with the same...BAD SELLER- should be BANNED from EBAY!!!

Two E Bay orders. Both paid with Bank Money orders. Receipt acknowledged
by The Toylet. Inquiries were via automatic response. On 07/01/02 They sent
an e mail stating they cannot fulfill the order and will be issuing a full
refund. Based on this data, we bought the items locally. They they said they
are shipping and would not refund. On 07/03/02 they threatened that if we
did not stop e mailing them they would seek legal action for harassment.

Won 10 auctions on February 17, 2002. Was told I couldn't combine shipping,
so I ended up paying $80.50 for shipping and handling for 10 beanies. Then,
instead of getting them in 30 days as promised on the ebay auction site,
I finally received the first one on April 1, 2002. On March 24, 2002, I finally
got her to answer one of my many emails. She was rude, sarcastic, and still
didn't answer my questions about the status of my beanies. I put a complaint
into support at Ebay, and they said they would investigate. I waited patiently
for my other beanies. Then, when I started writing to her again and gave
her another chance to be civil, she answered me back rude and sarcastic and
called me a liar, and that was the last straw. When I told her that I wanted
a refund because I thought I had waited long enough, she sent me an email
the next day saying that they had shipped another beanie. In the mean time,
I had purchased another one on Ebay, so I ended up having to pay for 2 of
the same ones. Not once did I get a refund even though I requested one on
several beanies. I reported her to Ebay again. When I gave her negative feedback
on Ebay, she made her sarcastic comments, and took me to Square Trade. I
refuse to remove the negative feedbacks, so now she is starting another case
with another one of the Ebay Beanie ID's. The WORST Experience on Ebay I've
ever had. DON'T BUY FROM HER!!!!!!!!!!!

I won three auctions May 23, sent payment total for two on 5/26 and the
third on 6/4, but they contacted Ebay and reported me as non-paying with
NO request to me for any additional monies. Almost two months later, STILL
no beanies....They have also filed slanderous, false information with my
Ebay feedback (in retaliation of my posting neg. feedback about them) tarnishing
an otherwise pristine record. BUYERS PLEASE BEWARE THIS SELLER!!!

The WORST experience I have ever had shopping on the Internet and I have
been buying everything from computers, furniture to beanies. DON'T BUY ANYTHING
FROM THESE PEOPLE - You won't be dealing with a person, they won't answer
your emails but if you leave negative feedback they'll hop up and get online
to leave negative feedback about you which is totally bogus.

I won an auction of of ebay for a Mom-e beanie bear. After sending my
money and waiting over 3 weeks for my beanie with only automated responses
to my emails I called them long distance. I spoke with a woman who didn't
have a clue as to what was going on and said they didn't have the beanies
from this dutch auction (24 Mom-e bears). I asked to speak with her manager,
but so conveniently was not available. I left my number for them to return
my phone call. All that I asked was for a refund of my shipping price ($6.95)
and I would have gladly waited for this hard to come by beanie. The manager
was extremely hateful and the rudest person I have dealt with in my entire
life. She yelled awful things at me I would never say. I couldn't even get
in two words. I told her I would leave negative feedback if I didn't receive
my beanie. She said, "You're not going to get your beanie." She said I would
be lucky to receive a refund. She left me nagative feedback as soon as she
got off the phone with me. Of course I was not in the wrong, but she left
a negative response anyway. She wrote I should wash my mouth out with soap.
This is a total lie because I have small children that don't need to hear
the words SHE was saying. I did leave her negative feedback. I also had to
file a fraud report to recive my refund. She also had the nerve to ask me
to remove my negative feedback. They have 48 negative feedback for trying
to sell items they don't have. They leave negative feedback for everyone
who doesn't leave them positive feedback and call everyone liars and deadbeats
when they are left negative feedback. Ebay is looking into these people.
They should have their seller's license revoked. Mean, rude, and hateful
sellers who are only out to make a huge profit.

i have dealt with the people at TheToyLet. dont ask me to tell you her name because i dont know lol on june 8th i won an auction for 3 prinz von golds. about a week 1/2 later i get an email from them saying they are expecting a 2 week or more delay on the delivery of these beanies and if i want to request a refund i could do so at that time. so i did. she was HORRIBLY nasty and threatened to contact the FBI (yeah right lol they would have laughed in her face) and said i was harassing her and crap like that. i went ahead and gave them til july 8th to get the beanies to me. as of july 17th i still had not received them nor had they bothered to send an email stating that they were sorry for being late or whatever. no offers for refund, nothing. so i emailed and told them i want a refund. i finally got it. just be persistant with them. they will refund your money. i agree that it was the worst experience in my life to deal with such hateful, nasty liers but they did refund my money. they place auctions for beanies they dont have by the hundreds and when they cant get them to you by their due date and your request a refund, they get nasty with you. i suggest anyone who hasnt dealt with them to not do so.
Good luck to all that have dealt with these people. THEY WILL REFUND YOUR
MONEY. give them a chance and just ask for it. mel

I won 5 separate auctions from the Toylet on the same day. I went through the eBay billing process for each transaction which sends a request for an invoice to the merchant and in the 'comment section' requested that the order be combined and the shipping costs adjusted accordingly. All within a day after winning the auctions. I then went to eBay to pay after a day or two (I'd have to go back an look at my emails) through BillPoint when I received notices from The Toylet. On each of the notices from The Toylet, I had to complete my address and then I had to do the same thing when I entered the BillPoint invoice. Only one invoice on BillPoint had shipping charges, it happened to be the first on that I opened to pay. None of the others had any shipping charges. I thought that the Toylet had combined the order and was only charging shipping on one. My mistake. To say thank you, I paid an extra $10 on one of the invoices. I paid all the invoices at that time. I get back requests for payment from The Toylet. I send them emails. No response. I place negative feedback on one of the auctions and get an IMMEDIATE response that was very offensive and then the Toylet places negative feedback about me in response. My first feedback simply said that their billing process was complicated but they responded with "Deadbeat ..." Feedback given in defense - not because I was not paying! In the meantime, I receive a credit of $3.05 from the Toylet through PayPal which I do not have an account. I emailed BillPoint and asked how I could go back to the invoices and pay the shipping charges and they say I can't do this. I then go to BidPay and pay the shipping charges less the $3.05 (a credit that I cannot retrieve because I don't use PayPal).
I place negative feedback on all the items that I won from The Toylet and they respond that I am a Deadbeat and haven't paid them which I have. I placed negative feedback on the Toylet because of lack of and rude customer service, underserved feedback from them.
I will never buy from them again. Now, the Toylet applies the $18 shipping my invoices but now the $3.05 shortage (my credit) is left open on the most expensive beanie. I send emails and emails about how I do not use PayPal. I ended up paying the $3.05 through BidPay and PayPal said the $3.05 will be returned to The Toylet if I do not retrieve it in 30 days. They made $3.05 seem like hundreds of dollars. Think about it, you have a customer who is a serious collector and you won't solve a $3.05 problem.
In the meantime, I have not received the $49.95 - Prinz Von Gold or the
$39.90 Graf Von Rot beanie babies. The Toylet's feedback on me is completely
undeserved and bogus. They only respond to negative feedback so that's the
only way to get them to answer your emails. They place negative feedback
in defense of the negative feedback that I left NOT because I did not pay.
I made a mistake in assuming the shipping charges had been applied, I went
back and paid the shipping charges (overpaid $3.05 actually) and still have
not received all my order! If I do not receive the goods by next week, I
will call my credit card company and report this. Thank you, Debra

In May, I ordered 6 Asian Pacific Bears. In August, I received 4. I kept
getting excuses about why the other 2 had not been delivered. I was told
3 weeks ago that I would receive a refund of $33 within 10-14 days. Now this
company is not on ebay and will not return my emails. I'm sure many other
people are out money. Firm is also known to use the name of Breezeway. Pam
