Comments: I ordered 100 Lacoste shirts for a total of $1300.00 from this couple over three weeks ago. At first I was suspicious b/c they could not provide me any tracking numbers and had a very lame excuse as to why. They assured me the package was sent USPS Priority mail which is typically 2-3 days. As of today (6/22/05) I still have not recieved any shipment. They actualy said they did not want to do business with me again b/c of my not trusting the situation which is fine with me. They said they were going to return the difference of my money to me since they supposedly only sent 25 shirts form the original order. The refund was supposed to be a refund of $975. Once a week it seems they try to pacify me by telling everything is ok and that they were out of town therfore could not get back to me. I have said that it is getting to a point in which they are the ones thatare going to have to return my money, and there response is that they have to get the money back from the supplier. Which is a bunch of bull...since they are the agent representing the out of the country dealer they are responsible. So give me my money and then they can be reimbursed by the dealer. Anyway, three weeks later I still have not recieved any shirts or refund. As of today I am filing a police report with the Albany PD and with the FBI Internet Crimes Division. Any suggestions are welcomed.

Comments: Seller listed an evening gown with incorrect size. When I attempted to return the gown the seller refused a refund even though it was the sellers error. Went through paypal resolution and it took almost 2 months but it was decided in my favor. When paypal tried to refund me from sellers paypal account there was not enough money. Seller does not answer my emails. Although I went through the proper channels to get a refund I am still out monies. BEWARE of this ebay seller BRIELLE1000!!!!!

I have also been ripped off by this company and Mr. Marc Chisholm had promised me a $300 refund and it never came. I have all documentation, all my payments to them and all emails I sent to him at Americana Couture and all emails he's sent me in the past year. They really are crooks and I don't know how I can ever get my money back!

Comments: This seller is no longer registered on eBay; I suspect the name is not his real name. He has been selling items purchased with stolen credit cards (read ebay feedback). He accepts payment only in electronic gold (eGold), which is virtually impossible to trace. He did not reply to emails for days. He listed auctions with items in different locations across the country. He sent me an item from "Target.com" and it arrived from a FEMALE in California (he is supposed to be in Washington State). Beware of any seller requiring eGold; he may have created a new identity on eBay; and they won't help you if you get swindled by him.

Comments: I ordered from Cindysbeans on April 21st Sea Center exclusive Opie. I ordered BEFORE they went on sale April 23rd at Sea Center and LONG before Retail version was announced.

Sadly I received retail version..even though it is IMPOSSIBLE I ordered retail version as retail version did not exist when I ordered.

I just wanted to update you on my situation with Americana Couture. I hadn't heard a peep from Mark since April 5, when he apologized for the delay in getting my order out.

Yesterday, I received a "Complaint Activity Report" from the Tucson BBB. They received an email from Mark regarding my situation on 6/6/05 saying "Refund Already Given." This of course, is not true. As the original Credit Card has long been closed, the only way he could refund me is by check. No check has been received.

I am so disappointed, I gave them another chance to make good and all I got in return were more lies.

Message from Mediator, Pat

A new scam is being perpetrated on eBay. User IDs have been hijacked, and the person using them is selling lawn and garden equipment for thousands of dollars. He will only accept money by wire transfer. He claims to be in Spain, but has an Estonian email address (ending in es). He says the equipment is in Texas, and shipping is included in the price. He offered the items on the hijacked accounts, but sells off eBay through what he calls eBay International Trading Co. This is a fraud.  He leaves his auction up for one day. He usually offers two expensive lawn tractors or other equipment at a time, and offers a buy it now price if you wire the money immediately. He has used such names as
Daniel Alexe, Daniel Enache, Panait Cristian, and Thomas Shea.  If you have received any email from any of this names, or anyone else who fits this description, please let me know. EBay is aware of the situation, but this person has been able to stay one step ahead of them.

Never, never pay for anything via Western Union money transfer or moneygram. It is not a safe way to pay.

If you are an eBay user, please check your account daily to be sure that nothing is listed that you personally did not list. If there is a problem, contact eBay immediately.

Comments: I ordered 5 books on woodburning over one year ago and I never received them. I was promised a refund and never received one.

I was told the items were shipped a second time. Still I never received them.

I would have thought they would have insured the second shipment, but it never arrived, I was never refunded and they refused to answer the email requests.

They also refused to answer their telephone.
