Hello my name is Debbie Orlando and went though 2 years of tring to get a $60 fefund from americana couture .I never received my refund ,this company lied about shipments and I had to get fed ex involved. When my shipment arrived the order was wrong 2 times, they talked me into adding more crystals to one shirt for 60 extra dollars and the shirt came without the 100 extra crystals.I was calling them on a weekly basis for over 1-2 years when I finally gave up!

I want to post a warning for folks to NOT trade with Carlos Elias. He has two different email addies that I am aware of. After not receiving response to my emails about my end of the trade, I found someone else was having a problem, and I got another email addy from them.

I have been waiting since Feb. 28th for a Black Starlight he owes me. He keeps saying he sent or will send, but to date nothing received, and no promised tracking #. I have run out of patience on this trade, and want to warn others to avoid him.

He lives in the UK.

I am so glad that these liars are getting what they deserve. They have 53.00 of mine that was never refunded and I never got the merchandise. My emails looked very similar to those in the forum. Everyday it was another excuse. I can't believe people could just tell lie after lie to so many people. My orders began in October 2003. I, too, reported everything to the BBB, but I don't think it really made a difference other than alerting others to their fraud.

The bad thing is that they had such beautiful and unusual clothing...too bad it had to owned and operated by scum.

May I also add that when I got angry about the lies and deceit, Mark Chisholm told me that he would add my name to a list of others that would be PROSECUTED for making FALSE CLAIMS! Can you imagine that? He steals my money and I get "reported"!!!

I purchased a Red Hat Gund bear and sent him the money immediately by Paypal.

When the bear arrived I found it slightly damaged due to the very thin envelope and no protection whatsoever. I felt a neutral was warranted and posted my feedback as such with that explanation.

Brat3 retaliated with a negative and a very nasty comment. I have now requested a mutual withdrawal of feedback(s) and continuing his retaliation, he has refused. I feel this is worth posting.

I was a victim of an elaborate ebay safe harbor scam in the form of a second chance bid and involved western union im out $700 SMKSALESCO is the AOL user that perpetrated this scam posing as the seller. AOL has done little to nothing and its near impossible to notify ebay iv emailed www.ic3.gov And filled out a complaint also. What other course of action can someone take?

I bid on the following eBay auctions and won 3/22/05 from juliaslittlegiftshop. I haven't received anything and now the seller is no longer registered at eBay and has gotten some negative feedback. Via email I was told after I inquired that my items would be arriving shortly. Almost 2 months later I'm still waiting.

I have a major issue with not receiving my order I placed around March 2004! They still email me back and pull me along saying "oh, it will ship in 2 weeks". The 2 months go by and still I haven't gotten the package. So I email them again, and they say, "oh sorry, it will ship this coming week actually". I have most all email correspondence between us if you are interested.

Mark responded to the BBB by posting a rebuttal in which he said I let them know a chargeback had been issued. Once again, another lie. I posted the reply saying so and it's now back in the BBB's hands. I also sent the e-mail below. I just can't believe that with 33 complaints, an F rating and all the other investigations initiated - they continue to be in business.What they don't realize is I am very strong-willed and will continue to go after them for my money.

I have also been ripped off by tweety78. I paid for 11 beanie bears and only received one of them. She will not answer my emails. I got a letter on 5-29-05 from her attorney in California saying she filed Chapter 7 Bankruptcy. It said not to email her, phone her, or mail her letter about the money she owes me. She owes me $221.35. I have emailed Ebay and PayPal, but go no help because of the time frame. I ordered black and white starlight on 11-12-04. I received the black. but not the white. Her emails to me kept saying they would be shipped soon. On 2-17-05 I ordered the 2 new German bears and the UK Mum,I never received them either. On 2-28-05 I ordered the 6 2005 Asia-Pacific set, never got it.

I went and talked to a FBI in my town today and then he had me file a claim with the IFCC. He is checking with the lawyer and trustee on her bankruptcy case to see what I can do.

My question to you is can you tell buyers that got ripped off by her to file a claim with the IFCC at www.ifccfbi.gov/index.asp

The more buyers that file a claim the better are chances are to put a stop to her fraud. Then maybe she won't come back in a few months and open a new Ebay store under a new name.

I didn't complain to Ebay or PayPal before because she kept answering my emails that they would be arriving soon. Of course, like a fool, I believed her. I have dealt with her for over 3 years and this is the first time I had a problem. I have probably bought over $1200.00 of beanies from her. I don't know if I can mention her name or not, but it is E.S. from Moreno Valley, Ca. Please tell people to beware!

I am just writing to tell you that today I received a letter in the mail from the UNITED STATES BANKRUPTCY COURT in the Central District of California.

It seems that Estie Sawyer has filed for Bankruptcy on April 22, 2005.

I was VERY fortunate that Paypal decided in my favour and reversed 2 Paypal payments that I made to Estie Sawyer on March 13th and March 17th for 2 auctions that I never received.

I emailed her numerous times and received no reply so I notified ebay who advised me to file with Paypal.

On April 19 I filed with Paypal and 10 days letter, I got my money back !!!! I am so impressed and so glad that I didn't wait any longer before I filed !!!

Please update her page on the Bad Traderlist !! I know of at least 2 other people who emailed me about the same auction as she has more than one item available. Nobody had received anything and were in the same boat as myself.

Now that she has declared bankruptcy, I hope she has some assets that can be used to pay her creditors !!

I got my trade, but it was late. We traded on the 16th for winetags that expired 4/30. I got them April 29th with a postmark of 4/26. I contacted the trader and she was rude claiming she sent them out on the 17th so she doesn't know why it was postmarked on the 26th.
