Comments: This is a follow-up to a complaint I originally filed. I contacted "John Contreras" at the phone number mentioned on the complaint page and was basically told by "John" that he has no contact with "Rick Metal" but would forward my information to him. This was about 2 weeks ago. I called him again today and was given the run-around once again. He claimed he gave "Rick" my information but failed to give him my phone number. Who knows??

This all started when I purchased some cards with the "buy now" feature at EBAY. He was payed promptly through Paypal. After a reasonalbe amount of time due to shipping taking some time, I emailed them regarding the purchase and have been lied to constantly since then. I have filed a complaint with the USPO. I also contacted "ebay" and "safeharbor" regarding this matter and they refuse to help or sanction him in any way. All I receive from them are automated email messages saying nothing. rmmc_enterprises practise fraud. Sure they have 100's of good transactions, but if you read their feedback closely, and look at the negatives, you will clearly see a pattern of deception.

I emailed them which the ignored. Then they did not even send me the last 3 boxes. They charged 341.05 on my discover card and then didn't even send the boxes. I started looking into it and have found that they are on your sight. I contacted a Contreras subject but he claimed he knew them but was not associated in any way. He knew information on them but refused to give it. I still have a box with the return address of Allison Simms, 1914 Woodcrest Court, Tracy, Ca. 95376. That is how I was able to track them down to your website. I am going to contact my Discover card and the U.S. Post Office. Do you know the number to the District Attorney in Tracy, Ca. Comments: I purchased a set of yu-gi-oh cards for my son using the "buy now" option on Ebay. I paid using paypal. Seller agreed to send purchase to my alternate address and not my paypal verified address. I have all of the correspondence to prove this. After a few weeks and not receiving the merchandise, I contacted them and was told that the product was mailed to the paypal verified address and as soon as it was "returned to sender" it would be forwarded by RMMC enterprises. That never occured and I was forced because of the lack of email responses, and them not responding to "SquareTrade" to post negative feedback. He then posted, calling me incompetant. I started doing a search of their feedback and see an obvious pattern of what I would call fraud. The total amount of my purchase is only 14.44, but thats not the issue. I paid for a product, and service and upheld my end of the sale, and got nothing in return. Even more disturbing to me is the fact that Ebay continues to allow this seller to do business on their site. I enjoy Ebay very much and this was my only bad experience. I was shocked to find the other complaints against RMMC enterprises. I have filed a fraud complaint with the USPO in this matter. Its a shame that 14.44 was worth all of this. I'm 42 years old. These cards were for my 14 year old son. Beware of this merchant. They move an incredible amount of product and I can understand that mistakes happen. But its obvious this is no mistake. They want you to see all of their positive feedback. Well as of this writing, they had 8 negatives in the past week.

Beware of Jason Andrews, whose real name is Jason Scott. He still owes me my cards back or trade cards. Here is information on him. I think this contains all the information you need on this guy. I will not give up until I warn everybody about this scammer. The first trade with him was really smooth, and all his emails seemed sincere. Guess this spoils it for me on sending cards out first on large trades. I am sure he will just change his email address, but Yahoo will not let him change his user ID. After checking around and finding that he was not using his real name to get mail, or his emails, I think it was a scam from the start. I will file postal fraud charges on him, as the total amount of the cards was around $60.00 to $70.00. I mailed him a package on October 14, 2003, with Delivery Conformation. The number was 0302-1790-0001-2817-7545, which he received on October 17 at 12:29PM. Last email from him was on October 19, where he promised to send me the cards.

Comments: Bid on a pre-sell auction, won, and sent info to this seller that I would send payment right away. Viewed Traderlist (a regular thing for me to do)and seen AFTER I won auction, complaints on this seller, but didnt know they had a complaint on them until after the auction because the post wasnt put up until after auction closed and I had won. I then find out that this seller has a bad traders page. I sent seller an email asking that due to the nature of these complaints could I send payment when they got the item in hand. The seller proceeded to call these complaints lies and threaten neg feedback and a report to Ebays non paying dept.if I didnt have payment sent to them in 7 days. I dont know about the rest of you, but I refuse to send money to anyone that is known to not refund money when merchandise hasnt been delivered. I never said I wouldnt send payment to them initially, I asked if I could send payment when they received the item in hand due to the complaints here on Traderlist. Their email proved to me that they snub their noses at feedback when it comes to a buyer questioning theirs, but will play double standards when it comes to the buyers feedback and will threaten to hurt theirs should the buyer take their neg feedback into consideration when dealing with them. Seeing as this seller now threatens me and doesnt care that they have a page on traderlist and feel they have room to threaten someone, I am here in front of all the world to say that they will NOT get a dime from me. I have always sent payment with the fastest of speed, check it out for yourselves at Ebay under LawBaby32. This seller actually thinks a neg from them bothers me, laughable. This post is purely to let you guys know this sellers business practices. This seller feels that I should close my eyes to the complaints filed on them and send them money despite those complaints. I feel that if the seller was as dependable as they say in their auction, they wouldn't have minded me sending payment when I received the item. Use caustion when and if you deal with them.

I have filed a report with the FBI and received a mail back saying they will be looking into it for me, because I am in England does not matter, it was a fraud commited in USA so I can get the FBI involved. "Greetings!!

Now what do these few critics, with a hidden agenda, want me to do? NOT AUTHENTICATE the new release Mukluk if it has the left eye green and the right eye blue? I know for a fact I will receive them with altered eyes... I also know there are authentic Mukluk available with 2 different colored eyes and also with 2 white eyes (the more common variation). The altered eye Mukluk will not be authenticated! The unaltered and authentic 2 colored eye Mukluk WILL be authenticated!

I am authenticating authentic Ty Beanies and authentic Ty tags!! I am not authenticating Beanies that have evidence of any alterations. I will authenticate rare and older colored new face Teddies with the wrong ribbons or missing ribbons!! Read the explanations written on the certificates: "Original Ribbon", "missing ribbon", "wrong ribbon", "replaced ribbon" etc. I can not and will not accuse the collector sending in the authentic Ty Beanie of altering, changing or removing the ribbon!! The store owner may have or another collector may have done something and of course YES it could have been released by Ty without the ribbon, etc!! I have purchased many Beanies missing eyes, wrong tags attached, etc. etc etc.

I am not the person ruining the collectable market regarding oddities and variations, It is the people with an obvious hidden agenda that spend wa-a-a-a-y too much time criticizing my professional standards that are trying to ruin the collectability by their passive-aggressive character assassination. Are these critics and complainers truly concerned collectors or are they just looking for free advertising on behalf of a competitor/s? The legitimate collector reads what is written on the certificates before placing a bid and often times emails me before bidding on the auction!!

Isn't it strange and unusual that these critical people don't attack Ty for creating the variations? Why are they attacking the sellers and me, the authenticator? For example: The wingless Quackers......... There are thousands of altered wingless Quackers that I have never authenticated! The list can go on...... Remember you must consider who is doing the complaining and on behalf of whom?

I too have many friends and supporters who would gladly criticize my competitor/s on Ty's boards, on my behalf, however, my professional standards are too high and I discourage this type of vicious and slanderous behavior. Its not fair or appropriate in any professional or personal setting.

Comments: In May of this year, I agreed to be a diaper tester for this WAHM. I paid $13.95 through PayPal to order one test diaper. Several months later, on July 7, I received an email confirming that he had 2 dozen diapers ready to send out. According to the last order status doc that she sent out, my tester should have been in that batch. As of November 8th, I've received nothing. She's not responded to friendly emails or those indicating I would pursue legal action.

Comments: I too am a victim of Mischa McGehee of Cuddle Me Close. I paid $28.49 on May 18, 2003 for 2 of her All in One tester diapers, doublers and shipping and have yet to receive anything. I have emailed her several times asking for my money back and she will not respond to my emails. There are many other people that she has scammed as well with her fictious diapers and slings and whatever else she has sold on her website. And with in the past week she has shut her website down. Comments: I agreed to test her AIO diapers, and sent 13.35 to cover the diaper, a doubler and shipping. This payment was made via paypal. After receiving many emails and promises of shiping over the next few months, Mischa suddenly appeared to fall off the face of the earth while "away seeing family " for a few months. Email requests for updates and then refunds were never responded to, her webpage has now been pulled and she closed the yahoo group she originally created for "testers". I know of 17 other women who are in the same situation, but there were a total of 107 as a part of her yahoo group, so the number who have lost money to her may be much greater than we know. I have made every attempt to be reasonable, understanding and patient, but she is not willing to communicate or respond in any way.

Comments: This person lured me to a yahoo group called cuddlemeclose@yahoogroups.com (which she closed tonight) and was offering tester diapers for a price, in exchange for feedback about the item. I paid $10.95 total back in April/May, and never recieved a product. I was being patient as she was expecting a baby, then she had the baby, and I was still patient. I even stayed calm when she emailed the group to say she would be out of town for a COUPLE OF MONTHS, and would work on some of the diapers while she was gone. I recently emailed her when my daughter potty-trained (don't need diapers anymore) and she never responded. I have since been in contact with the other mothers who were in the group, and haven't heard from one mother who DID get a diaper. She also sold slings and other products on her website (cuddlemeclose.com) but she shut that down tonight, too.

Comments: If anyone has ever had a complaint against Dave, Dale, or Kelly Borders please check their bad trader page for help. There is a Peabody Police Detective who will help you with your dispute with the Borders. I had posted that I had got my money back from Dale Borders thanks to the Detective but that was premature as when I did receive the Postal money order I could not cash it. I live in Canada and Dale Borders sent me one that could only be cashed in the USA and I think he knew this when he purchased it but have no proof. I had to send the money order back to Detective Rob Faletra and hope he can get Dale Borders to get the proper International Postal money order and resend it to me. I will keep you posted on the outcome of this as I have been after Borders for a couple of years now.

Comments: On October 16, 2003, I ordered $159.81 worth of beanies. On October 27, I enquired as to how my order was shipped and how long they expected it would be to arrive in Canada. I was told 7-10 days and it should have arrived last Friday. Today I received a refund from paypal with a message from beanieconnection saying, that due to my location, they were unable to ship to me. I am so angry that they kept my money for 3 weeks, told me that it was already shipped, then tell me they never did ship it. I have always ordered my beanies from the US and have not had a problem with them being shipped via USPS.

I was buying Christmas beanies, among other things, to put in gift baskets for our upcoming Church Ladies Tea. I am upset that I wasn't given the opportunity to order my beanies from somewhere else, in time for this event.

This really is poor business practice as well as being very inconsiderate. buyer beware.

Comments: Was winner of Stephanie Carter's eBay auction for VHS videotape of miniseries. Stephanie contacted me with item amount ($22.50) and stated that she preferred PayPal for payment. She also mentioned that was due to enter the hospital for surgery and that shipping would be temporarily delayed. I responded that I didn't mind (thinking it was only a matter of weeks) and paid via PayPal on July 7th, 2003. I never received my merchandise.
On October 6th, 2003, I contacted Stephanie in regards to my merchandise, as I had been more than patient and had already noticed that she'd again become active on eBay. She replied that she'd already sent the videotape, then claimed the item was part of a "mix-up" but had been insured and stated that she'd immediately send a replacement and inform me on what had happened. She never contacted me again.
Since then, I have sent two more emails that have received no replies. I've contacted eBay and PayPal and sent a money request via PayPal to Stephanie. I've also contacted the Postmaster General, the Federal Trade Commission's Internet Fraud site, Fraud.org, and the Internet Fraud Complaint Center. I do NOT take being ripped-off lightly.

During the past week, Traderlist has received comments and questions from readers who are wondering why we waste our time posting messages about sellers who sell counterfeit items. The following is our answer to these comments.

We have read the auctions, as well as all the correspondence between the parties involved, as we always do when we are asked for help.

It is the seller's responsibility to be sure that the items sold are legal and authentic. It is illegal, knowingly or unknowingly, to sell counterfeit items. Just stating ignorance is not acceptable in the eyes of eBay or the legal system. This infringes on copyrights which companies they take very seriously.

In addition, it is a felony to sell counterfeit items, and the FBI will assign a case number to a situation if the victim files a complaint. The complaint will then be sent to many other law enforcement agencies responsible for Internet and Postal Fraud.

It is also illegal to send counterfeit items through the US Mail, and a complaint can be registered with the US Postal Inspectors. The seller will receive correspondence from the USPIS.

As a respected dealer, it is up to a seller to offer an immediate refund to the victim when it is determined by authentication that the items received are counterfeit. Once a refund is received, the seller should be notified that the items will be marked as Counterfeit, and returned. The seller should destroy the counterfeit items. The Authenticators frequently testify in court concerning problems such as this.

We appreciate your interest and views on this subject, and taking the time to voice your opinion. Our job is not to take sides, but merely to inform the alleged perpetrator about the law, and the consequences of ignoring it, and to try to obtain reimbursement for the victim before law enforcement needs to become involved.
