I was told that you could maybe give me some info about how to deal with
Daniel DeCosta of BeantownMaine. I sent BeantownMaine a box of buddies and beanies, worth $108.60, the beginning of October 2000. It arrived on October 4, 2000. I had delivery confirmation. My check didn't come and I kept emailing Dan. It was always an excuse, like the check must have gotten lost. And maybe we should wait another couple of days and things like that. Finally on 11/14/00 I received a check for the $108.60, which I instantly cashed. I thought finally this was the end. Well, on 12/22/00, I received a letter from my bank where I cashed the check, that it had bounced 3 times and now I had to come up with money before the first of January or they would turn it into a collection agency. So I had to take the money out of savings to cover the bad check. I immediately emailed Dan and he started again with his excuses. The last I heard from Dan was on 1/8/01 when he said he was mailing me a money order for the $108.60. Naturally nothing has come. So could you please offer any advise, as to what I should do now? Thanks for any help whatsoever. Pat Macurdy

traders_name: beantownmaine (Dan DeCosta) Comments: I bid and won an Osito
Buddy and Germania bear on e-Bay on December 18, 2000 and I paid immediately,
via paypal to this verfied PAYPAL member, who is supposed to be Dan DeCosta,
we e-mailed each other a few times, to confirm shipping options, and I never
heard from in for some time. On Dec 25, 00 I look at his feedback, and he
have at least 5 negatives over a period of 5 days! And also he/they are no
longer a registered user!! I can't even post a negative feedback! I filed
a FRAUD and complaint to e-Bay already, however, that got me nowhere, since
my items where not over $35.00 USD, so there is NO insurance coverage, and
I tired reporting to Paypal, and they were no help whatsoever! So now I am
ripped off for the 3rd time in one month from a USA seller, and sadly because
I am in Canada, I can not do too much more! This guy had a professional
beantownmaine.com website, selling beanies, and surprisingly now, it is shut
down (due to legal complications....how convenient!) -- BEWARE of this guy
and company!

traders_name: Dan Decosta Comments: Won several Ebay auctions for beanies
& buddys in late November. Had problems making arrangments for credit
card payment but all that got cleared up & was due to receive right after
Xmas. Got box & only got 3 or the items AND the DARK peace buddy ended
up being pastel. Emailed him as to where were the other 2 items & what
was I to do about the mis-ship. Finally got back to me to say other 2 were
on there way & we agreeded that I would keep the buddy. Other items have
never arrived, he no longer responds to email, & just found out from
Smartcollecting that he is scamming EVERYBODY! Apparently doesn't pay for
incoming purchases either. To make matters worse, he has been booted off
Ebay but has managed to get back on under another id. Watch out for Daniel
Decosta dba Beantown Maine
Ebay id: beantownmaine.com
email address:info@beantownmaine.com
NOW LISTED AS
myfatuncle.com or fatbuffalo.com both with same email of ceo@myfatuncle.com.
A quick check of the Ebay info shows all this points back to Mr Decosta.
Ebay has been contacted & requested to suspend the new accounts as well.

Cautionlist had complaint about him in beginning of Jan. When emailed about
it he did reply and make good. Since then other complaints have come in and
he does not reply to emails sent to him.

I've already posted a complaint on him on this site already, and tried
warning others on the Smart Collecting CN site too. Just a recap again, I
bid and won an Osito Buddy and Germania bear on e-Bay on December 18, 2000
and I paid immediately, via paypal to this verfied PAYPAL member, who is
supposed to be Dan DeCosta, we e-mailed each other a few times, to confirm
shipping options, and I never heard from in for some time. I almost e-mail
him each day and now his info@beantownmaine.com e-mail address is no longer
in service either, as I know he was getting his e-mails before. Well, it
looks like I am still out this $28.00 total, it is a small amount (big for
me though!), therfore e-Bay insurance will not cover the losses, since there
is a $25.00 deductible. Dan is operating under a new business site called
"myfatuncle.com" DO NOT buy anything from him, as he WILL not send items
to you or refund anything you buy! I DON'T want to see Dan ripping off others,
and I told him in my prior e-mails, that I would tell as many people what
a con and fraud he is!

Comments: In Oct 2000 my granddaughters and myself and two other friends
sent many MINT tag covered Beanies to beantownmaine per their web site. We
are owed $130.99 and $452.00 respectively. I have emailed Daniel over 50
times with no replies. I have filed with bbb and mail fraud and no results.
Seems like there are many of us who are in this same position with Daniel
De Costa. HELP!!!

I ordered a Ty Quackers without wings Buddy 8-10-00. Order was placed
on BeantownMaine's internet store and paid in full with credit card, $150.00,
plus S&H. Multiple e-mails transpired with the promise that the item
had been shipped, but alas, I never received the item. Then the e-mails from
Dan DeCosta became more terse, with the comment " I am looking for one for
you. I will let you know when I find one". Finally he refuses to answer my
e-mails and apparently has my e-mail address blocked,as all my e-mails are
returned as undelivered. Beware of anything with Dan DeCosta's name attached,
and do not buy from myfatuncle internet store, as that is the new name for
BeantownMaine,of Scarborough, Maine.

Dec. 7, 2000, I ordered 'Chinook' the Beanie Baby. My credit card was
charged the same day for $97.50. I contacted him when I had not received
the item. He said it would be forthcoming. Later, I realized he was 'in trouble'
with a number of people. He assured me that I would receive the beanie soon.
I have yet to receive it. He refuses my emails. I get the message that my
mail is un-deliverable. I trusted that he was in financial trouble as he
stated. I even emailed him, and expressed my sorrow for the problems he and
his wife were experiencing. I'm very disappointed in him, and realize that
he is not the honest person I thought he was! I don't know where to go from
here. I only hope that he can be stopped. I notice that there are other
complaints against him.
