Hi... I was wondering if you have any previous info on this person. I did pay him $610.00. My gut tells me I'm deadmeat.  PLMK if you know anything...On the face of this it may seem that I am overreacting (or reacting prematurely). But I really really do not think so. I hope I'm wrong but I do not think I am. I've been at this awhile now and sometimes you just know. Your gut knows.

After emailing this person (David Gindles) PRIOR to bidding on his ebay auction #562999056 to inquire as to when the item (set of 6 Buckingham Buddies) could be shipped to me FROM FLORIDA, he replied that it could not go out on Saturday 2/24 but could go out Monday a.m., 2/26. So I placed the bid and was high bidder. I sent the PayPal funds of $610.00. Since we are both on AOL, I can tell if he has opened my emails. He didn't open my 2/24 email until 2/27 (the day AFTER shipment was promised). He then sent me the following email:

I bid on your auction SOLELY because you indicated in your email to me that these items would be able to be shipped on Monday morning (i.e. you were returning Sunday night). As you likely know, the price of new Beanies and Buddies falls VERY RAPIDLY. You advertised this auction as product IN HAND (Florida). I emailed you specifically regarding shipdate info and you said "Monday Morning". Now you are saying "as soon as we can". I am finding it slightly odd that prior to this week, you have never run any auctions for Beanies at all before, ... (and all your feedback is as a BUYER) now suddenly you have begun with NUMEROUS auctions for large quantities of expensive Beanies/Buddies (foreign). I was not able to locate any auctions (or seller ratings) for you on Yahoo.  There have been a great number of instances on eBay, etc, where a person has built up FB as a buyer and then blitzed the auctions as a seller, subsequently not following through. There have also been numerous cases where sellers offer a hot item as IN HAND, but then do not ship until they can obtain the item at less than their auction closed at.  Even though the vast majority of sellers are honest folks, a few bad apples have caused many buyers to be very wary.

On 2/26 when you had not yet opened my 2/24 email, I initiated a eBay User Inquiry to obtain your phone number. I dialed that phone number and was told the number was not valid (even though you registered with eBay only about 6 weeks ago). Seminole FL even has a different area code according to Directory Assistance (who had no listing for you either). Seminole Heights is 813 but no listing for you there as well. Please understand that I am not accusing you of anything -- I simply want what I paid for, and I want it in a timely manner according to your response to my email PRIOR to my bid. I am now concerned due to some recent things I have read. I understand you are a busy person. So am I -- hence my being up at 2:45 in the morning. I shipped out 47 packages yesterday myself (online orders: website: email posts).... and all of those people had just paid on the weekend or yesterday. I included $10.00 for shipping my items which should more than cover shipment via Priority Mail with Delivery Confirmation. If you cannot mail my items (in mint condition as stated in the auction) ON TUESDAY, 2/27/01 via USPS Priority Mail and provide me with the Delivery Confirmation number via email on the same day, then I must respectfully insist that you return my PayPal funds in the amount of $610.00 no later than 6pm EST on 2/27/01 or I will initiate immediate action. Then, oddly, right before I clicked SEND, I got email from another person that he had cheated. he will email you about this also. But after all of this I do think that I have been scammed. thanks for any help that you can give to me.

2/27/01--today I spoke with Janet at metaexchange.com and she indicated that yes, his selling privileges have been suspended with metaexchange. I obtained a different address and phone number for David Gindles from Janet based on her records.I dialed that phone number and got a voice mail service. I left a message with my phone number, requesting an immediate return call. Nothing since.) (941-778-1466)

IN SUMMARY:

1. This person advertised in his listing IN HAND in the USA items.

2. This type of item falls quickly in value which everyone in this industry knows.

3. I am not interested in either falling victim to his SCAM and receiving no merchandise, nor am I interested in taking delivery of this item set at a LATER time after the prices have fallen. (That is called a PRESALE and must must must be represented as such on ebay with specific guidelines if it is such.)

4. Regardless of any of the above, there is evidence of PRIOR FRAUDULENT ACTIVITY by this person. He has already been suspended on a major buy/sell site.

5. He listed a bogus phone number with eBay:

Dave provide them with yet ANOTHER address for himself (to which this seller shipped the auction items on which Dave was high bidder)... All the while he was seemingly gathering FB as a buyer so he could do the "seller fraud blitz": This is the address that person provided:

8. A person should at a minimum find it ODD (and frankly, suspicious) that someone who has been a BUYER ONLY for 6 weeks since his eBay registration would all of a sudden come up with THIS MANY items to sell.... all expensive and in high demand! People just do not "get into the beanie market" in the manner!.

9. Many times fraud is successful by a scammer because by the time everyone starts worrying about it, he has managed to obscond with THOUSANDS of dollars first. Then he disappears and covers his tracks.

I realize it has only been 3 1/2 days since I won the auction and sent the payment. HOWEVER, I FEEL VERY STRONGLY that PayPal should LOSE NO TIME WHATSOEVER in FREEZING this person's PayPal account until this matter can be investigated and resolved, since there is evidence of Prior Fraudulent Activity.  Sincerely, JJ Dufek

I was referred to you by a bidder/customer who was having difficulties with a seller by the name of David Gindles (sweet2001viper@aol.com) who had taken his money and not delivered the product. Mr Gindles has continued his pattern of fraudulently selling items on MetaExchange, eBay, and yahoo! that we know of, and probably much more.

We are a collectibles business located in Nevada and we matched up on MetaExchange with Mr Gindles for 12 Buckingham Beanie Babies and sent him $853.00 via PayPal, for which it has been over 3 weeks now and we have not received product, a refund, or any further correspondence from the seller. We have contacted Janet and Steve at MetaExchange , and they have since restricted him from selling any longer on their system. We have contacted PayPal and although they claim they will 'monitor' his account, we don;t feel as if they will be doing as much help as the team at Meta provided. (We also filled out a Fraud claim with PayPal, however that involves a series of 'jumping through hoops' and they claim that if they are able to get the funds back from him Then we will get our refund - what if they Don't get the funds back?!?! and as far as eBay, that's the least helpful of all as reporting to SafeHarbor or the like is the same as placing a Post-It note 'somewhere' in the Library of Congress for others to read. If there is absolutley anything that you may be able to do to help we would greatly appreciate it, and even if this message helps you prevent him from doing it to others then it would be worhtwhile for us. We can provide any documentation necessary to show our payments to him, and as mentioned the various other Sites involved have already been alerted. Please feel free to contact us anytime regarding this matter, thank you for your time......Scott

The experience has cost me only a lot of grief and time (and of course the $5.00 PayPal fee to accept my money back). I really appreciate your help in this matter!!! I did personally speak with Janet at MetaExchange on 2/27/01 and she verified that VIPER's selling account there had been suspended. She said that from what she understood, he has a relative in the UK and that he was offering UK Beanies/Buddies for sale and representing them as being in the USA, and then they would eventually show up, having been shipped from the UK instead. That is still fraud -- everyone in this business knows how fast new Beanies/Buddies fall in price.I was very glad to get my $610 back. Thanks again for your help. JJ

I am so glad some received their money back, which I might add is a first, we, have not been that lucky with this nasty and fouled mouth seller. I had posted a message on the collectingnation trader board about this guy who uses 2 different email addresses(sweet2001viper@aol.com AND year2001dvdman@aol.com) Several of us will be filing insurance claims this week with ebay, but I am wondering if he is selling on yahoo under any other user id, he has been suspended from metaexchange and ebay.(david gindles is his name and user id on ebay has him located in Bradenton, Florida 941-778-1286) Marge  Just wanted to let you know.by the way his other user id was--year2001dvdman@aol.com

I am writting to you to let you know that I also paid for items on his auctions and never received them. I paid a total amount of $18.99 and they were for 2 Ty Beanies (Mellow & Eggs). A lady by the name of Marge told me you could post all e-mails with bad experiences. I kept ALL e-mails he wrote to me about this transaction. He said something in his feedback that he left about me on his page that he put a tracker on my items and it showed that I received them. Well I talked to my postmaster about this and she said if he had done this then I would of gotten a Form 1510. Well to this day I have not received my items or any form stating he had done this. I know this is not alot of money to some people but it is to me. I have bidded and also sold items on e-bay and have never had this problem before. I just don't understand why something was not done sooner to him. I was wondering if there is a way also to get this terrible feedback off of my page?? Well whatever you need to know about my situation just e-mail me  I will be glad to answer anything I can. I also reported him to paypal since this is the way that I paid for these items. On Friday, March 23rd, I  Finally received four of the bears I had bought on the one auction. David is still holding the Buckingham Buddie Bear hostage. He did send a note in the box stating that the tag was bent and he is getting additional ones soon and would be sending me another one. I have not emailed him regarding the receipt of the bears. I absolutely had no idea he was even mailing them until after I read the rebuttal to my negative feedback where he printed a confirmation#. Lo and behold it was the right number and I got the four bears which I was more than pleased to see. However, I feell the bear he shorted me is the hardest to come by and would cost me $100-150 to get him on another auction if at all possible. Here is the attachment which explains all. To this day I have not heard back from ebay or Paypal regarding my monies sent to this guy. He is still on ebay selling up a storm. I hope someone can do something about the man who is very rude and has a very sharp tongue which he exhibits on our feedbacks. Thank you for your time.  Karen

Hello, I think I have been scammed by an Ebay Seller, user name year2001dvdman@aol.com also as known as David Gindles. I purchased 5 Buddies from him on auction # 565953950. I was also bidding on another item but wasn't the higher bidder but it delayed the payment to him for a few days with his permission. I sent $$360.01 thru my Paypal account to him on 3/10/01 at 2:32 pm PST. When I did a message from Paypal came back telling me who I had just sent monies to. I immediately noticed that the email address wasn't the same so I notified Paypal who said that they allow a user to use up to 8 different email addresses and it was the same person only his base email address is:  Sweet2001viper@aol.com.  I had also immediately write to David and asked him to check his Paypal account to be sure he obtained the funds. He responded he had. I have repeatedly emailed this person asking for my buddies, but get no response from him.. He even went in that gave me a positive feedback thanking me for my fast payent. I have not used the second email (Paypal gave me) in any of my correspondence with him.  Today I received an email from another buyer of the same auction and none of us have received our buddies. Okay, now what do I do? I am just sick about this as that is a lot of money for a retired person to lose. The buddies were a gift for my granddaughter's birthday coming up. I bid on a Dale Earnhardt Primary Paint 2001 Die cast collectable on February 19th. Earnhardt had passed away on February 18th and Earnhardt stuff was going through the roof by midnight on E-Bay. I made my purchase from this clown using a "Buy It Now" bid for $250.00 shortly after midnight. I sent him $300.00 through Pay-Pal and immediately sent him an e-mail requesting he call me or e-mail if any questions. I also spotted the same item going for as much as $900.00 that morning on E-Bay so I thought that I had a good deal. Yeah, right. After a week I hadn't heard from him so I continued to send him e-mails. He sent me an e-mail message back saying something about what a shock it was that Earnhardt had died and that he was committed to keeping the item "displayed" for 30 days or something like that. He then said that he anticipated shipping on 3/5. I sent him another e-mail message back and said basically…bullsh*t I paid for it and I want my item now. I also threatened to enter negative feedback about him if I didn't get a response. He sent an e-mail message back saying something to the effect that "He told me I would get the car on 3/5" and "If I entered any negative feedback about him he would put me at the end of the shipping list" whatever that means and once I received my item "I could cry for as long as I want". That's the last I have heard from him.His response to the negative feedback I entered on him is that "I already received my car, tracking shows that" and that "I should get off the couch and off of the crack". The guy is a complete jerk and ripped me off for $300.00. He won't supply the above mentioned tracking number. He won't answer any e-mail or send me a check or money order back for the amount I sent him. The fact that he profited from someone's death (Earnhardt) only makes him even a bigger low-life.

I SUGGEST YOU GET IN TOUCH WITH AUTHORITIES CONCERNING THIS INDIVIDUAL, THE PARTIAL ORDER HE SENT ME CONTAINS A COUNTERFEIT SAKURA, ACCORDING TO TY'S ANNOUNCEMENT. THE NUMBERS ON THE INSIDE OF HIS TUSH TAG ARE THE NUMBERS TY HAS ANNOUNCED AS COUNTERFEIT. DAVID GINDLES CAN BE PROSECUTED NOT FOR MAILING COUNTERFEIT ITEMS AND INFRINGEMENT ON TRADEMARK ITEMS. I just wanted to let you know that I did receive ONE of the beanie babies that I won on this auction. I received Eggs with a note saying quote: "Soon as I get more Mellows I'll send you yours. When e-bay canned me I sold them locally. Sorry. You'll have it soon. David." unquote. The only thing I have to say about this is if he had them to begin with why did he not send them out. I sure hope I receive my other  one soon. Only time will tell. Thanks. Tammy
