I would really appreciate your help in settling this matter as I just seem to keep getting the runaround from the E-Bay seller, tweety 78. I have asked multiple times for a refund for an auction that ended back in February and in May. Originally I purchased 2 Wales beanies  in a presale and she was unable to get them. It was then said that I could either have a refund or order different bears, I suggested a few that she did not have on hand and she mentioned that she had a presell on the Prinz von Gold beanies, if I wanted I could bid on them and just pay her any extra that they may cost(foolish I realize, but I did this, that is why there are 2 seperate Paypal payments). I never did get the beanies so I started asking for my refund in July and even though she was answering my emails -10 days after I asked for my refund she told me that she had shipped them. I never got them. Now she is saying that she has shipped a second time and she will be out money if she ships a 3rd time? At this point I am very upset as I feel that I am the only one out money, I did pay for insurance and since they did not show up she should have claimed it. I asked for her not to ship a second time to please refund and now today she is saying (this is how I understand it to be) that she will be out alot of money if she has to ship a 3rd time. If she had just refunded my money the first time I asked for it we would not have this problem. I also do not understand how she could be out any money when I paid for insurance. Included are copies of all the emails that I had saved if you read through them (sorry there are so many) you will understand what I am saying. I am unsure of what to do from here as I am not sure if this qualifies as fraud (since she does say that they are mailed) or if I am to presume that she is lying or just a very big misunderstanding. She has over 10000 positive feedback on E-bay and it seems ridiculous to try to save $108.95 by this method. Is there anything that you can do to help me, please let me know, thanks Nora (user id on E-Bay dragonlady574, not sure if you   require this information.I thought that the whole idea of insurance was that if it did get lost the Post Office would reimburse you for the amount. So far, from what I understand from her she has mailed them twice and if she mails it again she will be out alot of money. She charges everyone from Canada $4.00 for insurance and it is mandatory if you pay by paypal. When I asked for proof of mailing I never received a reply until one week later and I was told that she had been away from home because her sister had lost a baby, The seller id on E-bay is tweety78. I do not have an address for her as E-Bay will not give the information as it says that the item is no longer on file since too much time has passed. Her name is Estie and I believe that her husband's name is Rob. I do know that they are located in California. Anything else that I may have forgotten please let me know . Thanks for your help, Nora

Hi Estie. I included this information for you again, I haven't made an additional payment for Prinz yet as you were going to get back to me on a balance owed. If this helps at all For the Wales beanie the auction was $35.05 for each and $4.00 for paypal and $6.95 for shipping. Since the Prinz von Gold was $49.00-difference of $13.95 per beanie times 2 = $27.90. I get that it will be a difference of $27.90 if you could verify this for me please. I realize that since you sell so much that it can be harder for you to find things that go back 3 1/2 months. I don't know what other information that you need please let me know. Thanks Nora

Hi Estie, I have to admit I am very disappointed. When I cancelled the order 12 days ago I explained that it had partially paid through my husband's paypal (Wales) and the balance had been paid through my paypal. I have already arranged to get the beanies from elsewhere by a trade. I feel as if you delayed refunding me my money until you received the beanies and then shipped to me. Hi Estie, During the month since I cancelled my order and asked for a refund, you then shipped 2 weeks later on July 29th. To this day I still have not received anything-no beanies, or no refund. I am warning you 1st of all that if my name appears just becuase of some nutcase complaining without any merit no matter how much money it takes I will sue your website and have it removed plus sue for damages Trust me when I say I am not kidding ! I was not able to get her what she wanted so she said send me 2 of another Bear so I said fine She originally ordered 2 Wales Bears and said it is o.k. send me 2 Prinz Bears, so I did Then she asked for a refund after the Prinz Bears were sent. I send her package long long ago but it is impossible to track since it went to Canada. She did not insure the package and I gave her a choice back in February to Isuure it and she declined. I will not be held responsible for a package to another Country where the buyer choose not to buy the Insurance when it was offered and furthermore cant be traced without it. I am a very honest seller on Ebay and have over 17,000 Positive feedbacks with less than 17 overall negative comments, my repuation speaks for itself. I have tried many time with numerous emails to this person , and have told them their package was mailed long long ago. they said they insured it, I have proof they never paid for Insurance. I was wondering what was going on when I didn't here from her. Below this email you will see the proof from Paypal that insurance was paid for originally when I paid for Wales. When I paid the extra for Prinz von Gold I did mention that I had already paid for the shipping and insurance when I paid for Wales. I thought that she was so very nice and now she is lying, that is wrong. . The information below is copied and pasted from Paypal and if she checked the transaction date in her paypal account she would have seen the exact same information. If you check through the copies of email that was sent to you previously you can see that I have quoted both the date and transaction number of this Paypal payment to her. I am glad you have Lawyers on board because you may need to use them with me I am not saying that your website is not legal but am saying that it is not waranted to put my name on there just because of a complaint from someone that is totally baseless and false My feedback reputation speaks for iteself I did not call her a nutcase to her face or in an email, I told you that I thought she was a nutcase, if you think that is unprofesional that is your opinion There are many other choice words I could use but declined to lower myself to her level. She was offered Insurance, and I do not charge Canadians $4 for Insurance and say that it is a must, that would be Illegal according to Ebay rules. I do not print out every single correspondance from her or anyone else as we had an understanding and there was no problem unti lyou wrote me. When she did write me I tried to write her back within 24 hours or most of the time within a couple of yours. She is only sending you the emails she wishes to send to you, I am sure she is not sending ones that show I said when I mailed her items and that over and over again I stated you did not pay for insurance. I have been very consistant with her. She bought these items in Feb, then wanted to change the 2 items because I could not get them so I sent her the 2 items long ago. I do not deliver the mail, it is out of my hands once I give it to the post office  Since of Feb Transaction and probably over 50 emails back and forth she has left me many many positive feedbacks for other items in 3 of the 7 Months since Feb. Hello again. I am reading your email again. I did tell Nora she did not pay for Insuance several times, she is only sending you the emails she chooses too, not every single one I have sent her that is very obvious. That is simply crazy that I charge sellers to Canada $4 to buy Insurance ,if you read any of the ads and I believe you can go back at least 3 months you will not see on there that there is any extra charge for Canadian users unless they would like to add Insurance . On all of my emails and clearly stated in my ads it says Inusurance is optional at $1.10 . If I am such a bad seller why is she buying form me over and over again ? I have asked you this now twice. I have not heard a reply from you? also this transaction originally was in Feb , like I stated before I sent her order out long ago, I have never stolen money from anyone especially someone who has ordered many times over and over and am not about to start now with this small order. The total of both bids including shipping and handling was $93.51. The bids read that the bears would be delivered within 30 days. After the WTC disaster she wrote to say they would be delayed but if I wanted my money back she would refund it. As it had already been over a month, I asked that she refund my money via email on 9/19. She emailed back that she would send it out on 9/20. On 9/22 I received another email from her saying she was going to mail it out that day. I in turned emailed her "What's going on, you said you would mail it 9/20." From then on she went crazy sending me many hateful emails, telling me I was nuts, crazy, on drugs, a liar. She now says I have the money and I am trying to scam her. Almost 2 weeks after she said she sent the money I still do not have it. She finally said she sent a money order. Money orders can be traced but she keeps telling me I have the money and that I am sick. Well, I'm sick all right. I'm sick and tired of being scammed by these creeps over ebay. This is my fourth bad encounter bidding on beanie babies. So far I have recovered 3 scams. I have 2 more to go. I have contacted her local police department as someone else told me that's what I should do. They were of no help, they said I had to contact my local police dept. Here is what I am going to , I will send Cindy a Personal check for the full amount again on Tuesday Oct. 9th, if I find out that she has cashed the money order and also cashing my personal check , I am going after her 100% for fraud! and no amount of money or any amount of paperwork I have to do will stop me. I'd contact Ms. Sawyer myself but I've been instructed by the Lisle Police Department not to have further contact with her. First of all, I do not know what bank she is dealing with her area, but she should be able to find out with one phone call if the money order has been cashed, not 2 working days. She should have the issuing bank provide her with a copy of the cancelled item. If the item has not been cashed she should get an affidavit from them stating the money order has been lost, I would then give her a written statement that I have not received it which she could attach to the affidavit and get her money back. The Burden of Proof lies with the Purchaser. I, personally, would not issue additional monies unless I recouped the money that I originally sent out. The fact that she would send more money without going through with this procedure indicates to me she is what I have stated all along...a liar and a scam artist. I will notify the Lisle Police to see if they think I should proceed with filing criminal charges or wait to see if she sends the money out "again". On Nov 16, 2003 I won a TY Herrod Stardust Bear from this seller and that same day (as I always do when I win an auction) I used Ebays checkout system to let this seller know I would be sending payment right away. I had checked Traderlist board earlier before I even thought about bidding on this item as I always do because of the many bad sellers on Ebay to see if there had been any complaints about this person. When I checked the board there wasnt a complaint but when I went back to check it I seen there was, in fact, a complaint on this seller and then seen they had a bad trader page. I read the page and thought, there was NO way I was oging to send money to this person until I emailed her asking if she would let me pay for this bear when she got them in hand seeing as she did have a page on Traderlist. She then sent me a reply trying to explain away those complaints and the page they have here, which also included a threat to report me as a non paying bidder if I didnt have payment to them in 7 days. I then sent them another email stating that I wasnt going to send payment and chance being one to loose money to them like others had since they didnt want to work with me and told her that if she was as reputable as she says she wouldnt had minded me sending payment when they received the bear in hand. Keep in mind she never said in the first two emails she sent me that she even had any of them in hand. Not until the third email did she say that had I just went ahead and sent payment like I was supposed to, I wouldve been one of the first to get one because they had some over 60 hand at that time, and said had I been even 1% nice I wouldve gotten one of those. SURE!!! and I have 1,000 acre gold mine in the Sahara I can sell you..I wasnt nice? I ASKED her if I could send payment, I didnt TELL her I WOULDNT send..So why couldnt she had told me she had some in hand when I asked if I could send payment when she had some in hand in my FIRST email to her with concerns of this? Anyway, I now have a non paying bidder strike against me because this seller is greeeeeeedy and dimisses the trader page she has on her and expects me to do the same. Beware of this seller and read the Traderlist page she has on her. I pay for auctions I bid on, PROMPTLY! Go to Ebay and search under LawBaby32 and you will see this for yourself. This woman claims to be reputable but dont ever tell her you seen her on Traderlist and expect her to care one way or the other. But all is well on this end because I still have my $59.00!......=)...

I purchased a presale for a MC Anniversary bear 2nd Edition. I waited for 3 months as she kept telling me it was coming. I finally cancelled the order and asked for a refund. She told me that as soon as some people paid her via Paypal she would send my refund in full. That was over 3 weeks ago, NO REFUND and now won't answer my emails. In the auction it clearly states that after 30 days if you don't receive your item she would give a full refund!! It's not fair that people can just take your money and not deliver or give your money back!!

I have a bad deal with Estie Sawyer with an auction I won on June 4th, 2003. It was a presale auction but after 2 months I still had not recieved my 2 sets of Asian Pacifics(6 in a set). I paid for them with paypal on June 4th,2003 also. After the 2 months I started asking about them. I was told they were hard to get and would I mind waiting. After a very long wait I started asking again. On 10/11/2003 I was told she was suprised they had not arrivedsince they had been mailed. She had a # from Endicia that just said they were in route. Estie said they must have been stolen,lost, or something. She would have the postmaster check into. On 11/13/2003 I emailed again asking where are the beanies.I was she emailed them priority mail and the postmaster would check into it. During this time I also had been asking for a refund. No refund. On 11/25/2003 I sent another email asking again but after that I never recieved any emails back. Till this day I cannot get an answer from her. If you can be of any help that would be great. But at least you can warn people about the women.

On May 21, 2004, I won a bid for Ronald McDonald. Pay with Paypal the amount of $204.68. Ms. Sawyer was not able to get these beanie and after 60 days the order was cancelled. Ms.Estie offer to sent my money back on 7/4, 7/12, 7/21 & 7/17. As of today, no refund and all e-mails have stopped as of 7/27.

I sent her a money order for 3 presale beanies on Dec 18th through her Ebay listings. They were expensive but decent prices. Had to keep asking about receipt? I have sent out 85 money orders for Ebay purchased and none have ever gone missing. After several attempts to get an answer I rec'd a nasty, verbally abusive phone call from Mr. Sawyer threatening me with non payment. I had already sent them the money order number. I had to hang up the phone and they tried again but I would not answer. They filed against me for non payment and I filed against them for harassment and threats. I have kept a file and it is full of lies and threats and a great deal of nastiness all on their part.

I checked on my money order and it has not been cashed but the beanies have since increased in price. I suspect that when they get a letter with an MO and the value of those beanies increase - how hard is it to say 'you never got it' - only I have been pressing so they are getting back at me with nasty threats of being thrown out of ebay. Yes, they do a lot of selling BUT I WON'T DEAL WITH THEM. These folks can't be trusted and by their language and behavior have proven to be predatory!.

Comments on Ty.com have uncovered some similar behavior that others have experienced with this seller. PS I have 100% + feedback as a purchaser and never have encountered this behavior before and hopefully never again.

It is now costing me 15 dollars to recover my funds (hopefully) which is $97.55 and they have also accused me of being crazy. Oh well whatever floats their boat. Ebay makes money from them so why rock it ---what a shame!

On November 15th I purchased 5 white Starlight beanies on ebay from Estie Sawyer. I mailed her a check the next day, and she acknowledged receipt of the check on November 19th. There were emails back and forth, and she always said she would be getting them. I left her negative feedback on ebay, and things went down hill from there. I requested a refund of my $241 on February 5th, 7th and 10th. To date I am out $241!!

I purchased the above, in an 30 day Ebay presale. She returned my e-mails, in regards to delivery, but said that Ty hadn't released these items, yet. Today I received notice of Chapter 7 Bankruptcy

It seems that Estie Sawyer has filed for Bankruptcy on April 22, 2005.

I was VERY fortunate that Paypal decided in my favour and reversed 2 Paypal payments that I made to Estie Sawyer on March 13th and March 17th for 2 auctions that I never received.

I emailed her numerous times and received no reply so I notified ebay who advised me to file with Paypal.

On April 19 I filed with Paypal and 10 days letter, I got my money back !!!! I am so impressed and so glad that I didn't wait any longer before I filed !!!

Please update her page on the Bad Traderlist !! I know of at least 2 other people who emailed me about the same auction as she has more than one item available. Nobody had received anything and were in the same boat as myself.

Now that she has declared bankruptcy, I hope she has some assets that can be used to pay her creditors !!

We had a 99.8% feedback rating for over 7 years on Ebay so had a good track record but like I said I had to close my business and have no assets at all

I was ripped of for over $14.000 by 2 UK and Japan sellers and that pushed me over the edge , sold my car, tried to fill as many orders as possible and had no choice but to file Bankruptsy, I would have loved to stay in business, complete every transaction but I have no assets of any kind and am not in business any longer

I went and talked to a FBI in my town today and then he had me file a claim with the IFCC. He is checking with the lawyer and trustee on her bankruptcy case to see what I can do.

My question to you is can you tell buyers that got ripped off by her to file a claim with the IFCC at www.ifccfbi.gov/index.asp

The more buyers that file a claim the better are chances are to put a stop to her fraud. Then maybe she won't come back in a few months and open a new Ebay store under a new name.

I didn't complain to Ebay or PayPal before because she kept answering my emails that they would be arriving soon. Of course, like a fool, I believed her. I have dealt with her for over 3 years and this is the first time I had a problem. I have probably bought over $1200.00 of beanies from her. I don't know if I can mention her name or not, but it is E.S. from Moreno Valley, Ca. Please tell people to beware!
