Cautionlist: This complaint page will be done differently than others because of problems incurred with lost files of most of the complaints. In the week before Christmas I was notified by someone who had found out that this Fabian Vanquez was using her feedback on ebay to make deals with. She had made a deal with him and asked for his references and she gave him her id name "Sharonwasc" to check hers on ebay. He did not contact her back. Very soon after that and luckily she got email from someone who had also made a deal with Fabian but when she looked at the feedback she became suspicious as it was so the sharon in the id was so different than Fabians name etc. So that was when they found out that Fabian was using another persons references,  which were quite good,  to make deals on beaniemom site. I notified the beaniemom site and they left note there about this. Many people then emailed me that they had made deals with him very recently. many that same day but most of all were done in the week before Christmas. I told them all to go to their post office immediately and to get a retrieval form and fax it to post office in Texas where they sent their beanies to get them retrieved. Everyone did do this and they did get their beanies sent back to them. A very few people who had sent before this lost their beanies. I had all the information about all of this and the emails from everyone on my other server. When I changed servers I was unable to retrieve all of that information. What is posted below is what I was sent when I changed servers. The person whose feedback he used has changed her id name to her email address. Cautionlist thinks that everyone should use their email address as their id name so that this does not happen. Anyone who they got email from a person about a deal that had feedback under a different email address would immediately get suspicious.

I want to thank you and the trading board. I e-mailed you earlier about Favian Vanquez. I had sent him a package with 10 beanies, mostly bears.I sent a fax to his post office and I got my beanies back today unopened. Since I sent them priority I didn't have to pay postage back. I now have my Blue Face Spangle back as well as the End and 8 others. Thank you very much. This was first time I was almost scamed. Thanks to you it turned out ok. Carolyn

Hi, i was talking with another honest trader about Fabian Vasquez, and she  told me beaniemom was talking about him too, and i found your address. The  information below was the what he gave to me. he tried to scam me by giving me someone else's reference on ebay. I confronted him and he agree to send me his maple buddy, but he never did since Dec 20-22, and he never  return my mail! Thank you for reading, please get him out of the net! Becky Wong

I have had the same problem with email ID was fabianvasquez@yahoo.com. He wanted to trade his Maple Buddy for a few of my beanie bears. I have not heard a word from him since...I guess I can kiss the bears goodbye! Lynn Karaim

I got an email back from "Fabian Vasquez" dated 1/19/2000 and he claims that he is only 11 years old and that I scared him when I told him I would be turning the information over to the Sheriff's Department to have them look into it. Who knows if he is telling the truth! I sent back a reply and asked him then...where was my Maple Beanie Buddy. So let's see if I get a reply on this.Lynn Karaim

Cautionlist: As I said there were many more complaint than this but they were lost on my old files. But most I did tell to retrieve and they were able to do this and get their packages back. From what I can remember there were only 2 or 3 who sent early and did not get theirs back.

I sent the return package slip at my Post office about 2 and a half weeks ago and I havent heard a thing from Texas PO regarding the scam fabian vazquez pulled on me , do you have any other info my Post master said maybe the FBI is retaining them for investigation if you know anything else please let me know it will be greatly appreciated. I just wanted you to know that I had success with getting my Beanies back from Fabian Vasquez. I filed a mail fraud report with the USPS and it actually worked! A gentleman called me named Jack Montague and said that Fabian's mother intercepted the notioce from the USPS. Jack confirmed that Fabian was 12 years old. He apologized repeatedly for this happening. He retrieved the Beanies from Fabian and I got them back in the mail today. If anyone else has a problem I have a number where you can reach these people. If you want to...give them my email address and I can give them the information. It did not sound like Jack was Fabian's father, but maybe they live together or something. Who knows...not my concern. Anyway, I just wanted to let you know I was successful and to confirm that Fabian was a child of 12 years old. Lynn Karaim

ThankYou for your help. I received an email from Lynn and then contacted Fabian's mother.A very pleasant woman who is working to clean up the mess by her son and will be returning my beanies. She is working with her son and how this whole series of events will teach him a lesson for now and the future. She is not allowing him to do beanies any more. Infact he is grounded the rest of the and she is having him calling people to say he is sorry. MAry Ann

I had a deal with Fabian and have not received my 9 beanies back. I contacted you twice before--you told me some of the records had been lost. I also went to the post office and filled out a retrieval form about a week after the fact--and have heard nothing from that. The pieces were The End Bear, 99 Holiday, Ty2K, Wallace, Groovy, white faced Spangle, Osito, Pumpkin and Glory. Hopefully I can see these again! Cautionlist heard from Fabians step father. They are really upset about what he has done. They do not even have a computer at home and he was using someone elses when he made these deals. The parents are making him make good on all of them. As I  previously said in the beginning of this posting, many of my records on this were lost when I changed servers Jan. 1. So if anyone has not gotten their beanies back please notify me and I can tell you how to get them back.

Boy bamboozled woman for Beanie Babies

A woman who shipped 10 Beanie Babies to a Texas collector and waited in vain for a return delivery in the Internet swap later learned she had been duped by a 12-year-old whose Beanie obsession prompted eBay to warn traders about his tactics.For the City of Pewaukee woman and others elsewhere in the country, the warning came too late. But the alert allowed 10 to 12 others with shipments en route to Texas to get the Postal Service to stop delivery. And another 20 people immediately called off negotiations with the young wheeler-dealer. The boy's stepfather said the child is less a Beanie bandit than Beanie addict. "One of the things I learned is my worst fears about the Internet were true," the stepfather said in a phone interview from Texas. "People could get in trouble on there, especially children. There's a lot of grief that can come to people when it's not handled right. "I don't like Beanie Babies. I thought (the boy's collecting) was a problem and it was a problem. His mother and I found out about the trading at the very last moment. Neither one of us knew it at the onset. "You probably should know what's going on at somebody's house. We didn't and as soon as we knew it was a problem, his world got turned upside down." Although the boy is not being prosecuted, his stepfather said the child has forfeited his computer access and his 100 Beanie Babies, a collection that doesn't include those that were returned this week to Pam McCright of the City of Pewaukee. McCright said she never previously had a problem with trading on the Internet and had assumed her Texas counterpart was an adult. The boy provided her a list of people with whom he had traded in the past. She now believes he may have used someone else's eBay account, because traders have to be 18 or older. "It was a learning experience not only for him but for me," she said. "I trust too many people. I just have to be more aware." The stepfather said that holds true for him and the boy's mother. He, evidently being a very intelligent kid, he's very resourceful and used it to his benefit and not necessarily to the good of other folks," said the stepfather, who is not being named so as not to identify his juvenile stepson. "That's just what is destroying his mother and I - that it was able to happen and he allowed it to happen. That's so wrong." The stepfather, who spoke on the condition his community in southeastern Texas would not be named, said the boy was unable to put on the brakes as his deal-making spiraled out of control. "He's a very bright little boy, but I don't think there was a malicious bone in his body when he got started," said the man. "He saw all this coming to him and he didn't know how to say 'no' and he didn't know how to stop. It's not an excuse. That's just how I see it."  Nonetheless, as part of the scheme, the boy had the Beanies delivered to a cousin's home. The stepfather said his son also obtained Beanies from someone in Oregon and New York, and the family is in the process of returning them. Kevin Pursglove, spokesman for eBay in San Jose, Calif., said he did not know how company officials became aware of the boy's trading. "Generally, (problems come) to our attention through other users who have had difficult experiences with a fellow user," he said. "Does it happen a lot in the overall scheme of things when you consider the tremendous volume taking place on eBay? No. The bottom line is there are certainly problems and inconvenience for our users that we want to continue to come up with solutions (for) so we can alleviate the problem." After seeing the warning, Pam McCright went to City of Pewaukee police to complain that she had sent off 10 Beanie bears in a swap but never received the coveted Canadian Maple Buddy promised in return. Detective Neil Evens told McCright there was little police could do legally to retrieve her Beanies. Nonetheless, he decided to e-mail the Texas trader in the hopes of persuading him to return her Beanies. The Texas boy initially denied any knowledge of McCright. When pressed by Evens to identify himself, he wrote: "I am only 11. You must e-mail me what you have to say. I can't give you my number. I can't call you." Evens sent another e-mail, this one telling the trader to tell his parents that he had been contacted by police and warning him that he would contact Texas authorities about the matter. The boy, actually 12, finally admitted to Evens that he had the 10 Beanie Babies. The boy's family contacted McCright by letter Feb. 23 seeking to resolve the matter. The Beanies, valued at $20 to $50 each, were sent to the City of Pewaukee police. McCright retrieved them Tuesday. "All 10 hostages are safe and sound back in the City of Pewaukee," said Evens, adding that "it just goes to show with the Internet you don't always know who you're dealing with."

Cautionlist: Actually I do not think that he did any dealing on ebay. The only connection to ebay that I know of is that he used another persons feedback there. I believe that all of his dealing was done on beaniemom and we notified them immediately and they put up notice about this for people to contact me and most everyone got their beanies retrieved before they were delivered. some had sent before that time and they are the ones now that are being returned.

All's well, ends well. Talked with stepdad, the day you emailed me. I received a box yesterday with all the beanies that I had sent to Fabian. He even called to verify that I received the box.
