I recently bid on an auction on ebay for two beanie buddies in the amount of $166. It was a presale which meant that I bid on buddies that were not in stock at the time. Ian was very good up until the 13th of December responding to my emails saying that Ty hadn't sent him the buddies yet and that if he didn't have them by the 15th of January he would refund my money. But I didn't want to wait any longer. So I emailed him on January 1st and asked for a refund, and he hasn't resonded to my request. I have sent several emails since then and they are returned to me saying his mail box is full. Checking his recent feedback on ebay, the last four buyers gave him negative feedback saying they won his auctions, but they neither got the merchandise or a refund. I am at a dilemma and really don't know what to do.Some of the people cheated by him have tried to call him, but he does not return the calls or answer his phone.Ian's address and email EazzyRider@webtv.net 4701 Laguna West Way Elk Grove, CA 95758.Lois

Response to cautionlist from: eazzyrider@webtv.net

are you threatening me?...i will be charged with fraud? how is that you are not law enforcement and should not be making threats. you cant just charge someone with fraud, obviously you need to study the law a little better. watch out as you could be sued for defamation of character.Theperson you are talking about is in the process of having thier money refunded as many others have already been refunded. feel free to put me on the bad traders list i dont care i dont deal with beanies anymore anyway. also you are accepting thier statement as fact without finding out the true facts involved. by the way why do you use a hotmail address?..email me back with a real email or i wont respond further.

Response to cautionlist from eazzyrider@webtv.net

you are misinformed. You stated in your first email that i would be CHARGED with fraud. If you knew the law like you say you would have wrote "be reported to the authorities for mail fraud".Second if i issue a refund how is that being a bad trader? My auction stated this was apre-sell and i PROBABLY would be shipping them in december. the person you are talking about emailed me a few days after complaining about not getting thier beanies and didnt see that t was a pre-sell which was clearly stated in the description.I never stated a definitive date. The person that i was to get the beanies from kept stalling me and ultimitely flaked out on the deal i had (they more than likely got a better deal). After realizing i would not get the beanies i started issuing refunds some time ago. Everyoe but the person you are talking about and i think one other who's email isnt working has been refunded, i would hardly call that fraud or grounds for being on the bad traderslist. I understand your position but next time email me with somecourtesy and tact and maybe you will get a nicer reply. The person you are talking about should get the refund early next week and i can give you the money order number if you like. sincerely, ian wallace

Update from: lmartin988@aol.com

I can't believe how arrogant he is about the whole situation. He still hasn't responded to any of my emails about any kind of refund.  Anyway I will let you know if I get any refund. I know there are a lot of other people that bid on some of his auctions on ebay that he never responded to and never got their money back. I suggested they contact cautionlist. These people did post negative feedback on ebay so that's also proof that he took people's money and never sent anything. And there are at least 5 other people. I think he as a -2 feedback which is really very bad. He should have never starting selling beanies if he had no idea was he was doing. I think he got in well over his head on this one. So he has a lot of nerve to have an attitude. People like him totally disgust me. If you go to the ebay website www.ebay.com check out Ian's feedback. Ian did mention that he would give me a refund but kept saying he would wait until January 15th. I emailed him several times asking for my money back, first he didn't respond and then I kept getting his mail back saying his mailbox was full. So if he was so reputable why didn't he answer my emails andothers. Today is the 15th and I have no refund as of yet and he has not even bothered to contact me at all. That is just no downright rude and inconsiderate considering the fact that I put a lot of faith and trust in a seller, especially the fact that he was a registered ebay user. Anyway I hope that he will make good on his promise. I bid on the buddy back in october. Even though it was a presale, I have never had to wait that long for any one of the beanies or buddies I bid on. So, yes he did say he was going to refund my money, but kept putting it off. And when I asked for my money back like everyone else he never had the decency to return my emails. hate to be nasty, but he is such a liar. How dare he say I contacted him a few days after the auction asking for the beanies. Plus they were buddies, not beanies. Obviously he doesn't know which is which. Anyway I have done many presales on ebay and he must be naive to think I would actually expect to get the buddies a few days later. If anything I told him(I save all my previously emails) that I was more than willing to wait for the buddies. It infuriates me that he can be so rude and he's trying to make me sound like a fool. Obviously if he checks his saved emails he will realize that I was not the one who requested my money back immediately. There was another woman who won the dutch auction with me who finally told me after many threats she got her money back. But I was the onewilling to wait, because once again I trusted him. In this instance I guess you could say I was too trusting. Anyway I wanted to set the record straight. You would think rather than being so arrogant he would be more than willing to oblige. He originally acted like he was a retailer because he kept saying that Ty was slow in sending him his shipment.(I have that email too) But he said he should be getting it soon. My theory is that he put the Teddy buddies up for presale in the hopes he could find them cheaper, but he couldn't because the price of the Teddy buddies is more than what I bid for them. So it was a loss to him. Anyway just had to vent a little because I am the one being duped here. I had payment out to him within 5 days and he makes me waits three months! that's absurd. mail.Hopefully I willl have some good news by next week. Lois

Update from: lmartin988@aol.com

I have some good news and some bad news. The good news is that Ian sent me a money order. The bad news is that he only sent me half of what he owes me. I bid on his auction and won one cranberry teddy buddy. I then sent him $83.76.($80 plus $3.76 S&H) He contacted me and told me he was supposed to get four in altogether and if I wanted another he would sell it to me for the same price. Since a friend of mine wanted one I sent him another MO in the amount of $81.76. So he received a total of $165.51 from me and only sent me back $80. I don't exactly call that making good on a promise. So now I am out half of the money. I sent him an email asking for the remainder of the amount. So far I haven't heard anything, but I just sent it. Hopefully I won't get it back saying the mailbox is full.

Update from: lmartin988@aol.com

Ian FINALLY contacted me since this whole situation began and said he didn't realize I bought two buddies and would send the rest of the money out tomorrow. He was also very rude and nasty in his response and said that he gave everybody else back their money, so how can hebe trying to fraud anyone.

Update from: lmartin988@aol.com

Ian told me in his last email on 1/21 that he was mailing out the remainder of the refund on the next day. As of today I have not gotten the money. So I emailed him just know to find out ifhe actually sent out the refund at all. I am waiting for a reply. I told him that I would proceed with filling out a mail fraud form if I did not hear from him by Friday. I really don't think he is going to send the rest of the money.(later in the day Jan 27)Well Ian got back to me. Talk about arrogant and rude. He acts as if he is the victim here. Anyway he says in bold letters DO NOT THREATEN ME!!!!! All I said to him was that I would fill out a mail fraud form if I do not get a response from him and he considers that a threat. He said he has the MO, got in on Friday and hasn't mailed it because he doesn't have a car. Is that an excuse or what? He must think I'm totally stupid. Anyway he says he has the number and all of the MO if I want it and that he's mailing it tomorrow. He also said he was actually ripped off himself because he claims he bought these bears off a woman who hasn't refunded his money or sent the bears. Anyway he claims he's mailing it tomorrow. We'll see.

Update from: lmartin988@aol.com

Good News! Ian sent the remainder of the money today. Of course he didn't include the S&H, but I am just satisfied that he sent what he did. I would like him placed on the bad traders list, because he promised me ALL my money back by Jan. 15th and it is now  Feb. 1. I wouldn't want anyone else to have to deal with his rude and arrogant attitude. He can't be trusted. Plus I don't think that I would have gotten a cent of my money back if it were not for the help of the cautionlist.Lois

I won the bid on Ebay for a Cranberry Bear Beanie Buddy. Sent Ian 65.99 for the buddy plus shipping. This was 10/22/98. He continued to email me that the buddy would be coming in December. Then he said it would happen in January. No buddy and no refund as of yet.
