This individual, KimWal33@aol.com     traders_name: James Ricciardelli trades under jimmyricc on Ebay. His Ebay contact info states a location of Palisades Park, NJ although I have been unable to locate such a person in that town. I concluded an auction on 5/4/02 for a laptop computer that was to be delivered within 30 days of auction close. Seller could not produce the item at that time nor within the two extra weeks I allowed. I requested a refund of $1125.00 on 6/21/02. To date, the seller has "sent" a money order that hasn't arrived and has had "problems" with his PayPal account that prevent him from issuing the refund.

I was high bidder on one of their auctions and have yet to receive my item. Only after I left negative feedback did I receive an e-mail. That message said my item would go out that day and I would receive it in 2-3 days. Of course, that was one week ago and still nothing. I am only out $15.24, but it is still maddening. I reported them to eBay and also filled out a complaint on Paypal. Ebay provided me with this:

I'm not sure what else to do at this point. I have heard from many other eBayers who had similar problems. However, one guy did report back that he received a $1,200.00 refund after reporting them to Paypal. Good luck and let's hope we are as lucky. .....Lani

I do not remember the dates specifically but have it all documented with written notes and direct emails. The seller held a Dutch auction for 5 notebook computers. When the auction was completed I sent electronic payment (approx $1400). None of the buyers received any notification from the seller until I made enough noise through emails to the seller and cc copies to the other buyers. To my knowledge I am the only one that received the unit advertised. The other either did not recieve a unit, their money back, or both. The transaction was not very professional. I should have listened to my gut instinct and stayed away from such a large transaction with someone that previously only sold lotion, etc.  The unit that I finally received (after some work on my part) was in good condition and functions just fine..I would warn other buyers to stay away from this seller.   Jeff

I won a bid and paid in full and waited and was promised the computer over and over again. They even told me that they had shipped it a couple of times. One thing I learned is that there is speculation selling where the seller is supposed to let you know that they don't have the product in hand but have up to 30 days to deliver after end of auction. They are supposed to post this on the item page. They never did, but after monitoring some other auctions, that's what I learned. Anyways, I was very patient and polite but firm until the very end when I thought I was going to go nut and they finally refunded my money. That was through a painstaking process because they temporarily got suspended from Ebay for a supposed old debt on the husbands side which the did clear up. I came away a little wiser after that one and thankfully none poorer.   Roy Carver

I MUST ADD THAT WE DIDNT EXPECT THIS MESSUP AND PAYPAL REVERSED MR ERIC H PAYMENT. THEY SAID WE NEEDED TO VERIFY SOME INFO AND THEN THEY WOULD POST THE PAYMENT BACK TO HIM. Yes, I was refunded $15.24 by Paypal after filling out a complaint with their Square Trades department. Paypal said they investigated my complaint and found that the seller was at fault. I wasn't sure, though, if that money came from Paypal or from jimmyricc. Maybe they just go ahead and transfer money from his account? Anyway, I am through with this and hope you get as good a result.

I had won a dutch auction for a Sony laptop computer, there where 5 or 6 supposedly in this auction. We were supposed to received the laptop 10 after payment. Well 10 days past no laptop kept in contact with the seller the whole time, for awhile no response from him until I threatened fraud charges then he answered my e-mail. Finally I he answered saying he didn't have any and was awaiting shipment of some. That never happened so I told him I just wanted my money back since it was way past 10 days and according to the statement on the auction I had that option. Well the was a problem with Paypal he told me, they froze his account. He said he would refund my money as soon as his account problem was cleared up. More than a month later I received my refund along with $30.00 more for all the trouble I had gone through. Which I though was fair. And by the way I never left any feedback positive, negative or neutral. I just let it go.   Roger Wilson

What I bought was a Sony gr-370 laptop computer the ebay auction number was item 2019762167. I waited so long with several promises and little follow through. At last I asked for a refund and was promised several times it was sent out. The total I sent him was $1225.00 in the form of a US Bank money order. The money order number was 5033599583. I did as you know receive a personal check refund that I promptly deposited in my bank with instruction to track it and call when it cleared, which of couse by now you know didn't. He contacted me Thursday with the promise that he would be mailing overnight a money order to cover the bad check. He was willing to pay any fees that his bounced check may have caused me. He has been pretty good about his emails... just very short on follow through. I am totally fine just getting my original amount back. I do not have the address for the check but do have the following information:

Turns out the confirmation number he gave you was for a refund he made to someone in Illinois. I had been in touch with that person too. He said that he had received a personal check rather than a bank check. Don't know if this thief is just getting confused with all of his lies or with all the complaints, or both. hi   We are in the process of taking care of any complaints due to this backorder. Mr rosario will be mailed his refund within 2 days with tuesday being the latest. Please let me know if there are any other complaints and we will take care of them appropriately. We did have a good bussiness here on ebay but had problems within the past 2 months with paypal holding our monies and tying us up with payments that we sent out. Hello. I just called his bank, and there aren't sufficient funds in the account to cover the check (he paid me with a bad check). I am going to the police with this as this is considered deceptive practice. He knowingly wrote an NSF check and sent it through the mail. Thats a felony in Illinois for the amout written.

hi   thanks for the update....We are working to have everything resolved and get back into a better state of selling. Michael rosario i am sending tomarrow july 31st a cashiers check and also REALTOR JIM i am sending his out also with a credit for the return check. Thanks and just email me when they have these abd are satisfied with everything. I didnt call the bank yet to check on eric h complaint. If this is the case it will be mailed tomarrow july 31st also via cashiers check. Just let him know and i will also include the return charge of 25 to him. No more personal checks as i didnt know they were going personal and actually they shouldnt have been mailed that way. Thanks for your helpThanks again

Nothing from him as of today. Hopefully this one will have better luck finding me than the one he said he was mailing on 7/24 or the three other "refunds" he's mailed me! I will let you know what happens but in the meantime I'm still supporting the NJ State Police investigation I've initiated into his activities. I received a refund money order from Ricciardelli. It came express mail return receipt requested. I sincerely hope the other victims of this scam artist can retrieve their lost funds. Thank you for you assistance in this matter.

Cautionlist has been able to track down the real physical address of James Ricciardelli. When he registered at ebay he gave the names of Louis and James T. Ricciardelli. I have researched and investigated these names and found out that the only Ricciardelli's in the entire state of N.J. with the first names of James T. Ricciardelli and Louis Ricciardelli both happen to live at the exact same address!!!!  This is not a coincidence.

This is a current phone number. Hackettstown is only about 50 miles from Palisade Park, Cliffside, NJ. One or both of them probably work in Cliffside or know someone else who does and picks up their mail. Or they just have their mail forwarded on to Hackettstown. A 50 mile trip to work is nothing at all in this area. Many all over NJ commute to New York to work daily.
