May 16, 2003 Important update!
Four indicted for online auction fraud
Friday, May 16, 2003
By Torsten Ove, Post-Gazette Staff Writer
http://www.post-gazette.com/localnews/20030516ebayfraudreg5p5.asp
Four men have been indicted in federal court in Pittsburgh as part of a nationwide crackdown on Internet fraud called "Operation E-Con" that will be announced today in Washington, D.C., by U.S. Attorney General John Ashcroft.
Three of the indictments involved local men charged with selling items online that they didn't own and had no intention of delivering. They used eBay and other Internet auction sites.
A fourth man from Germany is also under indictment here because some of his victims live in the federal court's Western District of Pennsylvania.
The indictments name as defendants Rajit Duggal, 26, of Monroeville; Keith B. Condon, 19, of the North Side; Jeffrey Alan Diller, 34, of Tarentum; and Mario Koch, 30, of Ingolstadt, Germany.
The U.S. attorney's staff would not discuss the cases in detail, but the indictments indicate the men repeatedly sold items online that they didn't own and then had payments sent to various addresses.
None of the men was connected with any of the others, but all are being prosecuted as part of Operation E-Con.
According to the indictments, Duggal, sometimes using the name "Michael Booker," sent e-mails to eBay customers and offered to sell items such as cameras and sound systems. Customers paid him through the "Paypal" online payment service and delivered checks to an address he established at Mail Boxes Etc. on Mall Boulevard in Monroeville.
Duggal defrauded customers from across the United States from October 2001 through June 2002, according to the indictment. Ronald James Wiest of Cottage Grove, Minn., for example, paid for a $629 Sony digital camera kit that he never received.
Condon and Koch pulled similar schemes, according to the grand jury.
Diller began his operation in 1999, prosecutors said, when he advertised Beanie Babies and Beanie Baby cards online and had customers send payments to an address on Cambridge Street in Harrison. When customers complained about not receiving their merchandise, police investigated, but Diller fled and disappeared.
In 2000, he resurfaced using a new Internet name and a new address for payments at the same Mail Boxes Etc. used by Duggal. When customers complained again that they weren't getting their items, the charges say, Diller put them off by saying he was sick.

traders_name: Jeff Diller Comments: I bid on a pre-sale in September and
I have not received my beanies and I sent him a MO> I have filed mail
fraud charges against him and he does not answer e-mails. He went by jazzy315
on Ebay. He is no longer a registered seller on Ebay. He took many other
people on this pre-sale also. Hope they register their complaint.
On 10/3/00 I won an auction on eBay from SELLER jazzy 315, email jazzydeals@hotmail.com. The auction was for a pre-sell of 2 BUCKINGHAM BEARS. The auction stated that " Items would be shipped exactly 28 days from order or a full refund will be offered". I paid $72.99 on 10/3/00. I sent an email to this seller on 11/1/00 saking about the status. I received a relpy from someone who stated they " Represent the owner", although they never said who they were, asking that I give him until 11/7/00 and if if item was not received a full refund would be given. On 11/7/00 I received a letter in the mail, no return address on envelope or on letter, stating that "Jazzy" has become ill and it would impossible to fill orders, therefore refunds must be issued. If a refund was requested I should contact them by email or direct mail (remember..no return address!). It goes on to say that refunds would be issued but no date could be given and that I would be contacted sometime in the future with more information. I have sent numerous emails that have gone unanswered, a registered/return receipt letter was sent to the address given by ebay. This came back to me undelivered as ATTEMPTED, NOT KNOWN. I have contacted other ebay members who have had the same problem with this seller.
I have sent all the information to the PA ATTORNEY GENERALS OFFICE and was informed that the PA Bureau of Consumer Protection will be reviewing the case along with a file # . I would appreciate any help you might be able to give me. I also want this to go onto the bad trader listing so no one else gets ripped off by this guy. I paid using eBay Billpoint payment .

ON 9/22/2000. ON NOVEMBER 4TH I RECEIVED AN UNSIGNED LETTER STATING THAT THE OWNER OF THIS FIRM HAD BECOME ILL & COULD NOT DELIVER AS PROMISED. THAT REFUNDS WOULD BE ISSUED.TO DATE NO REFUND HAS BEEN RECEIVED. AFTER NUMEROUS ATTEMPTS TO MAKE CONTACT WITH THIS INDIVIDUAL AND CHECKING WITH EBAY I FIND THAT I, AM NOT THE ONLY ONE SWINDLED BY HIM. EBAY TOOK MY COMPLAINT, BUT WAS OF NO HELP. THEY ENDED UP SUSPENDING HIM FROM TRADING UNDER THIS USER ID. ALL OF THE OTHER INDIVIDUALS I HAVE CONTACTED REPORT SIMILAR FINDINGS. IF YOU CAN BE OF ANY FURTHER ASSISTANCE IT WOULD BE GREATLY APPRECIATED. IF YOU NEED FURTHER INFORMATION PLEASE FEEL TO CONTACT ME AT JHAMI68101@AOL.COM, THANK YOU; JACK V. HAMILTON
I am writing to add my name to the list of people that Jeffrey Diller has scammed . In September, 2000, I won 2 auctions from this man. I paid him with my credit card, through Paypal on Sept 29, 2000. I go several e-mails from him, promising to ship. In November, I received an unsigned letter with no return address intimating that he was dying and could not ship or refund. I reported him to E-bay and Paypal, but because of the time lapse, they claimed they could not help. I have a claim pending investigation with my credit card company. I am at a loss as to what to do next. Can you help?
I also got ripped off on 2 beanie pre-orders from Jazzyd. Fortunately I had paid with a credit card through one of the on-line payment services, so I have lodged a complaint with them and they issued a credit for $165.00. I also got the letter claiming illness with no address or contact information. I hope he does get prosecuted for all those who paid by check or money order and didnt have the option I had. Thank you so much for looking into this. As I believe I told you in my 1st email, I have written to PA Attorney Generals Office and got a letter from Senior Agent Dorcus Turner that Bureau of Consumer Protection is reviewing my complaint and I was given a file #. In the letter it asks that any new or additional information be submitted in writing to:

I don't know if you want to put this on his bad trader page, you are welcome to. Again, you are great to be doing this mediation & investigation and I can't thank you enough. Hope we can at least get everyone's money refunded. One more thing, I tried to call phone # ....724 337-5160. Just get some strange noise then nothing! Laurie Panek
This e-mail is in reference to Jeff DIller who calls himself "jeff dazzy & jazzydeals@hotmail.com. I along with several others were recently cheated by this person on e-bay with a presell of Beanie Babies in the amount of $86.99. I sent the money on Aug 27th,2000 and did not get the letter until on or about Nov 6,2000. Since it was over 60 days e-bays insurance would not cover any reimbursement. I paid by check which of course was cashed long ago. This person sent an anonymous letter without a date or signature and said I would receive a refund which of course I never have. I am requesting that Jeff Diller be added to your bad trader list. Thank you. Betsy Shepet
I have seen several complaints regarding jazzydeals. This person is Jeff Diller who is from the Monroeville area in Pennsylvania, he goes by jazzy315 at ebay and has 2 other known emails that I am aware of as follows:
jazzydeals@hotmail.com
million29_2000@yahoo.com
Im kind of slow getting back but I was also scammed by Jeff Diller I sent
him a personal check last September 21 for $72.99 for a Ty Beanie Baby
(Buckingham Bear) To this day I would still rather have that bear but my
money back would have been nice. I filed fraud charges with Ebay. They sent
me $43 Mr. Diller still owes me $30. That letter we all received said he
was deathly ill and not to worry restitution would be made. The day the letter
came was the day the bear should have arrived according to all of his previous
emails. My first bad experience on ebay and needless to say I have not bid
on anymore beanies. My husband however still bids. He has run into a couple
goofballs. Oh well, thanks for listening Barbara Linder
I won a bid (eBay) on 9/9/00, sent money (via PP) 9/9/00, He received
it on 9/12/00. No Beanie. Req. refund on 11/7/00, received letter from estate
on 11/7/00, wrote letter to estate on 11/8/00. Heard NOTHING!!! I have written
others that won bids, they have heard nothing.

This is an update on complaint filed back in January, 2001 against ebays seller ID JAZZY315. Was ripped off on a presell for 2 Buckingham bears for 74.00. Address & phone listed through eBay are bogus. Filed complaints with all the suggested authorities. PA Attorney Generals Office has been working on this case. I spoke to them on 6/8/01 and they are preparing to drop this because they cannot locate Mr. Diller. A detective from the Pittsburgh FBI Ofiice is working on this also and I got some info that this trader and his "girlfriend"?? have worked together to scam many! Other ebay user ID'S: LIL18, SUPERCARDMAN & IRKMAMA in addition to JAZZY315. Her name id Lisa Kostiner and she is also on the bad trader list in PA. These people have ripped off many and this cannot be dropped!! I urge anyone who has had dealings with any of these sellers to contact the
