I think I may be the victim of an e-bay auction scam. Last July I was a bidder in a presell Germania auction. I sent a check in the amount of $121.01 to the seller the next day following the auction. The check was cashed, but I haven't received my Germania Bear. I have sent several messages, and get different answers as to why the package hasn't been shipped. Do you have any advise as to what step I should take next? This auction was on July 22, 1999. It was a presell Germania Bear Auction on Ebay. I sent a check in the amount of $121.01 to

The check was cashed August 2, 1999. I have sent several e-mails asking about my Germania. I asked for a refund in December and again on Jan.1, 2000. I still haven't received Germania or a refund. I have been in contact with the other bidders who also haven't received their bears.Kay

I had also purchased two Germaina's from Jenni22880@aol.com. If you could help or if I can help resolve this matter, please let me know.  I  received the following email from her on Nov 29.
"This should be the final update for the Germania presell, as we are approaching the final weeks of it. All the orders that were dealined for November have been shipped. You can refer to your original auction to see if your final month was November or December. Those orders that are deadlined December (or Christmas) will be shipped in the next 2-3 weeks following the November shipments. That will finish our presell on time. I get many questions about individual orders, but since all are within a few weeks of each other in shipping, it will be easier just to e-mail when shipments have left instead of daily inquiries to my shipper. I am very pleased with the kind communication with all of you, and I hope you will have a nice approaching holiday season. If there should be any delays or problems with your individual order, I will definately let you know, as many of these are Christmas presents. Thanks again and Germanias are on their way.Jenni"
Thanks Dan

I did promise  eire@cyberhighway.net that her order would be shipped out by 12-31-99 or she had the refund option. She contacted me recently and I told her that I would check with the third party that ships these items if her package had been sent. It was my understanding that she still wanted the product rather than her money. This Germania is shipped from Germany, so it does take time to arrive to her. Today is Jan 7th, so if it was shipped even the last day, 12-31-99 to comply with the presell, she might not get the package until maybe the 10th or so. I need to check with the shipper to make sure that package has been sent, or will be sent asap if she still wants it. If it has not been sent, of course she is entitled to a refund. If there is anything else I can help you with, please let me know. I am an honest seller who ran into some delays during this presell. Thank you.Jenni Wolfenbarger

I received a memo from someone named Kay telling me to contact you if I hadn't received Germania yet. I've attached the last correspondence from Jenni, if that will help you any. If you can help me or need some additional information, please contact me. Otherwise, I will contact the shipper after the 10th per Jenni's attached instructions. Thanks! Virginia

"Hi, If you have already received your order, or you know it has been shipped, please ignore this e-mail. Also, if you have asked me about your order in the last 3 days or so without an answer, your answer can be found in this e-mail.NOTE: I will be spending Christmas and New Years with my family and may not be able to read my e-mails. So please do not be concerned during that time. All orders not yet shipped, will be shipped between today and December 31st. We have received our last shipment of germanias so we are able to send everyone's out. I know the mail is slow this time of year, so allow some extra days for shipping. While I am out of town, or even after that, you can contact the shipper himself if you are concerned about your package. This should be done if it has been more than 10 days since shipping. For example, if you package would be shipped the last day Dec31st, and you don't have your package by January 10th, I would suggest you e-mail him and ask him to trace your package. You should include your name and address ( or name and shipping address if different), because he cannot look up orders by e-mail address alone. This would also help me out, so I don't have to forward your questions to him and then forward his answers to you. All packages have a tracking number, and he can trace them if necessary. His e-mail address is pekka.franck@odn.de Please save this e-mail should you ever need to use this information. I hope you have a Merry Christmas and a Happy New Year!!!! Jenni"

I have spoken with my local police about this matter already. These items were shipped from Germany, and that has taken much longer than expected. There was a portion that did not leave by the shipped by date (which I can't say if these e-mail addresses are part of) but I have been contacting those individuals by e-mail and by letter.Jenni

I traded her last summer a bday bear for a Germania and I did receive it. I actually made the deal with her sister in Germany but since Jenni lived in the US, I sent her the bear and she sent me the Germania. After I made the initial deal with her sister, I never heard from her sister again and Jenni just took over. drider8433@aol.com

I also had a deal with Jenni and did not get the bear by the deadling. Well my final update is that I received my refund today in the mail in the form of a money order. She was 5 days later in sending it than originally told but got it. On January 15 I got this message from her in case it helps others.

Subject: Re: Germania presell
Hi Ray,
This past Wednesday, I contacted everyone who still had not received their orders giving them the option of the refund. Maybe the e-mail did not reach you. I will copy it after this and you can decide if you would still like your order, or a full refund. Our last shipment came in too late. Jenni Yesterday, I received a list of orders for the presell that were not shipped by the deadline and your name was on that list. In the auction, it was stated that if we did not meet the deadline, you have the option of a refund. To comply with that, I would like to know if you would like a full refund at this time, or if you would prefer that your order be shipped. Our last order of Germanias is in Germany ready to ship, but I would need you to let me know that it is ok to ship it late. I am really sorry that the presell didn't work out as smoothly we both had hoped for, and I am sure that both of us would like this completed in a prompt manner. Following are instructions for refunds and for those who still want the bears. If you would like your order shipped:
Please e-mail me at Sendgermania@aol.com and state that you would like your order shipped. Include your name, and any changes to your shipping address . If you would like a refund: Please e-mail me at sendrfn@aol.com and state that you prefer a refund. Include your name, address, number of germanias ordered, and total paid. Also include if you paid by money order or check. The more information you can provide, the easier your order is to look up. Please use these alternate e-mail addresses to make this process faster and easier. That way the refunds and the shipments are much easier to monitor. I hope this is no inconvenience to you, and I hope you accept my apology for this situation. Have a nice evening. Jenni

I, along with many others, won a pre-sale e-bay auction for Germania in July and have failed to receive either a bear or refund from Jenni. I have repeated e-mailed her but have had no response, except 2 times early on in which she gave excuses as to why it had not been shipped prior to Christmas. If anyone has had any luck getting a response from her, please let me know how you did it. I have tried every thing I can think including e-bay mediation. Thanks, Deb

Comments: Better late than never (since I just found out about this site)... Anyhow, I too was a victim of the infamous Germania pre-sell. I never received a bear, a refund, or any response (other than the canned responses mentioned throughout her list of victims) from Jenni. I tried to use her e-mail to see if she might have had a change of heart, but much to my surprise, it is no longer active. Add me to the list of scammees ...
