Dear Irene,

We have disputed the chargeback on your behalf and must allow the buyers Credit Card Company 45 days to reply to our dispute. Please contact us after 45 days for the outcome of the dispute. Thank you for your patience in advance. Sincerely, PayPal Chargeback Division

This is email that I had sent to them:

customer message: Transaction ID: '1F9243023T939141K'
Transaction Date: 'Mar 5, 2002'
Transaction Type: 'Payment Received'
Transaction Status: 'Completed'
Transaction Amount: '24.95'

Message: 'I strongly object to being a victim of a six month old charge back and being charged a fee for this. If the credit card was reported stolen or missused I should have been notified no later than thirty days. It should not taken 6 months to report. You would have been notified immediately. Why am I paying for this. The owner of this card would have known after their first statement came in that this was not their bill and should have complained then, not 6 months later. This is not good business on PayPals behalf! Can you share with me what the buyers address is and what date she registered with you. On the complaint ID 510986 Your reason for denying this payment to me was due to the fact that I had not provided a delivery identification when indeed I did. Doll was mailed via Priority mail tracking #03010120000332791101. Package was received on March 11-2002. Yours Sincerely   Irene Jones'   customer subject: Chargeback on auction

Thank you for all your emails. To answer your questions, when a buyer pays by PayPal the address given for shipment should match the address given at time of registration. If the buyer wants it shipped to another address ( work, relative etc) that's when PayPal lets the seller know that it is an unconfirmed address and they do not offer protection for payback on any claims. The seller has the option to refuse shipment that being the case. I unfortunately fell for the story that Karen was buying for a friend who wanted to give it to his wife as a surprise and that it would get to friend quicker if I sent it to him directly. BIG mistake on my part as I now learn.

Yes PayPal did indeed charge me a fee for the chargeback. BAH HUMBUG! I have taken your advice, from earlier email, and sent a strong letter of complaint to PayPal disputing this transaction so long in the works and for charging me the fee. It will take 2-3 days before I get a response from them. I have asked for Karen's address also and the date that she registered with them but I can predict the answer to that, as in, Privacy policy to protect our members. What about my protection from them! I will wait their reply before venturing a phone call to the Smiths.  I have filed a police report, and they did tell me it was a Federal crime but doubted I would hear from any of their detectives in a follow-up since the amount is so small. We shall see! I will keep you posted on any new developments.   Thank you again for all your help and advice.  Irene

Cautionlist emailed Karen several times but although email did go through all was ignored. Did find more info on Smiths to whom the package was mailed. They should be able to give more information on Karen if they are not Karen themselves. Have asked Irene to phone them about this.

I did get in touch with Kate and Bob Smith today . Bob told me that his address was used by his former boss, Brian Bigley. They shared that other than allowing their address to be used for the delivery of the doll, they had nothing to do with the bidding or payment of the doll. I now have a phone number for Brian Bigley and have left a message on his answering machine. David claims he does not know this Karen Reading! I have the feeling I will not get anywhere trying to recover the doll or the money. Perhaps PayPal will be able to get some action from the credit card company.   I have tried several times to contact a Brian Bigley at 480-715-5386 and also 480-715-1059. Messages left have not been returned. David Smith told me that Brian Bigley is the person to whom the Scottish Barbie doll was intended for. Brian Bigley was David Smith's boss and David's address was used to receive the doll in order for Brian Bigley to surprise his wife with the doll. This was the story I got from David Smith. I thought it interesting that one Kathy Smith's comments to me was,"Not that doll again? We have had a lot of calls on that doll!"  Unfortunately, I didn't pick up on that piece of information until I ended the call. I just wonder who all the calls were from? Irene

I thought you would like to know the latest regarding my complaint on Karen Reading or David and Kate Smith. I was contacted recently by a viewer of the traderlist who supplied me with the email address and other information on one, Brian Bigley, the recipient of the Barbie doll in question. After contact with Mr. Bigley, I am happy to inform you, I have been paid in full for this auction.  I do not believe David Smith had anything to do with buying this doll. Below is the email I received last week from a very helpful gentleman who is responsible for me getting Brian Bigles' email address. He has asked me to keep his annonominity. I did try to post a message on the website below but it was evidently screened and never got posted. I will email the letter I sent to Brian Bigley who was the former boss of David Smith, also the reply I received back from a different person? I emailed back to let them know I had received the money and will email their response. Let me know what you think?   Irene

Subject: Scottish Barbie / Brian Bigley
Mrs/Miss Jones,

By coincidence, I was searching on the Internet for a website and ran into this website information page:
http://www.traderlist.com/KarenReadingorDavidandKatieSmith.html

Brian Bigley visits a 1/6th scale action figure messageboard. His callsign there is 'graeylin'. Bigley often asks to trade for items of Scottish background and mentions his wife collects Barbie items. The website is here

http://www.voy.com/14388/
His email is - graeylin@hotmail.com
His current address is -

Brian Bigley

Tempe, Arizona 85283

One of Mr. Bigley's favorite pasttimes is listing the names and addresses of bad traders on this board. It would not surprise me if your bad deal regarding the Barbie figure is in the hands of Mr. Bigley. For record Mr Bigley is also a ranking member of Toastmasters in his community and now uses an Intel mailing address for trades. It is my belief that Mr. Bigley is an employee relating to Intel in some way. My suggestion is to make a posting on that messageboard regarding your complaint. Good luck

This is email that I sent to Mr. Bigley:

Subject: Un Paid Auction.

Dear Mr.Bigley,

It has taken me some time to track you down and thanks to a concerned citizen I was supplied with your email address as well as your home address and telephone number. I left a few messages on your answering machine last year and was then informed that your telephone number was no longer in service. Let me start at the beginning.......in March of last year, I had a Scottish Barbie doll on the eBay auction site. It was won by a Karen Reading who asked me to mail the doll to a former employee of yours, David Smith at a Mesa Arizona address. I did so in all good faith! Several months later, I was informed by the PayPal banking system that their was a charge back on the auction payment. The credit card was used by an unauthorized person. The auction bid plus postage was for a total of $24.95 Plus a charge back fee was instigated against my account for $1.02 making a grand total of $25.97 which I am out of pocket for.  Having tried many times to get in touch with this Karen Reading and failing to hear back from her, I filed a police report on theft. The police officer informed me that it is a Federal offence and that I should get in touch with the Attorney General in AZ. I hesitate to cause that kind of trouble on anyone, so have been working with a mediator on www.traderlist.com who helped get me in touch with David Smith. During conversations with said David Smith, he revealed to me that the doll was ordered by you, Brian Bigley, his former boss! Mr. Smith told me you used his address for delivery in order to surprise your wife who collects Barbie dolls.  I received information today that you frequent a web site 'The Ultimate Soldier' and have posted a message under my user name 'Highland lassie'.I would be most grateful if we could resolve this matter amicably Mr. Bigley. Payment can be made through my email address under irenejones@woh.rr.com or sent to my address in the form of a money order or cashiers check. (I sent my name and address)    I look forward to hearing from you,   Kind Regards    Irene Jones

no problem, money will be headed your way tomorrow. I will send $30 to make up (a little) for all the trouble you have had.  I tried to call several times at the number you left on my machine, and got an answering machine. I left about 5 messages with no luck, then figured i either had the wrong number, or no one was giving you the information.

Hello Irene,

According to my E-Bay info, I don't have any auctions left that I get the Barbies from. So you may have gotten the wrong address to send this to?  Angel

Cautionlist believes that Brian has access to this email address also and used it to contact Irene. I believe that when Irene emailed back to that address that she had gotten the money for the ebay barbie auction there was confusion at first since they did not have any current Barbie auction wins not realizing at first that this email was from Irene letting them know she had gotten the money they owed her for the old Barbie auction.
I am leaving the Smiths name and mailing address here just in case their address is used again for a deal. But I do not think they had any knowledge of this deal and only knew that Davids boss asked to use his address so he could surprise his wife.
