I have been trading beanies on the secondary market for over two years. I am now out thousands of dollars in bad trades. The latest person to defraud me of $1,678.00 was Kevin Niemioja on eBay. Please be very careful of him. He has over 1100 feedbacks. Everyone views this as the mark of a good seller. WRONG!This is what happened: I saw a Spot no spot on an eBay auction. I looked at the picture of the Spot no spot; which was an Real Beans picture of Spot no spot taken off the Real Beans website. I email Kevin to ask if it was a 1st gen. hang tag. He said it was. I bid on the auction. Won after being bumped to $1,678.00. Sent Kevin a certified check for $1,698.00 for shipping and handling. A significant amount of time passed before Spot no spot arrived. When I opened the box, Spot no spot was not the same Spot no spot featured in the auction. It was soiled, the letter of authenticity was missing, and we noticed the hang tag had a fine line where an incision had been made to attach it to the plastic stem with glue. It was not originally a first generation hang tag. Upon further examination of the auction picture, we noticed the hang tag was in a locket holder which do not fit a first generation hang tag only a second generation hang tag. We checked the various manufactures of the locket holders. All of them agree, a first gen will not fit. We contacted Kevin the day the Spot no spot arrived, and asked him to please send the letter of authenticity. It was after we discovered the hang tag had been switched that we told him we were returning Spot no spot and why. He never responded to our emails; therefore, we sent back the Spot no spot. Someone in Kevin's household signed for Spot no spot. I waited several weeks, and then I emailed Kevin for the last time indicating I would report him to the authorities if he did not send me a certified check for the full amount. He emailed me stating he would send the money. His personal check arrived and I held it, because I had requested a certified check. Finally, I deposited the check on a Monday. Kevin emailed me on Tuesday saying he was putting a stop payment on the check, because I forgot to return the letter of authenticity with Spot no spot. After a month of having Spot no spot in his possession, Kevin said finally got around to opening the box I sent him with Spot no spot in it and discovered the letter of authenticity was missing. This means he sent me a personal check for $1,678.00 without ever checking in the box to see what I sent him.I reported Kevin to the police, however, since Kevin sent me a personal check and then put a stop payment on it. This became a civil matter, not a criminal matter. Even though I can prove Kevin set out from the onset of the auction to defraud me. Kevin has never addressed the issue of the tag being switched. Kevin said the reason for putting the stop payment on the check was the missing letter of authenticity. I listed the switched hang tag as one of the reasons I was returning Spot no spot to him for a full refund. I never told Kevin I had discovered the difference between Spot no spot he sold me, and the picture on his auction page of Spot no spot. I wanted the police to confront him with this information. He has already admitted to Detective Bridger the Spot no spot in his possession is the one he sent me. Then Kevin added if the tag has been changed, I changed it. I was trying to get him to send back to Real Beans for re-authentication, or admit why he was unwilling to send it for re-authentication. I will send the copies of Kevin's emails to you to Detective Bridger. I hope Detective Bridger can find inconsistencies in Kevin's statements to Detective Bridger and the statements Kevin made to you. I will keep you posted. Maybe after Detective Bridger interviews Kevin, you can help me think of a way to expose Kevin's lies.Kevin's personal information is as follows:

I have notified the FBI, Mendota Height Police, and bad trader list.Tomorrow I will file papers with the San Francisco DA, who is investigating eBay fraud. I am going to notify the President of the University of Minnesota Kevin is using the school email system to defraud people. I will also write a letter to the Attorney Generals Office for the State of Minnesota. I will email eBays fraud department again of this case, and if all fails, I have been told to call 60 Minutes by the Department of Surface Transportation.If you can think of anything I forgot, please let me know; otherwise, please warn people about Kevin Niemioja.

The beanie that the person got was the same one as the picture and it had an authentication paper with it. They sent it back in different condition that it was sent to them and I am not going to refund their money. I will gladly send the person her beanie in the same condition in which I received it back, but I will not refund her money. I have feedback of over 1160+ on eBay and she is my only purchase complaint. I suggest that you look into this further before putting me on your bad trader list. I fully admit that sending the check to her was a mistake. i sent it before I opened the box. I opened the box the next day, saw that there was no certificate in there and I cancelled the check. It was authenticated by real beans and I probably should have sealed it with the beanie, but I didn't think that it would be an issue when I sent it out. I have said all along that I will send the beanie back to her because it was the same beanie that was pictured. It is unfortunate that we are having this dispute, but I am not willing to give away $1678 to a person who did not send the beanie back in the same condition I sent it to her. Kevin Niemioja

His ad on eBay was very deceiving. He made it sound like you would get a bean bag of beanies when it turned out to be one lousy beanie! I offered to mail the beanie back for a refund. He was very hateful and told me he would not and that he already cashed my check. I put a stop payment on the check. He wrote all of this negative stuff on eBay and sabotaged my account with them.  It was an awful experience. He's a CON ARTIST!!!!!

I got a beanie that had been taken apart at the tush tag, and put back together. I feel the tag had been changed. It was in a baggie and about 1/3 of the pellets were out loose. Good luck. Carol J

I just had one experience with him several months ago. I had bought a 20.00 beanie and he sent me the wrong one so I sent it back to him then he sent me the right one but it was full of threads hanging out and I wasn't happy so I sent it back to him he then sent me a refund but it took awhile a personal check not a m/o and he never included my two return postages. So I had decided not to buy from him again. Leslie

Cautionlist was unable to get anywhere with dealing with this person. I finally left it for the FBI to handle. I did see all of the documentation and it does support everything that CMich1727@aol.com stated.
