I won a cell phone from Melissa Holmes of Sparta, TN on February 6 (item #5861082441) and paid for insurance. She marked the item paid on February 15 and not too long after that told me she had sent it. I never received the phone and I emailed her 10+ times with no reply and called several times and got no answer. I finally got a reply from her stating she had been out of town and said she mailed it and couldn't imagine what happened and would immediately make it right, and she'd send it if I still wanted the phone or she'd send my money back, whichever I wanted her to do. I told her never mind, to please send my money back. The total amount was $45.85.

I sent one last email telling her if I didn't hear from her in 24 hours, I was filing mail fraud charges against her and contacting Traderlist and also posting about it on the Caution Page at Traderlist. I heard nothing back from her. After I won the phone, she bid on three auctions and got three negatives for non-payment.

I asked Miss Outlaw several weeks ago if she wanted a replacement or a refund and she never answered me. As I do not have psychic powers, neither was sent. I will send her a refund on June 2nd 2006 in the amount of $45.85.

Not true. This is the email I sent to her telling her I would like a refund.

After emailing Ms. Holmes again, Mediator received the following message from her:

Donna can pursue whatever she wants to persue! I told her 6-2, is it 6-2?

No! And you can caution whatever you want as well!!

(Note..it WAS June 2nd!) This was the last message Mediators received from Ms. Holmes. No refund or phone has ever been received, and charges will be filed.
