I put a bid on a Flag nose Aotearao on eBay. I lost the bid as it went
too high. After it was over I got a message from a Ashley/Michael Judd that
even though I lost the bid she had a extra bear she could sell me. That way
she didn't have to pay high ebay fees. I got the bear in the mail and it
was a black nose Atearao with a little NZ flag charm glued to its nose. I
have since learned that this person won 5 auctions from ebay consisting of
three black nose Aotearao and 5 little metal flag charms. The person that
won Ashley's bid and one other than me have all gotten this fake bear. Dealing
with them has been a nightmare as you would suspect for the three of us.
I am even getting threatening emails from Ashley friend. There was a different
name on the package I received the bear but from the same address in San
Marcos CA. It is a Charles I Arancia Jr. I lost the least money but the other
two lost way more. My question is what can we do if anything. I was going
to let it go but now that I am getting email from a so called friend saying
I was a freak and going to do everything in their power to make as much trouble
for me as they can I feel I have to keep these people of the boards. Any
advice you can give us would be greatly appreciated.

There are at least three of us that received fake beanies from Ashley/Michael Judd. Because they told me they did not have paypal (we have since found out they do have a paypal account that they use to buy items) I mailed them a check on January 10th for $250, and it was negotiated on January 17th. I mailed the check made out to Ashley Judd to

Though your credentials do not apper very clearly in your message, I would
expect that any investigation would include contacting me (the seller) before
passing some form of judgement. I have no idea who you are. The information
that you are passing on to me has been supplied to you, I believe, from a
woman who contacted me asking to buy an aotearoa beanie. Actually I am still
unsure what auction your client won from me, I would appreciate if you would
use the auction # in any future correspondance, because according to my records,
I have not sold an aotearoa beanie baby for the amount of $130.00 to anyone
named Diana Kozy. Unfortunatly, I have been contacted by many persons with
harassing e-mails due to that fact that my name, my address, and personal
information are being passed around on the Ty website under the BBOT, and
I intend to have this matter investigated by ty.com. If you are representing
anyones interests I suggest that you follow the square trade format on ebay.
I unfortunatly at this time will have to contact my legal counsel in order
to protect my rights as a seller. In closing let me reiterate that I do not,
nor have I ever sold counterfiet goods, nor have I ever altered a copywritten
product from the ty corporation.

I just got off the phone with Michael. I called him to ask him why
he left me negative feedback on eBay before I did anything else. He responded
that he did that because I contacted you and I posted lies about him on your
board. He has informed me that he has contacted a lawyer and that I will
be held accountable for the lies and slanderous things I said to which I
responded that none of what I said was a lie and that I have proof of what
I said in the posting. He got very angry and hung up on me. This person is
seriously not well. I wish that I had never met him or had dealings with
him.

I also have had a problem with this seller, that goes by the ebay
id now patedisafreak. I won my auction and never received my beanie korea.
Auction number 6034087122. Seller said item was shipped on feb 16th, and
to this day march 22nd no beanie. Turned this matter over to ebay
yesterday.

Dear Sir,
Unfortunately most of your information is wrong. I don't know where you are getting it, but you had better check your resources. Your message is being forwarded to our attorney. I view this email from you as harassment.
1. I don't live in Stevens Point, and am not subject to their jurisdiction.
2. I do not live in Wautoma, and am not subject to their jurisdiction. Periodically we stay at a cottage we co-own with five other parties on a lake in Waushara County.
3. Silvercryst is a restaurant we have eaten at a few times. I do not know who owns it.
4. I am not the webmaster of Traderlist..only a volunteer for a Good Samaritan website protected by law. You may read more about the law at www.traderlist.com/caution.html. I do not get paid for mediation, and never have.
5. There are no grounds for a Postal Fraud Report. This is a joke. I have not defrauded you in any way, including the US Postal System.
6. There are no grounds for an FBI Fraud Report. This is also a joke. As I mentioned before, we work on a daily basis..are not employed by, but cooperate with, the FBI and the Federal Postal Inspectors as well as State and Local authorities, and Offices of the Attorney's General.
7. In order to file a civil lawsuit, you must come to Wisconsin. I welcome that.
8. Traderlist does not wish to have further contact with you. We have given our advice to the victims, and it is up to them to pursue charges, which they are doing. We did our best to obtain refunds for them. Now legal action is being taken.
Police reports have been filed in California by your victims and they have also filed the Postal Inspector Fraud Forms, and the FBI fraud forms. You can expect visits and or letters from authorities any time. We have every right to give expert advice to anyone who requests our help, and to guide them in the right direction.
I never requested any contact information from eBay about you. They will verify that. Any information posted by me or other mediators was given to us by your victims. You are attempting to "shoot the messenger" which won't work with a Good Samaritan website.
Your victims have proof of your fraud, and will take this as far as necessary to obtain refunds, which was my only goal in the first place. All auctions have been printed and items preserved as evidence.
Any further emails from you will only strengthen their case against you, and will be forwarded directly to our attorney.

Comments: On April 23/06 I bought what I thought was a Korean Flag nose bear from dolls2treasure4eva but when I received it in the mail it was a black nosed Korean Bear with a flag tag glued on its nose. I conatcted paypal and told them what had happened and they started an investigation. I was told to send the beanie back to the buyer registered mail which I did but when they received the bear back they refused to refund my money. Paypal was able to retrieve only $20.00 from them. Below is what the response from PayPal was:
We have completed our investigation of this case. We attempted to process a refund from the seller's account to your account. Unfortunately, the seller's account does not contain the funds necessary to cover this refund. We were able to recover $20.00 USD. We have taken action against the seller and are working to recover the remainder of your refund. We will contact you when we have more information. No further action is required of you at this time.
