I have tried and tried and cannot get her to send my bear. I live in a small town and have no where to get an international money order so I sent her cash.(dumb I know, you think I would learn my lesson) She stated in the auction NO CHECKS! I believe that she forgot that  "she e-mailed me that she received my money" and just tried to play it off as it got lost and she never received it. The second week in Oct. I purchased a Buckingham bear from

for $93 - ($103 with postage) I sent her out the money but did not put enough postage on the envelope so it came back to me. I re-sent it and e-mailed her of the problem and that is was on the way again. I did not tell her it was cash. This was on 10-21-00 the second time it went. From there no beanie and no answers to my messages.Finally I told her that I would give her until the 15th and then I would place a Neg. feedback on her. I did not hear from her so I did just as promised. Boy did she come out of the woodwork then. And she was real upset. I e-mailed her over 10 times. Kept telling her to send my bear or my money back at the end. She would not even acknowledge my e-mails. Then after I neg. feedback for her she said she will have it traced , that it would take a few weeks. Well it has been over or almost 2 months now I believe. No e-mails from her again. So I e-mailed her again. (I will send a copy) to just send My bear or money that I do not want to star the year off making trouble for her but I was not going to be out that much money , still no answer. So I emailed her a copy Of the e-mail where she says "money received" and still no reply. HELP!!!!! Thank you so much for your help. the auction # for this auction is e-bay auction#456583961.

Please be notified that our computer has been down and it would not have hurt to have tried to give us a call with something as important as this.I notice that on the feedback you have put emailed 10 times what a lie as only 3 emails here. Also your payment was not sent out promptly and was received very late putting your excuses aside when we were chasing you for the payment. The bear was sent out to you in good faith recorded delivery to you and we will be tracing its whereabouts as it is registered at every postal depot it goes through. If the delivery service states untraceable we will send out another Buckingham immediately because that is our company policy. If the parcel has been recorded as received we will be suing you for fraud and defamation of character. Yours faithfully

Emails directed to us are from a cache of our internet provider that is forwarded onto us when we instigate our outlook express on our computer so your statement is incorrect. We are hardly likely to ignore emails of this content willingly especially with negative feedback. Also the fact that you sent us an email stating that the payment you had made to us had been returned to you would not have put any delay in us receiving it? I suggest you go through your emails again and get your facts correct before you email us again. We can well believe you have sent out 10 emails to us for the whole transaction but the fact that you have misled persons in the feedback leaves a lot to be desired. A full investigation is going through with the postal service of which we will be keeping you informed when we have further details - the time process of this is between 2 to 4 weeks. We have sent a reply to this email please prior to this only we did not send it out high priority at the time and going by the date on your emails it should have been. We have not had access on our email for about a week now because we are in the process of changing host suppliers the relevant information to prove this is documented of which we would be happy to forward to you. Dear Sir/Madam,

Further to your email below with reference to Patricia Bates.

We sold the item on ebay in good faith and have posted the item to her of which we have proof of via HM Postal service. The monies for this item did not turn up until very late with the excuse it had been returned her as she had put the wrong address on it. This was against the terms of our auction as well because we had stated credit cards only on the payment methods of which can be completed on our merchant account or via bidpay.  We did email when we received the monies to the person concerned to confirm we were in receipt of the monies. At this stage please bear in mind that the monies did not come recorded to us or posted in a way that was traceable so that the person concerned would not ever have had any verification as to whether we had received the monies. With this information in mind if we had of wanted to commit fraud we would have stated that the monies had not been received. The goods were sent out the same day as receipt of the monies of which we have a proof of posting. We have currently put in an insurance claim and trace on the goods sent from here of which you have to wait a set period until you can claim and then it takes weeks until we are notified of the whereabouts of our package. This process is no different in the UK as it is in the US. We have stated to the person concerned the details above and have also stated we are happy to replace once the information had been received if it is found that the item never turned up. Information given by the person concerned especially on the feedback on ebay is false with reference to chasing us with 10 emails - having been hostile from the beginning of the transaction. We would be very happy to forward copies of all emails sent out by both parties concerned. We have been trading for over 3 years now and are an established company with 3 stores here in the UK. We have a very good reputation. Within these 3 years we have been buying and selling internationally for 2 years and not once has a parcel never turned up although some have taken up to 6 weeks to arrive. Our normal unwritten policy on these matters is to replace the item if it has not been received within 7 days for the UK and 21 days for the US and then put in our claim forms and follow the item through from there in our own time so that the customer is not inconvenienced in any way. This procedure was not followed through here because the whole transaction to us did not ring true and we had our doubts about the person concerned. We are happy to follow any procedures on this matter that you feel necessary and you would be welcome to contact us anytime on the following contact numbers and addresses.

Dear Sir/Madam,

We are forwarding all emails to you this evening. There is too much documentation to fax. With the proof of posting we will have to scan it in of which I am doing now as we speak it has not come up clear but will send a photocopy of it in the post to you if you could please forward me your address. Also we would appreciate being sent details about yourself and your legal standing. We have discussed the matter with our solicitor today and feel it necessary to inform you that we will be taking matters a lot further taking out action against parties concerned for defamation of character because we have the proof that no foul play has taken part on our behalf. We still have not had any notification from the US postal service on as to whether it has been delivered or not but because the item was sent out to the USA of which the UK HM Postal service will not insure we will be enquiring about insurance through ebay. The form we filled out asking for the item to be traced will be faxed to you in due course. I hope that this is to your satisfaction.

Cautionlist sent mailing address for receipt of proof of mailing to be sent. Please note that in above email they state that package could not be insured when sent out as previously they said it was insured and tracking was being done. This was reported to have been done 2 months ago. Also cautionlist received by fax a form that they said had been filled out a post office to have package tracked. This was in no way any proof that package had been mailed. Cautionlist gave again mailing address on Feb 4 to have receipt mailed. Cautionlist feels this package was probably mailed but that it was also probably lost in the mail. They did say that package was insured at first but in later email said that it was not. They are responsible for making good on this deal and it has been since the beginning of November since they received the money for this item. It has now been more than 3 months since this product was paid for and not received.

Cautionlist still has not received proof of them mailing the package that they promised to send. And they are not replying to emails now.
