For $625 I was to get a Trap with a sl creased hang tag, an authenticated Bronty, and an old-faced Jade Teddy. When I received the beanies ( on August 21) I could see the Jade Teddy was fake. I contacted her immediately, we agreed to "end the deal". I sent her beanies back to her on Sept. 3. She keeps telling me a money order is in the mail and I have yet to receive it. Now for the first time, my emails are being rejected by her.
Please let me know what I can do to help myself - I would like to pursue
it to the full extent of the law. I DO have the cancelled check cashed by
her, by the way, and copies of all correspondence we have shared.

In September I was interested in a number of auctions being run on Ebay by beanies105. I made contact with the Seller in relation to a Peggy Gallagher authenticated Royal blue peanut - I think it was Certificate No. 8381 or 8281 from memory. I missed out on the auction because my computer crashed and had to be rebuilt, but was contacted by the Seller - Patti who explained that ill health had caused her to end her auctions and she would sell to me if we could agree a price rather than her re-list. We agreed a price of $750 plus Express Mail to the UK of $32.75 and I mailed an International Money Order to her in late October for $782.75. The details she gave were:

After two weeks I contacted her to ascertain whether she had received the IMO and she said she had not, but was still keeping the beanie for me. I asked her to let me know if the IMO had not arrived by the end of November because the Bank could cancel it and re-issue. I also explained to her that the Bank was unhappy issuing a replacement and sending again to a P.O. Box address so she gave me an alternative address:

I mailed the replacement on 10 December. It was only by chance that I
looked beanies 105 up on Ebay to find she was 'No longer registered' . I
became concerned so obtained a telephone number for the address in Huntington
Station which turned out to be her parents: Michael and Millie Gabriel
001-631-271-7076. I telephoned and spoke to her mother who assured me she
would look after everything and gave me her email address of Momgabe@aol.com
for contact. Patti and Millie both responded to emails and when I found Patricia
Gabriel had been posted on the Bad Trader List I again contacted her mother
who assured me not to worry the problem related to a transaction which had
gone wrong whilst her daughter was ill. The IMO arrived on 17th December
and Patti emailed to say she would mail the beanie on 20th December and let
me have the Express Mail details. She has not responded to any more emails.
I spoke to her father yesterday evening and he said he believed the package
had been sent last week but that I should email Patti on: pgabriel105 @
hotmail.com. I have done so requesting mailing details but without response.
What should I do now? Look forward to hearing from you. You sorted a problem
for me a couple of years ago and I have great faith in you being successful

I called Patti's number at 6.10pm PST, she answered but then hung up.
I tried again and got the answer machine and left a message. I just set my
alarm and got up to call her at 10.00pm PST but the phone just keeps ringing.
I called her father who says he will speak to her tomorrow. He is very confused
by her attitude. He says she lives with her boyfriend. I haven't asked for
her address yet as I don't want to cut off communications with them. Will
try again tomorrow. Telephone number for Patti is 001-573-336-5664 , I guess
the area code should help you slightly also will Paypal not be able to give
you any information she is registered with them under both email addresses.

I have not heard from Patricia directly~ I do so appreciate your
updated information. Patti told me her parents were in New York, as well
as her fiance. I have never heard another word from Patti at all~
Sincerely doubt I will now, but will give it a shot. I will continue
to pursue my claim against her in small claims court - now probably first
thing Monday morning, Jan.6. Please let me know of any further

The first time she said she sent the money order, she never did. She asked
if I would send the beanie and I told her that I would not until I received
the money. She then claimed that it must have gotten lost in the mail and
that she could cancel it and issue another one. So then she finally sent
me the money order. When I received it, I sent her the beanie baby immediately
via the USPS, priority mail. I even sent her the tracking number and information.
Once it arrived at the destination, I no longer kept that info. I have tried
to contact her numerous times, but she will not respond to my emails. She
insists on calling my parents in New York who have no information about beanie
babies. I do not know why she will not answer me, but she does have that
beanie....I did ship it. I have not done anything wrong here. Thank you for
listening to my side of the story.

She has never ever sent me tracking information - I paid her $32.75 for
Express Mail $28.75 plus $4.00 extra for insurance. I received an email on
20 December saying she was going to the Post Office and would get in touch.
I never heard again until I received an email at my office asking me to stop
contacting her parents as it was 'freaking them out' and saying 'please do
not go legal'. I again emailed her and asked for the tracking number
but she has not replied. I have telephoned her asking her to call me with
the tracking information then I can ascertain what has happened to the package.
I have copies of all her emails two in total. I have sent her 10 emails and
made at least as many telephone calls to the US and 7 calls to the Federal
Police. Her parents said that she was not receiving email and having problems.
I do not believe she has mailed a package at all. I have a file of
all my transactions and can provide tracking numbers for items over 5 years
ago. I do not destroy any information and in any case would not until an
item was received otherwise I could not claim if an item was lost. I have
replied to each email she sent. and those sent by her mother - neither of
then have replied to my last 8 emails. In the light of her previous
dealings I do not believe what she is saying. Best of luck

Many thanks for all your efforts. I think Patti must have become worried
as I have received notification from Paypal of a payment of $782.75 from
her. Although they have deducted commission of $30.83 and I will also lose
£50 - $75 on the exchange conversion it is better than nothing. Patti
does however say that the refund is only to stop me going legal and it is
to be refunded when the beanie arrives. I doubt it ever will. I asked
her to send me the tracking number and suggested that if she had 'misplaced
it' she go to the Post Office and ask them for the number since she would
know the Post Office and mailing date. As I said before there was no response
to that email. For your information I often receive packages from the US
- I always pay for Express Mail $28.75 there is extra for insurance which
I pay if the item is valuable. I realise that Customs sometimes put duty
on it but if I have paid a large amount for the beanie I would rather be
safe than sorry. If you mail from the US to the UK via Express Mail
you get a tracking number usually beginning with EU or ET or similar, you
can then go to www.usps.com and track the whole journey of the package. It
can be quite exciting - especially if the beanie is rare. I am putting
the emails together and will forward them to you since despite the refund
I guess there is still mail fraud. Plmk what you think. Best wishes
