I won an Dutch Auction on Sept 28th 2000 for a Buckingham Bear in an acrylic box for $105.10. The delivery date was 30 days or a full refund. I have E-mailed her several times and was told 2 different times that it was going to be shipped and never was. The 18th day of Dec 2000 I asked for my refund and got an e-mail from her saying she turned the request over to Accounting and now she will not answer E-mail and I had Square Trade try to reach her and no reply. I purchased a Buckingham beanie baby a presell on ebay auction # 452360557.
Payment was mailed Oct.02/00 and was cashed. Buckingham was supposed to be shipped by Nov.05/00 or I can request a full refund. I received an email on Nov.29 or 30 stating that buckingham would be shipped on Dec.01/00. I have not received the beanie as of today Feb10/01. All emails to the seller are unansered and when I phone the seller, their is no answer. I left several messages and all my calls are not returned.

I'm one of the ebay members who paid Kali for a dutch auction item(buckingham
beanie)#455254223 which ended on Oct 11,'00.I paid $96.95 with a personal
check which was cashed on Oct.25,'00.The item was promised to be delivered
within 30 days of auction end but when I contacted her on 11/21 she said
there was a delay and she would ship by 11/30 so I agreed to wait and have
neither recvd. the bear nor refund despite several emails to her that have
remained unanswered.I 've filed complaints with ebay and IFCC and have just
completed the mail fraud form and will fax tonight.I posted a complaint at
your website ( using my other email gobind@pol.net) a couple of days ago.
She's been using tyheaven4u,website reamart.com.As you know she's been suspended
from ebay twice.I've been in touch with 5 others including buyers from UK,Japan
and Canada who've all been scammed by this woman.I believe Soko from Japan
has contacted you about Kali,too.He found her using different aliases and
addresses/phone numbers/etc.I wonder if you could help and let me know what
else I can do to have this person caught and prosecuted.This has left such
a bad taste I'm going to give up my beanie collecting which I started in
1996!

My main account for selling on eBay was krmd42@aol.com. Evidently you had
the wrong email address for me so I never got your emails. That was for large
Dutch auctions and antiques. Tyheaven4u was for individual beanies. eBay
approved both accounts. The separate eBay accounts were for accounting purposes.
I am in communication with my power seller rep with eBay and know I am suspended
until all orders are resolved. What happened was not deliberate and I am
handling as quickly as possible. My mailing address has always been:

In spite of having said that she sent my items to me, she had not yet sent my items to me. So I wanted her to repay the money which I paid. I wrote that I wanted her to pay my money by the International postal money order on March 14.

Hi Soko; After reviewing your records, I realized you paid for the orders by credit card. Why can't you receive a credit via your credit card company? That is normal procedure and protocol. It puts me at risk sending you a cash refund, because I can still be charged back for the canceled orders afterwards. I am calling Mike today and informing him. I operate a reputable business Hiyo and do regret the length of time to resolve this issue. $94.00USD...The only time I heard from her was to ask for her $$...she won;
reply to my emails and probably blocked me and a bunch of others as well.
I filed a compalint and fraud charges on eBay...she is NASTY! and a guy emailed
me today with this site saying they were under a new user name on eBay and
the old name was reamart ...Joan's mother...who has A TON of complaints as
well...I want my money back of you see this Joan...I have an attourney ready
to go...so reply! p.s She cries FLOOD which is an excuse...If there was a
FLOOD and have no time to eamil your winners, why would you have time and
energy to post new auctions...shouldn't you save your energy for the clean
up...I should know we were flooded back in 1997 here in Winnipeg.

Use caution when bidding on her auctions & request a firm shipping
date. I did finally receive my auction items on 6/15/01, auction ended 5/1/01.
Items were rec'd only after informing seller my plans were to file a claim
with Ebay when she refused to refund money. She is untruthful in her selling
practices & uses any and all methods to stall buyers when their items
don't arrive when promised; she leaves inappropriate negative feedback for
buyers who leave negative for her and if the information on this board is
accurate, her identity is questionable. She now says she has reported me
to safe harbor, although I don't know for what? All I did was request what
I had paid for & left negative feedback because it was deserved. If you
bid on her auctions, be prepared to suffer whatever punishment you inflict
upon her. If you give negative, she gives negative; if you report her to
Ebay, she does likewise, etc. I WOULD NOT RECOMMEND this seller; bid with
caution! She is vindictive and immature.

This is a sincere question: If there was no mail service in the Houston area
from June 8 to June 19, how come my priority mail package was postmarked
June 11, 2001 (from Longview, TX)? Does priority mail ship independently
from the USPS? If there's anyone out there who works for the USPS or lives
in the area, I would love to know.
Comments: I did a BUY IT NOW on ebay thinking I would recieve my beanies
with in a week..I even payed with paypal thinking that would speed things
up. Auction ended and was payed for 06/13 I emailed her several times asking
where the beanies were. It took several days to recieve a reply. She told
me that paypal had messed up and she was unaware that I had payed. I gave
her the benefit of the doubt.. I then asked her when they would be shipped
i never recieved any emails at all about it. I found out it was delivered
on the 06/27. I felt that 14 days for beanies I had done a buy it now for
was a little long. So i posted neutral feedback saying beanies were in great
shape but the delivery was slow. SHe then posted neutral feedback saying
that I should read her ME that she was flooded out and couldnt send the beanies.
WHY SHOULD I CHASE HER.. She can email me about her money but she can't email
me to let me know houstin was flooded out? Whats the problem there. I am
the buyer. I had emailed her NUMEROUS times and it took forever to get a
reply until she wanted her money.. She however told me AFTER the fact that
they were flooded out.. which i would of understood had i of known.. Her
business skills are very poor.. as a business woman she should know that
its up to HER to make sure her customers and potential customers are satisfied
and they know everything that is going on with thier order... I was very
nice to her and she retaliated as if I was rude. I was annoyed but not rude..
This woman is not a nice person very hard to deal with. SHES NOT ORGANISED
AT ALL! used excuses like she was selling on ebay for the summer to make
extra cash..blah blah. IF YOU CANT ORGANISE AND MAKE SURE YOUR BUYERS KNOW
WHATS GOING ON THEN THATS YOUR PROBLEM. You shouldnt be a seller if your
over extenuating yourself. BEWARE OF THIS SELLER.. TOTALLY UNSATISFIED im
not just a buyer I am also a seller I would never treat my customers this
way.

I won Auction No. 583955562 on May 3, 0l and was asked immediately to
send my MO. I mailed a MO and asked to be notified when received. Joan never
responded after several emails. I finally did get an email and she said she
had not received the money. I called my bank and found out the MO had been
cashed a full week before. I told her what I had found out and she then claimed
she just received the MO on that day. Don't know how that was possible as
it had already been cashed a week before. Said she would be sending the beanie
immediately. It was not received for a full month and a half, and only after
I left her negative feedback on ebay. She retaliated by doing likewise and
sent me a horrible email claiming I was a sociopath and hoped that when she
became a Dr. that I was never one of her patients. Also said that her lawyer
would be contacting me. I tried to email her and tell her I could save her
some money if she would send me her lawyers address so I could send all
documentation but she had me banned from contacting her. She also complained
to ebay about me. She leaves negative feedback for any person that crosses
her but pleads innocence and uses the floods in Houston as her excuses even
tho the floods did not happen for a full month and a half after many, many
auctions have ended. Also claims that PO sent to wrong address, hasn't received
money, and any number of other excuses. We, the innocent parties are being
damaged by all her lies, excuses, etc. This woman (?) should be banned from
all auction sites. Buyers Beware. I have all correspondence to and from her
if anyone is interested. If you choose to bid in her auctions watch for the
lies. Joan if you read this, please have your lawyer contact me. I am ready,
willing and able to prove the grief you put me through.

I won an auction for a Dearest and Hero on the 23rd of May,sent payment on May 25th,and waited.On June 5th I contacted the seller who told me she had had a "flood"problem and as yet had not received the payment.Eventually,the seller admitted to receiving payment on June 9th.She e-mailed me on June 22nd to say the bears were been posted to the UK on June 25th.On July 2nd,the bears still had not arrived,so I e-mailed her again,she promised faithfully they had already been posted.It is now July 12th,7 weeks after close of auction and almost 5 weeks after she received payment!!!!!!! If the floods affected her so badly,how come she was able to continue putting items up for auction,and send beanies to people who won their auctions well after she received my payment.As yet she has not been rude to me.But that will come later today,as I have just posted negative feedback for her,and she will retailiate by reciprocating.

sent out MO immedietly & as of 7/11/01 I have not recieved my beanie.
I have contacted Joan several times & she resonded there was flooding
in Houston but would be sending out the beanie ASAP. I have emailed at least
3 times & the last one gave her a date to deliver by or I would leave
negative feedback & pursue fraud charges as well as add my complaint
to the bad traderlist. I have had mostly good experiences on Ebay but one
bad apple like Joan Moore can spoil it for all sellers.

I won an auction of hers on ebay June 9 2001 and promptly mailed payment
via postal money order. I have not received my goods, nor an offer for refund.
There have been no replys to my polite emails...the only information I have
is what I see on ebay. She left a brief "me" comment to explain the delays
in shipments. However, her auctions continued and I continued to wait. It
is now well over 30 days. I want everyone to be extremely cautious about
dealing with her. Others have reported that she is abusive, retaliatory and
quick to throw around idle threats of legal action against her victims. This
will not deterr me and I urge everyone who has had dealings with Joan Moore
to report their experiences to ebay and other trading/selling venues. This
is more than just a delay in shipping due to the floods-(which I know we
all felt compassionate about)she has made a tidy profit from her practices
of non-delivery. It's a shame, I had just joined ebay and this was my first
tranaction. I will certainly do a more thorough job of reference checking
in the future-if ever again.

In regard to all of the complaints and "rumors" circulating on ebay. kewlgifts2001 is not a "one man" operation. The ads are not posted by one individual, nor is the product shipped from only one location.
The email address kewlgifts2001@aol.com is not associated with any other sellers.
The floods, interruption of mail service and missing payments are not
an excuse, it's a fact. Losing product due to the water is a fact. Replacing
the product, coordinating shipping, answering a high volume of emails is
a huge undertaking. Yes, the email is back logged due to the volume
recently...the repeat email, the mass emails some users are sending has created
a problem. Yes,some of the negative feedback is too personal and very offensive.
No one is being ignored, and all the back orders are being shipped. We are
receiving physical threats, hate email, vulgarities, have been slandered,
and have been associated with other sellers we know nothing about. Every
post put on the "ME" has been at eBay's suggestion to help inform the public.
Every post is accurate and candid. It's understandable if one is upset due
to poor communication and late shipping, however the disgrace of complete
strangers actually typing personal threats, cursing, name calling is frightening
and unacceptable. We are dealing with this situation to the best of our ability
and anticipate the orders being current soon. If any one cares to discuss
their order, you will receive a reply to your email.

I mean if you want less bad feedback ...shouldnt you deal with the auctions
that have already ended??? dont you want to keep good face and keep the customers

WHY NEW AUCTIONS??? Arent you over extenuating yourself more?? You state
that your BACK LOGGED why get yourself further back logged? Or is it a matter
of you are not backlogged you just cant keep up.. I understand it is hard
to run a business. But if you can't keep up with everything why should we
suffer. You seem to be blaming everyone who bids on your auctions for paying
and winning the auction. You can cash a money order right?? Transfer paypal..

to poor weather. WHICH! i might add we would ALL understand. Some of these
people are talking almost 2 months. You had 1 week almost 2 weeks of bad
weather so you say. But you can't use that excuse for the 2 months. Like

and get back to me, this has not happened. I have also noticed that because

everyday. She did respond to me a couple of time saying that she would get
my packages (two of them) out to me asap. She then said one of them was sent
on 7-13 and that she would get the other out to me asap. Well I have continued
to email her everyday, now her mail box is full and I can't send anymore,
and I have not received any packages or my money from her. What do I do?

AFTER SEVERAL E-MAILS TO HER JUNE 22,2001 I FINALLY GET A REPLY, SAME OLD STORY ABOUT THE FLOOD, SHE SAID SHE WOULD BE SHIPPING ON MONDAY,I HAVE SENT SEVERAL E-MAILS SINCE THEN AND NO RESPONSE TODAY JULY 20,2001 AOL INFORMED THAT HER E-MAIL ADDRESS IS NO LONGER VALID. I SENT HER AN EMAIL THROUGH E-BAY BUT I DOUBT ANYTHING WILL COME OF IT. THIS WOMAN NEEDS TO PUT OUT OF BUSINESS
I won an eBay auction from Joan Moore on May 4 and I paid her $54.96 through PayPal the very same day. My merchandise still has not arrived. Although all the e-mail that I have sent to Joan has been polite and professional, she does not respond to most of it and now her mailbox is full. She has promised several times that my merchandise "will be mailed out tomorrow", but I still have not received anything. I hope that you can help me. Thanks.
Yet another update on Joan Moore and this transaction.I RECEIVED MY BEANIES TODAY!!!!!!!!!Almost 7 and a half weeks after Joan MAINTAINS she received my payment.On July 13th she contacted me through a mediator,saying she had posted them that day,giving a tracking number.The parcel that arrived today, had no tracking number and date of postage was 26th of July,almost two weeks after she maintained she had posted them.She even lied to the mediator.I don't think this "lady"[and again that term is used loosely}would know the truth or anything about honesty even if it came up and slapped her in the face!!!!!!!!!!!!!!
I did finally get my "defective" beanie baby back from Joan (after 3 months of waiting all together) when I discovered that all she had done was cut the ribbon off (it was torn in the first place). I was emailed this morning from an investigator looking into Joan's dealings over the internet and is ivnestigating possible internet fraud on her part. Below is the information I was given if anyone else was taken by this woman:
"I received a complaint from an informant that a student at our university was engaging in internet fraud through ebay scams. I am investigating the case. There are a large number of complaints against this seller and if it turns out that this student is in fact the seller, I will pursue charges. I would appreciate any assistance you may offer in this investigation. Any emails or letters you may have exchanged would be helpful. Copies of cancelled checks, or other means by which you paid for the goods along with indications of where the instruments were deposited. Feel free to contact me at 713-348-4595 or by email."

Joan Moore personally, did the accounting for mail in revenue, handles phone
inquiries, shipped a percentage of the orders, and transmitted reports. She
has received numerous complaints because the account on ebay© was registered
in her personal name because she has a vested interest.
Kewlgifts2001, is a modest e-commerce business, not associated with any other, with various individuals responsible for specific tasks. This isn't a hobby, a spur of the moment venture or a student selling nonexistent merchandise. It's a small company, with wonderful people, that sells to a wide variety of customers and had a problem with the account on ebay© in particular. Only eBay© and only with the Ty© merchandise.
The business, kewlgifts2001, did not work to obtain an 1100 positive rating on eBay© only to deliberately destroy itself and alienate the public. The reasons for the terrible interruption in processing orders promptly is valid, and all the individuals closely associated know the facts. There was and is no deliberate effort to "stall", sell unavailable product, mis-communicate, and send slow email replies. The business is being taken care of with heart felt concern and diligently. When the shipping problem initiated, it created a snow ball effect with the internal mechanics of operations. Subsequently for about 2 1/2 weeks, the email became unmanageable due to the volume of complaints and inquiries.
No one associated with kewlgifts2001 is under investigation. The gentleman in Houston who received complaints has satisfactory verification that there is no fraud involved, or ill intent, and that the sales are valid and fulfilled. He knows that any pending sales, will be shipped, and any refunds are being issued. He knows that there are late shipments and that they are being handled. And there is documentation to verify all the payments, transactions, tracking numbers for shipments, etc.
No one has suffered Fraud. It is true many orders are late. Additionally, due to the volume of email, the box was full previously. AOL limits the amount of incoming email...however there is an open line of communication and the customers are not being avoided. The email is replied to as promptly as possible. It's unintelligent, incomprehensible, ridiculous and counter productive, for a customer to be avoided. However, under no circumstances -- will a reply will be sent to a person if the email contents has a personal threat or vulgarity in it.
It is common practice with most retailers to have orders shipped by warehouses, stores, affiliates and vendors to save time and money. You have a city in NY listed for kewlgifts2001, which is only a vendor location. Please don't involve vendors in the problems associated with kewlgifts2001. It isn't fair to the many stores that sell product and are owned independently. There are several vendors on the East Coast who drop ship for numerous retailers on and off the net.
The consensus is that most of the customers are pleasant, understanding, patient, and trusting. They believe there is a valid reason for the problems associated with kewlgifts2001, are secure with the fact the order will be taken care of, and are communicating peaceably while the sale is concluded to their satisfaction.
The minority of buyers, who are understandably upset due to the lack of prompt communication and shipping, however have over reacted by being personally insulting, have personally threatened harm by email and phone, have slandered and have a distorted perception of the facts. They have threatened to "pay a visit", call superiors, involve the police, call neighbors, "see you in court", visit at school, post character analysis on the net, black list, and "push us around". This is severe harassment and unreasonable. It's unconscionable and frightening. Using an Internet sale and turning it into a personal vendetta against an individual is inappropriate and will not be tolerated.
Inquiring about a purchase over the Internet and being concerned is
appropriate. Committing character assassination, threatening, making false
accusations is injurious...and in some of the cases illegal. There are many
customers who will not furnish their number so they may receive a personal
call to discuss their order(s). Email is impersonal and can lead to
miscomunnication. Speaking in person helps avoid unnecessary perpetuation
of the problem and is personal.

I finally received the rest of my order from Joan (after emailing her
everyday for two months and telling her I filed fraud reports and called
her local police). This transaction was a complete nightmare. After telling
her I filed fraud charges, she threated to take legal action against me (although
every email I sent her was nicely written, no threats, just facts). I know
she has still not sent some people their goods, I hope they don't give up.
In my case, persistance paid off.

This is a follow-up to my complaint of July 24 with regard to the eBay
auction of seven Beanie Babies that I won on May 4. As of October 24 this
matter was finally resolved. I initially received six of the seven Beanies
on August 6. The one that was missing was Nectar, which Joan was unable to
obtain. Kali Rea then offered to substitute Unity for Nectar and I agreed.
I have since obtained Nectar elsewhere and I am satisfied with the outcome.
It is unfortunate that things did not go smoothly and that the entire transaction
took over five months to complete. I appreciate Kali's help in finding a
substitute Beanie for me.
