I sent Shawna Cawthorn 63.22 and 59.88 plus 6.00 for shipping. A total of $129.10 for  concerning ebay auction numbers are 3145826930 and 3145828286. It was for old face Teddys. I had them authenticated and they are fakes. This is email I got from her about that.  Art

I guess you have wondered why I haven't left feedback on our transaction yet. When I received the package from you I noticed the OF Teddys were not the same color as my NF Teddys.So I sent them to Becky's True Blue Beans for authentication.Well Becky says they are counterfeit. I am not sure. I know little-to-nothing about beanies. I bought them at an estate sale with many other beanies. Because I did not know the history, I listed in my auction that they were selling "AS IS" and to ask questions before bidding. I even tried to put as many pictures as possible in my auction so my bidders would know what they are getting.   Shawna

I buy from estate auctions. Always random items - whatever I find. I never know the history of each item so I tell my buyers that I am unaware of the item history. "Ask questions before you bid". I even provide as many pictures as possible for the buyers to look at. I did not claim anything illegal. My questions is: How can I be held legally responsible when I did NOT sell them with the intent to defraud!! I read the website links in the email you sent me. Two websites state that I must "intentionally" traffic or attempt to traffic. I DID NOT KNOW!!!!!!! This is the first time I have EVER sold beanies! I will be taking this info to a lawyer to find out if I am really liable. I paid good money for these items too! There MUST be some protection for innocent traders!

Again, I have read through all the new website links that you have sent me. I also made copies and took them to my lawyer. I also notified eBay that I was unaware that the items I sold were not the real thing. I assured them that I would never be listing beanie bears ever again. They informed me that there were places that would check the item to make sure it was real (which I did not know). I had no idea that there were so many fakes out there!

My lawyer stated that I could not be held liable for not knowing (by me listing that I did not know the history, I also meant the following were unknowns - smoking conditions, pet conditions, children conditions, real or not, original purchaser and so forth.). He is also the one who told me to contact eBay in advance, which I did.  He suggested that by me refunding the buyer, I was admitting guilt - which I am not. Me and my lawyer both feel that I am innocent and a victim as well!   Now what?

October 20  Later:

My attorney has advised that I no longer correspond with you by email as you may not be who you say you are (Strange what lengths some people go to over the internet!). My lawyer will be handling correspondence from now on. If you email me, your message will be forwarded directly to him. He does not take your threats very courteously. And by the way, apparently, my reputation is already slighted by the negative feedback left by artsutherland@greenwood.net. And it can not be reversed even if I do refund the money! I have another meeting scheduled with my attorney on Friday morning. We will be discussing the implications of a refund. So much for justice. I am an innocent seller and am getting screwed.

Against my attorneys wishes, I am contacting you. To repeat my previous statement, I AM MEETING WITH MY ATTORNEY ON FRIDAY TO DISCUSS THE IMPLICATIONS OF A REFUND. You must either be blind or just stupid. If my attorney tells me to refund the money (after he further investigates the websites), I will refund the money. Now, did you simply ignore what I told you or are you just being this ridiculous? Sounds like you don't know how to do your job very well. I will be filing a complaint regarding your work ethic, as you are ignoring what I told you in my last email. Again, I repeat,

I AM MEETING WITH MY ATTORNEY ON FRIDAY TO DISCUSS THE IMPLICATIONS OF A REFUND.

If you missed it this time, you really are blind.

Cautionlist: Shawna never replied back to any email sent to her after she received the proof the beanies she had sent were fakes. She stated on November 4 she would be taking authentication to her attorneys that week. She never replied to emails sent to her after that from November until this date. She did not refund the money for the fakes she mailed out. Ebay is investigating now.

Cautionlist emailed Shawna on this date notifying her she had been placed on bad traders list. Up until this time there had been no emails or replies to emails sent to her since November 4. This girl tells so many lies that nothing she says can be believed. She sold fakes and knew full well that they were fakes. She set out to cheat others. This was no simple mistake. If it was any honest person would be mortified and try to set it straight. I was also sent copies of the authetication forms. These forms are authentic.

Thanks for the notification! I have already contacted local authorities about the authentication of your clients claim. Seems the "authentication papers" provided by your client may be a fraud. By the way, you lied when you stated "Shawna never replied to any emails sent to her". Proof of my responses is evident for everyone to see on your website! Your email address is now being blocked from being received in my system.  Have a nice day! By the way, I am not sure who Michelle Cawthorn is, but I am not her. The address listed is not my address. Believe me or not, but you really screwed this one up! Maybe you should think of finding another line of work! Shawna
