I purchased (4) Baby 2002 in December 2001 for $35.30 on their online site. (www.beaniesontheweb.com). When I did not receive the merchandise by Jan. 18, 2002, I called their toll free number. They promised shipment by Jan. 22, 2002, so I added (2) Footie Beanie boppers to the order in the amount of $27.95. They told me they could ship both orders together to save on shipping. I still have not received anything from them and they have disconnected their phone and they do not answer e-mails. I put the charges in dispute with my credit card company, however, I have already paid for the first transaction of $35.30.

Last year, I made a beanie baby purchase from Sugarloaf Collectables listed under Beanie Baby Hotline in the Beanie Mom website. I sent the money, but didn't receive the complete order I had paid for. My attempts to contact them were futile: Phone busy, E-mails ignored. Out of frustration, I contacted Ms. Sara Nelson (Beanie Mom) to let her know that she was advertising and, therefore, promoting a bad trader. Ms. Nelson graciously interceded on my behalf, and the person (a man named Jeff) finally sent me the merchandise under pressure. I resolved NEVER to do business with that company again. Last month, I made a purchase from Beanies On the Web (also Sugarloaf CollectablesII) advertised on Beanie Mom website. I didn't think it was the same outfit because the name Beanies On The Web didn't seem familiar; also, there was an advertisement from Beanie Baby Hotline right next to it, so I didn't even dream that those companies might be connected. I ordered a Nipponia which was a special, and received an immediate response from the company telling me the amount to send and the address. To speed the transaction, I sent a money order for $32.45 that same afternoon on January 22, 2001. After two weeks, I tried to contact the company to see what was causing the delay in my getting my Nipponia. (I had sent another company an order a few days later, and I had received their merchandise already.) Anyway, my efforts to contact them were futile. Below, I am enclosing copies of my e-mails, for which I received successful delivery confirmation from my Internet Server, as well as the only e-mail they ever sent me "to get my money." I checked my purchase order number in their website, and found they are listing it as "there is no such order." I started checking the Internet to see if there were any complaints against them, and I found two entries, but in Japanese. I contacted the webmaster Wakaba Fukada who sent me the English translation for item #21 at http://bbs10.otd.co.jp/1015745/bbs_plain He wrote that "the writer for item #21 says he was deceived by Beanie Baby Hotline web shop. He made full payment but no beanies. Not only that, they made additional charge to his credit card after one month. He says Sugarloaf Collectables is the same organization as Beanie Baby Hotline. They are beginning to deceive more customer's)." The e-mail address for the person who wrote me is wakabatown@jcom.home.ne.jp

It took a while, but I finally found the owner of Sugarloaf Collectables and what happened to his former website Beanie Baby Hotline: The owner Jeff Clark sold the website to an Oklahoma Coin Co. at the end of last year (Nov. 2001), which would explain why Beanie Baby Hotline's address changed from Brunswick, Maine to Broken Arrow, Oklahoma. The Portland, Maine newspaper article which I'm forwarding below explains that the State Court has frozen his assets. Am I right in assuming that since I paid for the beanie baby Nipponia, then it no longer is his asset because it legally belongs to me; therefore, the courts cannot freeze my assets. Please, let me know what can I legally do to get my merchandise. Although long, you have to admit that my story took on an interesting twist. Let's hope that it also has a happy ending Please, let me know what should I do.

Bank sues couple, seeking return of $340,000 windfall

BRUNSWICK — Last fall, a North Carolina bank mistakenly transferred $340,000 into the account of a Brunswick couple.When it noticed the error a month later, the bank says, nearly all the money was gone. Now First Union National Bank is suing to recover the money from Jeffrey and Kimberly Clark, claiming the couple depleted the account during a spending spree that included stops at Victoria's Secret, The Baby's Room, Filene's and the Christmas Tree Shops.

In documents filed in U.S. District Court in Portland, the bank's chief investigator, Assistant Vice President Robert Thomas Jr., also claims Jeffrey Clark used a portion of the money to purchase inventory for his Beanie Babies business at the Cook's Corner shopping mall. The rest of the money, the suit alleges, was used to pay off credit-card debt.

"Between Sept. 17, 2001, and Oct. 16, 2001, Jeffrey and Kimberly Clark engaged in a spending spree, withdrawing, transferring or spending virtually all of the money that was erroneously credited to their account," Thomas says in court documents.

First Union is seeking repayment of the $340,000 plus an estimated $25,000 to cover attorneys' fees. Earlier this month, U.S. Magistrate Margaret J. Kravchuk ordered the Clarks' assets, including their home on Church Road in Brunswick, frozen until the matter can be resolved. A date for a jury trial has yet to be scheduled.

The Clarks' attorney, John Barnicle of Topsham, said his clients intend to repay the bank. But Barnicle, who was retained just a few days earlier, said the amount the bank is owed still needs to be determined. The Clarks could not be reached for comment.

"I disagree with the bank's characterization that the Clarks went on a spending spree," Barnicle said. "If they felt they were in the wrong, then why are they still living in Brunswick? Why didn't they just take off with the money?"

No criminal charges have been filed against the Clarks. Mark Terison, a spokesman for the U.S. Attorney's Office in Portland, said he was unaware of the case, but would be unable to comment even if an investigation were being conducted.

Terison said potential charges in such cases include bank fraud, a federal felony punishable by up to 30 years in prison and a fine of up to $1 million.

In 1997, South Portland police charged Frank McPherson, 28, of Gorham with theft after he went on a spending spree that was funded with $169,000 his credit union mistakenly transferred to his account.

McPherson used the money to purchase a pickup truck, a new car for his girlfriend, two high-priced mountain bikes, expensive clothing, a camcorder and a modular home. He was sentenced to three years in prison with all but 45 days suspended. He also received four years' probation and was ordered to pay up to $20,000 restitution.

According to court documents, the Clarks were living in Georgia when they opened a capital asset management account with First Union in September 1999. About a year later, the Clarks bought a home on Church Road in Brunswick. Clark opened a Beanie Babies business called Sugarloaf Collectibles. He also operated a Web site that sold Beanie Babies.

On Sept. 17, 2001, a company called Oklahoma Coin Exchange Inc. paid the Clarks $37,750 for the sale of the couple's Web site. While the check was being processed at the bank's service center, an encoding error was made and the Clarks were credited with $377,750 - a $340,000 mistake. Over the next month, the Clarks spent nearly all the money that had been credited to their account.

The bank's attorneys, Peter Brann and Kevin Beal of Brann and Isaacson in Lewiston, contend the Clarks promised to repay the funds, but never did.

Barnicle said one option might be for the Clarks to sell their Church Road home.

"The bottom line here is, if there was an error made, it was made by the bank," Barnicle said. "The Clarks intend to repay every penny of what the bank is owed, though we don't know yet what that amount is."

Well, today I got the last news from Bangor Daily News, Brunswick, ME. A federal judge has frozen all their assets, including their house, pending the outcome of the trial. Jeffrey W. Clark is still operating Sugarloaf Collectables (he misspells it), but now the address given in his website is his home address: 301 Church RD, Brunswick, ME 04011. Phone # (207) 798-4568. You can find his website in the Internet under Beanies On The Web, Sugarloaf Collectables. I sent a $32.45 money order about three weeks ago (on Jan. 22) to his shop at Cooks Corner, 8 Gurnet Rd. Suite 52, along with a copy of the order form. I have copies of everything, including M.O. receipt. I have been checking on the Internet, and I found that Jeff Clark not only made all the $340,000 he took from the bank disappear, but he shed all his holdings, like putting everything on his wife's name.If you check the Internet search engines, you'll find even their phone number is listed under Kim Clark. I sent an e-mail to Jeff Clark saying that I intend to file charges against him, reminding him that they would be federal chargeslike the ones he's already facing from the North Carolina First Union National Bank.I need to find other people who may have been taken by him, to build a case that would stand in Federal Court. This is a nightmare! Could you help me with this matter? I would appreciate any help you may provide.

I read with interest about your problem with Sugarloaf Collectibles. I also placed an on-line order and was charged for it on 12/31/01. I have never received the order. I reach someone at their 877-798-5088 and was told my order had been shipped and that they honor all orders. When I still di not get my order, I tried to call both phone numbers and sent numerous e-mails. The phone numbers have been disconnected and I have had no response to my e-mails. I am having my credit card company charge back the $. Also, I have contacted Beanie Mom since that is where I got Sugarloaf web page. Sara Nelson is supposed to contact me about this problem. By the way, I have received a couple of beanies before this problem from  this company without any problem so I thought I could trust them. Guess I  was wrong!! Hopefully, we can both get our money back.

I, too, am apparently another one of Jeff Clark's victims. I placed an order online (Beaniesontheweb) on January 20th, and my credit card was charged, but nothing has arrived. I bought alot of merchandise from Sugarloaf in the past, and never had a problem. But now I see he has scammed many others, besides me. As I'm sure you already know, his phone is disconnected & he won't reply to emails.

As soon as I learned of the problem, I immediately phoned my credit card company to have them "reverse" my payment. Unfortunately, they can't until I have received my actual statement showing the charge (when I called my cc company, they verified that I had been charged). I hate to wait another day (or week or two) to start pursuring my refund on unreceived merchandise. Any help you can give, will be greatly appreciated. Hope this fradulent seller is brought to justice!!!! Thanks!

I am writing in response to the complaints about Jeff Clark (Sugarloaf Collectibles II; Beaniesontheweb).

I work for the company that purchased Beaniehotline.com, Inc. in September 2001. The company, Oklahoma Coin Exchange, Inc., has been in business for many years, and the owner is very honest and reputable. I feel it is SUCH a shame that Beaniehotline is being confused with Jeff Clark (Sugarloaf Collectables II; Beaniesontheweb). Since we acquired the Website, we have done EVERYTHING in our power to ensure our customers get only top-notch service and merchandise in a timely manner.

Just like many of Jeff Clark's "victims", we were not aware of his illegal and/or immoral business practices. Now, not only are many customers paying the price for his actions, but so is my employer! It isn't right OR fair for any of us. I pray justice is served, and restitution is given to all of the people affected by him.

On 12-31-01 I purchased 4 Beanie Babies from Sugarloaf via the Beanie Mom site. I got them within the week, but when I got my Visa bill, it had been charged twice. One charge for $44.30 (which was about $8 more then I had been quoted when I ordered) and again on 1-4-02 or $49.50. I figured it was just an error so the next day on 1-17 I called Sugarloaf. He told me my credit card would be credited for the extra charge.

I waited until 1-25 and called my credit card. It still had not been credited. I called Sugarloaf and was told that it was a mistake. Supposedly someone else with a similar email address placed an order at the same time I did and that was what had happened. Well, I got my next statement on 2-14 and there was no credit. I called Sugarloaf and the phone had been disconnected.

I will contact my credit card company, but I guess I just lost $50.
Is there anything else I should do?

My name is Cherie Meyer and I live in Maryland. I mailed a check to Sugarloaf Collectibles II on Jan 15th 2002 for a Pierre Buddy. They cashed my check on Jan 24th and I have never received my buddy. The check was for $37.45. I have tried numerous times to call them only to find that their phones have been disconnected. I have tried to email them several times and they have never responded. I have received things from them in the past and thought that they were a good company and I guess like the others I was wrong. This experience has turned me off to ordering from the web I am now to scared to do so. Any information you can give me on the outcome of this or how to go about getting my money back would be greatly appreciated.

this is Jeff Clark owner of beaniesontheweb. just to set the record straigt I have only charged people that have order from our company. I know there is alot of outstanding order not filled but am trying to correct that with the attachment. if the customers that order from me and been charged then all they have to do is dispute the charge and I will agree to the dispute the money is still sitting there. I just cant process any credits or debits because of the law suite at this time. I have always been fair to my customers when I owned beaniehotline and sugarloaf in ga along with beanies on the web. that why these company were bought from me because of the good reputation I wish this was the same but when your down other people try to bring you further down. we do apologize for all the incontinences and hope to correct the mistake

I placed an online order with Beaniesontheweb-Sugarloaf Collectibles II in Brunswick, ME on 1/1/02. My credit card was charged for $35.30 on 1/2/02. I have never received any merchandise from them. I called in mid January and was told it would ship the following day. I have sent several emails to which I have had no response. Then they quit answering the telephone. On Feb 7,2002 when I attempted to call, I discovered that both phone numbers had been disconnected. I called my credit card company and filed a dispute claim that same day. I am still waiting for the outcome. I would appreciate any advice you can offer on this matter.

Beanies on the Web never sent me the Luke Buddy they charged me for several months ago. Then on 1/21/02 they charged my credit card $68 the day after I ordered instead of waiting for the order to be shipped. Thirty-six days later the order has not shipped, they have disconnected their phone, but they are STILL taking orders!! I am reporting them to the Attorney General's Office for the state of Maine as well as the Interstate Commerce Commission.

I am so saddened by the way that Jeff Clark has taken so many people money and sent No Beanies. I for one am one of those people. I sent him checks totaling 826.00 and am still waiting for my order to be completed. This has been going on since May of 2001. If anyone knows who I should contact regarding this matter please let me know. I have all my canceled checks. My husband is very angry with me right now. This is the first thing that I found on the internet regarding what Mr. Clark has done to so many people. He needs to pay for what he has put us all through even with our spouses.

I did not know they were suspect until I just looked at the Beanie Mom website. I have ordered from Sugarloaf before with no problem. I submitted a billing dispute claim to the credit card company. We placed an order with Beanie Baby Hotline on December 20, 2001. We received a confirmation email from Beanies on the Web. The order for $56.70US was charged to our credit card on December 21 2001. We received the order December 31 2001.

On January 8, 2002 our credit card was charged AGAIN for $56.70US for the same order. We have not made any other orders.

We have emailed them a few times about this problem and have had no reply. We are currently having our credit card company look into this double billing.

Back on 12/31/01, I ordered the new January releases from Sugarloaf Collectibles. I had ordered from them before with no problem. I received my credit card statement and saw that $90.45 was posted to my account. The same day I tried to reach Sugarloaf on their 800 number to no avail, it rang off the hook, I tried their other number and was told it was disconnected with no further info. I e-mailed them about 4 times to avail. I have written to my credit card company telling them what happened. Needless to say I never received my beanies, and I am awaiting word from my credit card company. I now know that I am not alone with this problem.
