Message from Tom O'Dea


I have spoken with Trivedi's lawyer, the prosecutor and an investigator, all in the last few hours (Trivedi's lawyer was via e-mail). A notice will be sent out in the next week or so from the prosecutor who is doing an excellent job in this case. As part of the sentence there will be a court order requiring Trivedi to pay back 100% of what he stole so a promissory note is NOT necessary (couldn't hurt but it is not required). What that means is whatever he does not pay back now, must be paid back as part of an order of the court. I will see if I can get a copy of the transcript of the sentencing hearing (I may need everyone to kick in a dollar or 2 - it may cost $300 +/- but if 300 people sent me a dollar I'd be covered and then I could send it to everyone - don't send me anything yet - I'll try and get it for free). With a copy of the sentencing hearing, it will be much easier to get the money from him once he's out of jail. As part of the sentence, he will have to accept the debt as set forth in the IFCC list - DO NOT TRY AND INFLATE YOUR LOSS. If "irregularities" / fraudulent claims are made, you could be prosecuted and you will hold up the claims process for the rest of us. I am going to send the prosecutor my list so make sure you don't submit different numbers! Be honest, please.

Dear Interested Friends -
As many of you know, I am also one of those who was "taken" by Raj Trivedi (aka Edward, Barbara....?). I paid $775 by postal money order for a camcorder that was never delivered despite numerous fake USPS tracking numbers supplied by Mr. Trivedi.
Well, through the hard work of many of our law enforcement officers in California and Texas (and elsewhere I'm sure), Mr. Trivedi was arrested. (There is a particular officer who has been particularly busy on this case but he wishes to remain anonymous - we should all be thankful for the unsung police officers who work so hard to protect us all - I would propose that we all take 5% - 10% of whatever we get back and donate that to our local police benevolent association or see http://www.officer.com/ for some great ideas as to where to send the donation).
Anyway, on Friday 1/18/02, Mr. Trivedi and the prosecutors entered into a plea agreement. Mr. Trivedi plead guilty to 5 Felony counts (2 computer crime violations, 2 mock auctions and 1 grand larceny) and agreed to 3 years confinement and "global restitution." There will be a sentencing hearing in 60 days if Trivedi does not make the "global restitution." What does that mean? It means, at least so far, the best thing that could happen has happened. I spoke to the prosecutor a couple weeks ago and this is what she had hoped would happen but she was not sure she could get it done. Once I get her permission to publish her name I will do so as well - we all owe her a note of thanks and maybe a letter or 2 to her boss and the newspapers in San Diego as well. I will e-mail both the prosecutor and Mr. Trivedi's lawyer to see where they are getting the list of victims from and to assure all those who were victimized are made whole.
For those of you who have already e-mailed me, you do not have to so again but I remind everyone to make sure they fill out the ifcc complaint referral report - see www.ifccfbi.gov - I think that is where they are getting the list of victims. Please forward this to everyone you know who was victimized who is not on this string (I'm sorry for those of you who I have missed!). If Raj Trivedi does not make complete "global" restitution then we will re-examine whether a lawsuit would be an appropriate recourse.>>>>>

More details will be posted here as soon as I receive them.  If you have not sent your complaint to me, please do so immediately. This took exactly 10 days from the day I  first contacted the District Attorney in Houston..wonderful cooperation from all of you, as well as the Houston District Attorney's Office, the San Diego District Attorney's Office, and the Fort Bend County Sheriff's Dept!  RAJ will be extradited back to San Diego, CA. After they have him, the Fort Bend County District Attorney's Office should be able to get charges filed. Thanks to all of you who sent your complaints in so quickly.

We bought a laptop computer (Apple iBook 500 Mhz DVD/CDRW 128 MB) on 8-30-01 for $1445 and paid by Paypal the next day. 2-3 week delivery was promised. After weeks of being unable to get a tracking number we finally asked for a refund on 10-5-01. A week later they claimed to send out a refund (which never arrived) and then another. After a couple of fake tracking numbers we received a letter which stated refund enclosed but there was no check!!!!! We have since been sent two more fake tracking numbers and no refund. The San Diego Better Business Bureau has received 59 complaints mostly about delivery problems. They skipped town from San Diego and are now in Katy, Texas. They have not responded to the Houston BBB's calls. It has been 10 and a half weeks with no resolution. We reported them to the US Postal Inspector, IFCC, NFIC and the Texas Attorney General. Similar to all other complaints. Ordered a computer on 8/9, paid via e-check through Paypal, and never received goods. Was sent three wrong tracking numbers, then was promised refund, one of which was a bounced check on a bank in Massachusetts, and two more times empty envelopes saying that a check was enclosed but was not. Now they are not answering e-mails. Please feel free to contact me via my e-mail address if you have similar issues. I am trying to pursue this as best I can, and would appreciate others experiences with this company so we can find a way to shut him down!

This company is nothing but fraud. I paid $1300 for a laptop. The laptop never arrived after 5 weeks so I asked them for a refund and filed a complaint with paypal. I got a check from rajsoftware for a fake bank account which obviously bounced. Asked for refund again. He sent me a money order that somehow got lost in the mail. Then he send me a verfied mail that I could track but guess what he put the wrong address on it. I dont know but all this interesting list of events and then not responding to emails after this incident has nothing but this guy is a fraud and running an illegitmate business. If you read this before buying from rajsoftware you should be lucky and do not give away your hard earned money to this guy.

He does not have a phone number on his website and paypal is another company that wont do sh** about this. Anyways I think I lost my money. Hope nobody else does.

The owner of this company is Raj Trevedi. Raj has a resellers program under his so-called business, rajsoftware. People sign up under the reseller program and begin taking orders from individuals on Ebay and forwarding the money through PayPal to Raj. Raj is suppose to ship the item directly to the reseller's customer. Instead, Raj keeps the money, and never delivers the merchandise. This makes the resellers responsible for the refunds to the buyers, but the resellers have already forwarded the money the Raj.

I discovered this after winning a bid for a camcorder on ebay and receiving an email to myself and 13 other people from the reseller a few weeks later concerning his troubles with non-shipment of items from Rajsoftware. Raj had lied about shipping the items, had given the reseller false UPS numbers, told him that the items were going to ship in a couple of days, etc. Raj's tactics are to stall the buyer or reseller for as long as possible. I have learned that Raj no longer uses PayPal. I assume PayPal booted him because of complaints of fraud, but Raj's story is that his prices are so low that he can't justify the fee that PayPal charges to do business.

I did not know any of this until I started asking the reseller some questions and doing some research of my own. I have lost $700 over this. In my case, the reseller happens to be a college student who signed up for the reseller program and was selling items through Ebay. I have been in contact with this reseller who, I believe, is probably in this for about $10,000, but that is only a guess.

If anyone would like more information, I'll gladly discuss this in more detail. I'm also interested to know if anyone is pursuing legal or criminal action against Rajsoftware, Trevedi Infosys, or whatever he calls himself at this moment. If there's a class actions lawsuit againt this guy, I would like to know about it.

In July 2001 I paid Rajsoftware for a Canon ZR 30 I won from them on Ubid. I paid via Paypal. They never sent the camcorder, and kept telling me it was coming. I ordered the camcorder from one of Raj Software/Trivedi Systems resellers (Terry L Choate). I paid with my VISA Credit Card.  Camera was to be drop shipped to me directly from Raj within 2-4 weeks of payment. I have spoken on the phone and emailed with my complaints on numerous occassions (i have all my records). Each time I was promised a new delivery date or given a new excuse as to why it had not arrived. I have even been given false ups shipping numbers (Steve Weaver - 0301 0120 0000 7553 2924 11/15)!   I have not received the camera. Terry has since informed me that Raj has not been shipping cameras to any of his 80 plus prepaid customers! It turns out that this guy has a long record of fraud, yet has never been caught!

I bought Sony digital camcorder on Ubid on 7/18/01 and paid them "Rajsoftware" the following day through paypal. They promised 2-3 week delivery. They gave me at least 3 boogus tracking numbers and each time making lame excuses and promising that it will be shipped out when the next shipment is in. But after weeks of of getting nothing I demanded a refund so they sent me a tracking number for a certified mail and I waited ... and got nothing. So they sent me another number and this time a a check came. So I thought - cool - this da** transaction is over so a week later I email them specifying that I have received the check and I would not do business with them again. Their response - 'Can you provide us with the address of the bank that was on the check cause we have closed the account 2 of the 3 checks that we sent out!!" Lucky for me I didn't desposit the check otherwise the bank would charge me!! So now they are going to send me a MONEY ORDER (yeah right)!! It has been almost 3 weeks and of course no Money order!! I can't believe UBID let these BAS****S use their auction service!! I lost faith in this a***ole and whatever email he sent me (Elizabeth, Edward, etc), UBID, and PAYPAL too. They are all worthless since I lost $625. UBID & Paypal can't do cr*p except for an email saying it is Raj fault but he has no money in his account so they cannot get any money to give back to me!! Let get this BAS***D out business and get our money back!!

Broken promises by: Edward, Judy, and Elizabeth, but may all be one person, Raj. All correspondance by email, so names may be misleading. I am asking for any assistence from anyone to hopefully get back my money, but definately get this person or persons where they rightfully belong. Have sent complaints to: BBB of San Diego, Attorney General of California, FTC, FBI(IFCC), Consumer Affairs, Attorney General of Texas, BBB of Houston, Attorney General of Arizona,(my home state). I like many of you in good faith sent monies off to purchase product from rajsoftware.com. On the 6th September I had $US1540 sent to rajsoftware bank account from my bank here in the UK. I was trying to buy a Sony XG 700 Laptop, it has now been almost 3 months with nothing to show for it, except international toll calls to UPS and USPS trying to track this parcel and a heap of emails to and from them. I got run around in circles with various tracking numbers, ignored emails etc. I even paid extra to have it shipped with UPS.

Awarded SONY laptop through uBid and paid by personal check in August 2001. My check was cashed by Trivedi Infosys on Septeber 6, 2001 with agreement to deliver by the end of September. In October, numerous e-mail inquires on my part were followed by company promises to first deliver computer and then promises for a refund.

I gave them repeated advance warnings that if I do not receive a refund by November 30, 2001, I will file fraud charges against their company. As of December 2, 2001, they have not sent either the computer or the refund.

I have now filed fruad charges against Trivedi Infosys and Raj Trivedi.

I have spoken on the phone and emailed with my complaints on numerous occassions.Each time I was promised a new delivery date or given a new excuse as to why it had not arrived. I have even been given USPS shipping numbers that were falsely addressed so as to return to sender.I have not received the camera. Terry has since informed me that Raj has not been shipping cameras to any of his 80 plus prepaid customers!

Like most of you I have also been tricked. I ordered a Canon Camcorder on UBID and paid my $600 through PayPal in July. All I have received is false tracking numbers, lies, and ignored emails. PayPal will not respond to my request for refund. This is definitely fraud on a very large scale. I have to admit they did a good job of being fraudulant. Strung me along for months. I am starting a dispute with my credit card company but it has been a long time. I am willing to go along with anyone who wishes to pursue criminal action, etc.

My complaint is the same as the rest. On Sept 30th I "won" a uBid auction for a Sony DCR-TRV17 digital camera. On October 5th, I made payment via Paypal for $626.00 to Trivedi Infosys in Katy, TX. Since then I have been subject to nothing but delaying tactics and outright lies, including three false USPS tracking numbers. I asked for a refund over a week ago and all I have received in response to that and to several subsequent requests, is silence.

It is now December 5, 2001 and I still have no camera. Terry emailed me and about 70 other people who he sold cameras to through ebay. It appears that Raj Trivedi with rajsoftware.com (I assume he is the owner)has everyones money and is not sending out the cameras. I want to make sure that no one else looses their hard earned money to this crook.

I bought a Sony TRV30 video camera on ebay from Robert D Peterson of Computer Xchange, Lamar, MO. I paid $1,105 via paypal on 10/14 and have received nothing. Peterson says the problem is with Trivedi, the distributor, whom he allegedly paid. I was initially promised delivery around 10/19. The retailer Peterson appears to be legit (had a sterling ebay record until this happened), but I have no proof of anything except several notes from Peterson trying to explain. I would like to help build the case if I can. What information would help?

I've filed complaints with ebay, with paypal, and with visa, but it will take a while to see if they will help. Paypal will not intervene for me - I filed after their 30-day limit, but they do have the specifics of my claim.

i ordered a product from rajsoftware.. an apple ibook laptop that cost 1450$ in august. its now dec. 6 and no laptop. the said it was to be mailed oct 15.. he mailed a 1 pound package to CT. then he tried to mail again. this time to Oak Creek, Wissconsin. i have finally asked for a refund. Elizabeth in accounts said it was mailed the 29th.. but no sign of it. she just wrote me back after i told her i contacted the district attorney of sandiego to file fraud charges and the better business bureau to file a complaint. she wants to arrange for a bank wire transfer. i froze my account so that they can't take anything from me. and im trying to see if it will work and ill get the money by the end of tomorrow.let me know whats going on with these people. i will be more than willing to put a stop to them!!!!!

I must join the long list of people who have been swindled by rajsoftware.com I ordered a Sony TRV17 camcorder on 9/7/01 on E-bay and paid $755 thorugh PayPal. I bought it through one of Raj's resellers. After several weeks, I started calling and e-mailing. When I spoke to Raj on the phone, he was quite hostile and refused to confirm or deny anything about my order, and told me to not call him. (281) 398-5273. He sent three bogus tracking numbers, none of which ever arrived. PayPal refused to give a refund as his account balance is $0. Three months later, I still have neither a product nor a refund. I only wish I had heard what a bad character he was before I placed my order!

I ordered a camcorder from Raj Software through UBid in July. They never delivered it, but they sent several UPS and USPS tracking numbers for things delivered to people in 4 different states. Also, after having promised a refund on two occasion, they sent e-mails asking questions as if they knew nothing about this order.  Ubid gave me some information about Trivedi, and I found the phone numbers for the San Diego area were not listed anywhere. I don't know if they were real numbers. But since they seemed to have moved to the Houston area, the San Diego information is probably useless. It should be noted that their web page Rajsoftware.com lists no business address, no fax or phone numbers. The only contatcs are e-mail addreesses. Legitimate businesses generally have a business address.

I tried to be a reseller for this scam artist. In a matter of 10 days, I was able to sell 30 cameras via eBay and accept payment through PayPal. I brought in $25,755 and sent Raj $20,330. The first two orders to him were by PayPal, the next 28 were by check. After he didn't deliver in 2-3 weeks and after receiving many warnings from other resellers, I stopped payment on all my checks to him. Luckily, I was able to catch this in time to cancel all of my checks and refund my customers their payments so they don't come after me for fraud. I then tried to get my money back through PayPal. PayPal was useless and told me that even though Raj was a fraud, they couldn't give me my money back because he has no money in his account. That put me out $1095. I was able to cancel 28 checks, but at a cost of $25 each for a total of $700. Bringing in nearly $26000 in sales via eBay and PayPal cost me about $850 in transaction costs as well.

I've sent my complaints to the San Diego FBI office at sandiego@fbi.gov, the San Diego Attorney General's fraud division at Receptionist@sdcity.sannet.gov and the Houston Better business bureau (www.bbbhou.org). They told me everyone should also file complaints there at www.bbbhou.org and they will aggregate them and send to the FBI and Attorney General's office. I want my $1095 in money paid to Raj by PayPal, my $650 paid to PayPal for transaction fees, my $200 in eBay fees, my $700 in bank stop-check fees, $5425 in lost profits and a piece of his newly-bought house at 20615 Aspen Canyon Drive in Katy, TX and anything else he owns in life for my lost time, aggravation, paid and suffering. Then, I want him thrown in jail for a really long time!

I have several others who have more information and I will share this with them.

I am shopping my case around to Houston area lawyers and am hoping someone takes my case on a contingent fee basis. I don't want to have to pay $5000 to a lawyer so that maybe I'll win $7000 which I'll never recover until Raj sells his house or some other legal system injustice or scam. If someone has a lawyer suing this guy, please share this webpage with your lawyer so he can contact me and the rest of us. I want to join your claim. We should all sue him!

On Sept. 11, I was the high bidder for Sony PC9, digital camcorder placed up for auction on Ebay. Part of winning this auction was to also receive the website address to this ebay sellers supplier. It was Rajsoftware.com. They have a section of their site that says "Join our resellers team." So I did. How it works; I would put cameras up for auction on ebay, receive payment from buyer, and forward the money onto Rajsoftware. They would then ship the camera, "please allow 2-3 weeks for delivery," says their site. After the first order I placed with them did not ship after the 3 week mark, I became concerned and e-mailed them. They sent me a tracking number that did not work for 3 weeks. I e-mailed Rajsoftware again explaining to them that my customer was getting annoyed. He explained that I could either cancel the order or file for an investigation. This made me wonder; if he's offering to cancel this order, that would mean that the camera never shipped. So I canceled the order and asked for a refund. I never received the refund. A few days later, 4 more orders of mine were supposed to have been shipped. I received 4 more tracking numbers that did not work. Obviously something was wrong. I then started to do research on this company and found dozens of places including www.groups.googles.com, with complaints regarding Rajsoftware. All exactly like my experience with them. After find this out, I e-mailed Raj once again and asked for a complete refund for all of my orders placed with them. Totaling over $11,000. This was the monday after Thanksgiving. They told me they would sent me a refund. I e-mailed them on Friday 11/30 asking what they were doing about my refund and they said "a refund check was sent out on Wed. 11/28." I gave it 1 week. The next Wed. I did not receive the check and e-mailed them saying I am going to take legal action. To this day I still have not received a refund for all of my 15 customers.

Until today, I have not received anything from him. I reminded him everyday. He promised to refund and gave me a fake USPS certified number twice. And after that he sent a letter saying that he cannot refund. The letter was sent from Katy Texas. His hand-writting on the envelop and I save it. I ordered the item (Canon Elura2 MC camcorder) from Rajsoftware/TriTrivedi Infosys, Inc. on October 27th, 2001 for $600. They only accept payment from PayPal. The delivery time was 3 weeks.

Their scheme with PayPal works like this. The vendor strings along the customer during the 4th week with short e-mails. The 4th week for me included the Thanksgiving holiday, so the delay did not seem all that unreasonable. After 30 days, the vender stops responding to e-mail requests, which is the deadline for disputing payment with Paypal.

I then submitted a grievance with PayPal, but was told that since it was day 31, they would not pursue the matter.

From the other complaints posted, it is clear that PayPal was aware of the fraudulent activity of this vendor since at least August of this year, but continued to process the transactions. PayPal receives a percentage of each transaction, which is significant for the high-end items sold by Rajsoftware/TriTrivedi Infosys. Thus, PayPal behaves as a money launderer for Rajsoftware/TriTrivedi Infosys.

Comments: I purchased a camcorder from Trivedi on a uBid auction. Exactly 2 weeks later, on a Staurday, I received my camcorder. It was exactly as stated it would be and came in the shortest amount of time posted. I learned of Trivedi's Reseller program and became involved after doing some research through Paypal, as well as my own positive experience. I sold several camcorders at auction and Raj delivered them, for the most part, without incident (about 70 total). Later in September things started to get more difficult as he moved from San Diego to Texas and shipments became later and later. Eventually they almost stopped. He still has approximately 70 unfulfilled orders totaling approximately $65,000.

Same as everyone else, promised it would be sent out 1-3 weeks. No Camcorder or refund. I was able to file a complaint with Pay Pal, but haven't heard from them. They are a guilty as Raj Software.

I was victimized by RAJ via Phoenix. Luckily for me I have the resources and roughly 9 days after the purchase I began to rattle Phoenix's cage to such an extent concerning filing a lawsuit and in fact having my attorney write a note... that he repaid me out of his own pocket. Bless his heart...really feel sorry for the middle men.
As for my out of pocket... roughly $40.00+ which is basically Pay Pal service fees. But if I can be of any assistance, testify, whatever, just let me know when and where.

I have been waiting for it ever since and have been kept up to date on Raj Software by Alvaro. I will file the FBI consumer fraud form as well. Do I need to do anything else??

My complaint is the same as the others on the list. I purchased an item on UBid from Rajsoftware.com or Trivedi Infosys Inc. and never received the item. I was given false tracking numbers and promises of refunds and still never received anything.
I partially blame UBid for letting this seller continue to commit fraud. According to UBid's seller ratings, this seller has had low ratings for some time. Instead of acting on it, UBid continues to earn a profit from the sellers business.

Hello Everyone,

I just spoke with one of the Detectives from Fort Bend County in Texas who was involved in RAJ's arrest yesterday. I had several questions for him, and the news is not very good.

Some of you have asked if you will get any money back. That is a possibility, but he owes so much, that it may not be a probability.

Some of you wanted to know if PayPal, UBid, and eBay will be held liable. From the criminal perspective, probably not, but if you all want to get together and file a class action civil suit, then you can name anyone you wish to be liable. This is especially important for the resellers who are legally responsible for returning the money to their victims. If you are a reseller, you have been caught in the middle of this scam, but since a contract was entered into by you and the customer, you are responsible for restitution. (This was the Detective's belief..you may want to pursue this with an attorney). Any of you who have lost a lot of money may want to get some legal advice immediately if you haven't already done so.

RAJ's website will be removed..The Detective was surprised it was still up.

He also told me that the most important thing is that the FBI Fraud Form be filed. You can find that at www.ifccfbi.gov. If you haven't done so, please file that form. All forms submitted will be channeled to the proper jurisdictions. This is especially important for any cases that have occurred since about Sept. when RAJ moved from San Diego to Texas. There are already many, many complaints filed in California, but not as many more recently in Texas, so if you haven't filed that form yet, please go to the FBI site and do so. The Detective wanted everyone to know that this is a case with multiple venues..CA, TX, and probably more. Different charges will be brought by different jurisdictions.

The good news is that he will definitely be prosecuted. I can continue to post complaints to Traderlist, and the Authorities do read that, but they need the FBI form most of all. They will use the information on that form to contact you.

The Detective also stated that it may be helpful for you to contact the state offices of the Attorneys General in Texas and California. Their addresses are listed at the bottom of the pages at www.traderlist.com/California.html and www.traderlist.com/Texas.html .

I will continue to compile a list of names of victims who contact me. If a civil action is brought, I will be happy to forward the list of names to the proper parties so everyone on my list will be included. If you know of others who haven't submitted their complaint to Traderlist.com please ask them to do so..just so we do have a list that is updated and available to all. This is the only way you will all be able to keep in contact and know who the other victims are, from what I understand.

If I receive any other updates, I will either contact all of you, or post the updates on RAJ's page. If you have anything you would like posted that is of interest to the group, please let me know.

I was wondering about that Edward Liu guy who's been replying emails for rajsoftware and providing false shipment info, and lying about the status of the orders? Is this the same guy as Raj, or someone else? If it's a diff person, since he's part of this scam, I would think he should be apprehended also. Does anyone know? As of last thursday I was still getting replies from this guy lying and saying the product would be shipped.

I ordered a cannon zr30 from rajsoftware on Oct 30 for $495. A great price if I in fact ever recieved the camera. I paid with paypal. It was supposed to ship in 2-3 weeks. I e-mailed him Nov. 20. "Edward" said that the camera would ship early next week. The story is the same as everybody else, no camera, no refund. Paypal are crooks too. They tell you that before you can make a complaint, make sure to give the seller ample time to ship. Try to contact him to resolve the dispute. Try this and that, wait and see. But then they only give you 30 days to dispute?? I just filed a complaint with visa, hopefully they will refund my $$ from paypal. They guarantee online fraud protection, we'll see. After all, they are in the risk business, not me. The worst part is that I paid $20.00 to slowrider34 on ebay to get the link to buy this camera for $495. Slowrider 34 is Jorge Olsen who has the website sweetseats.com. I e-mailed him back and told him what happened, he wouldn't even give me my $20.00 back!

I'm sorry if you are receiving this message twice. I have been away and have not answered emails so I apologize. I have filed a law suit against paypal for the amount of $800,000. My lawyer is doing this on a probono so I'm not paying him anything unless we win. Also I have spoken to Raj Trivedi's attorney John Cleary who is defending him in his upcoming trial. He wants me to send him everyone who has been defrauded by them. Raj owes me $22,000 (my 15 customers and myself). and from what his lawyer says that they are going to sell all of Raj's assets and try to give everyone their part.  I will be faxing all this information to Mr. Cleary this Friday. I won a bid on SONY VIAO PCG-FX270 on 9/25/01 from Ubid.com. I sent them a personal check for 1,395.00. Two weeks after I emailed them to check if they received my check. Since they didn't receive the check so I decided to send them another check in the same amount and told them to void or send me back one of the checks if they received them both. First I thought I can trust them since I have the information of this company either Web site, email and address. But around October 25-29, they had cashed all of my 2 checks. I emailed tehm and asked for refunds or send me 2 laptops. They emailed me and told me that they will send me refund via certified mail with the tracking number. I checked the tracking number on the internet but it's fake numbers. I've heard from them since December. Please help me!

I bid on and 'won' the bid to purchase a Canon ZR30 mini DV camcorder for $525.00 in Aug 2001. I have been in continuous contact with Rajsoftware and was told that the shipper was behind. I never received the item so I stayed in contact via email and was told I could get a refund. I never received the refund. I was told that a check was mailed, I never received it. I was then told on more than one ocassion that a certified letter with a check was mailed. I have never received any mail from them. I then advised that I wanted a wire tranfer to my account. After providing the information, I still never received any refund. I repeatedly requested that they check my address to ensure that it was accurate. I also repeatedly asked for a number to call to speak with someone. I was never provided that information. I have every email from Aug 2001 to the last email I received from this company on Dec 6, 2001. I have filed complaints with PayPal, Ubid.com, the BBB, the IFCCFBI, my bank Wachovia, the DMA Mail Order Action Line in Washington DC, the District Attorney's office in San Diego. I have over 50 emails tracking my correspondance with rajsoftware. There are different names used on emails I received from rajsoftware.com. I would like resolution. On 8/29/01 3:34:29 PM, I placed a winning bid on this auction from UBID.COM for a Sony VAIO FX220 notebook computer. I sent a check of $1215 ($1195 for the computer, and $20 for shipping and handling charges) on 30 August, 2001, which was cashed by this fraudulent Trivedi Infosys, Inc. (ACCOUNT 430032672) on 10 September, 2001. After several days, when I still did not receive the notebook computer, and since I was moving into a new address on 1 October, upon asking them, I was told that it was not in stock, and they would ship it as soon as it arrives. I agreed. But even after several days, when it did not arrive, upon asking, I was told that I could ask for a refund. When I did so, I was told that my refund had been mailed to me. When it did not arrive again for a few days, I asked them yet again. In the days that followed, I was sent three false USPS certified mail tracking numbers. The first one, 7001 1140 0002 4553 8117 (this no. didn¿t exist in the USPS records), the second one, 7001 1140 0002 1338 4432 (this was mailed by someone other than Raj Trivedi to plainsboro, NJ-08536), and the third one, 0300 1290 0004 4881 2178 (this was mailed by someone other than Raj Trivedi to someone at Knoxville, Tennessee). When I gave them an ultimatum, I was told that a replacement letter had been mailed to me on 29th November, 2001, which still didn't arrive. I have all the e-mails (over 50 odd mails that I had sent to no avail), the copy of the check with the Trivedi Infosys, Inc. account number on it, and also the copy of the postal receipt of the check that I had mailed on 30 August, 2001, and can send copies of all of the above if required.
I CANNOT BELIEVE THAT HIS UNSCRUPULOUS LAWYERS ARE PLEADING "NOT GUILTY" (?!) ON HIS BEHALF, AND WOULD DO ANYTHING TO GET EVEN A FRACTION OF MY HARD_EARNED MONEY BACK!

The thing that I had wished to happen, has. I felt out in the cold when I realized that I had been scammed, as I am sure each of you felt the same. Now, we all have something in common and we have the beginnings of a list of others who want resolution.  I think that if we get all of the information together and get it to the prosecutor, we can improve our changes for restitution as well as assist them in building the case against those that have been charged.
It is time we created order out of chaos. Here is what I recommend.
One of those in our group, meaning he is a victim also, is an attorney. I
asked if he would be willing to consolidate our losses and present this to the prosecutor. Believe me, in cases like this, there is strength in numbers. If you agree, please provide information to odea@halloran-sage.com:

Got me for $1,872 back in August. I also received numerous false USPS tracking numbers for the shipment and for the refund I requested. I was able to track them - they were going to other people, so I guess someone got their stuff. "Edward" told me that they had been shipped to the other addresses by accident and, of course, they would ship my computer out the next day. The amount of time this guy took just in emailing lies to all of us must have taken him all day long. No wonder it took so long to get a response. Anyone else get email from Elizabeth or anyone other than Edward? I'm pretty sure there aren't any such people, but just wondering how many aliases this guy had. Does anyone know anything about the Trivedi Infosys, Inc. corporation I mailed my check to? I haven't been able to find any reference to it at all in the corporation checks I've made. Just wondering if it for real or just another false front.

I have been in continuous contact with Rajsoftware since then and was told that the shipper was out of stock of the item. Then I was told that the manufacturer has discontinued the item and i as offered to take a refund or take the next available model. unfortunately i selected the model available on their web site. well, actually would not have made any difference as i c on this site lot of people had asked for refund well before that too !

I never received the item so I stayed in contact via email and was told I could get a refund. I never received the refund. I was told that a check was mailed, I never received it. I was then told on more than one occasion that a certified letter with a check was mailed. I received false USPS certified mail tracking numbers. But, I have never received any mail from them. I was then advised on dec. 7, 2001 that I could take a wire transfer to my account. They asked for the account information but i became speculative and then went on to BBB site to find that this company has a history of such cases. just around that time he was arrested. i have talked to them (edward/elizabeth and to raj's answering machine) on phone several occasions till it came down to getting a refund. I repeatedly requested that they check my address to ensure that it was accurate. I have every email from June 2001 to the last email I received from this company on Dec 7, 2001.

paypal.com are also crooks as they do not allow to file a complain after 30 days. and looks like raj software knew that very well !

After many false UPS and USPS tracking numbers, I still have not received the camcorder or a refund I requested on 10/4/01. I have received an empty envelope once. They have ceased communication since 12/6/01 and now at least I know that that I am not their only victim. I hope to see justice and get my money back.

I spoke with the prosecutor - they are going to try and get a plea agreement and as part of that plea agreement Raj would provide restitution. If he does not take a plea, we would have to go after him to get our money. Because the state has such a good case I have to believe he is going to plea. I also spoke with Raj's lawyer. He has gotten through 1/2 of the documents the state has against his client and will contact me if there is any plea agreement. Believe it or not, I liked his lawyer (remember we lawyers get hired to defend even crooks - I learned in the first year of law school 13 years ago, when you're defending a person you believe is guilty, you're not actually defending him, you're defending the system - basically you make sure the police and prosecution do their job correctly so that in the future they do it right and thus prevent an innocent person from being put away... all right enough of my speeches).

We all are mad at ourselves for being taken by this crook (no one more than me!) but as long as we stay involved in the process we should be able to at least get the satisfaction of knowing Raj will do serious time and we might even get some of our money back. And remember, of all the tragedy that happened in 2001, it's not that bad and may we all have better luck with our internet purchases in 2002 (I know I will only buy on-line with my American express and if the item is not delivered by the time the bill is due I dispute the bill and Amex is great with that - they always take the consumer's side).

My name is Mike Horn. I wanted a laptop computer for my daughter... Well, $1220.00 later here we are. I have filed with the FBI, as well as contacting the lawyer for trademarks and logo's for Apple Computer to let them know Trivedi used their trademark and logo to deceive and defraud. Apple is VERY protected of their trademark, logo and intellectual property. As a retired Army Officer, working for a Defense Contractor, I have a San Diego Deputy DA/prosecutor attached to my worksite as an Army Reserve Colonel. As a professional courtesy, he said he would put me in contact with his fraud division to make sure I did everything right in filing my complaint.

I received a call today (Friday Jan 4) from the arresting officer, the detective who went to Texas to arrest our friend RAJ. The only (new) information received was that San Diego was going forward with 98 criminal complaints (picked from the San Diego area for convenience of witnesses) of the 500+ complaints received before XMAS. Between Xmas and New Years, he believes another 200+ complaints have been filed, with even more expected after that. He thinks the average "take" by ole RAJ averages nearly +/- $1,000.00 per complaint!!! He insists that all victims continue to file with all evidence ready to send in when requested.

For people who need information, I hope this helps in some way. The detective apologized that he could not contact each of us individually. I really did not expect this much time or treatment from busy law enforcement. San Diego seems highly motivated to see justice done here. God knows what will happen if it goes to court.

I received several email from Raj a.k.a Elizabeth and Edward stating that my refund was in the mail I also received fake certified mail/tracking numbers I went to my mail man and even left someone at home to sign for a certified letter. Raj needs to give me back my money.

How about going after uBid and not just PayPal? Consumer Exchange auctions are deceiving on uBid, as they are made to look just like general uBid auctions. Plus, negligence; uBid should have removed Trivedi as a seller much sooner than they did.

Dear Interested Friends -
As many of you know, I am also one of those who was "taken" by Raj Trivedi (aka Edward, Barbara....?). I paid $775 by postal money order for a camcorder that was never delivered despite numerous fake USPS tracking numbers supplied by Mr. Trivedi.

Well, through the hard work of many of our law enforcement officers in California and Texas (and elsewhere I'm sure), Mr. Trivedi was arrested. (There is a particular officer who has been particularly busy on this case but he wishes to remain anonymous - we should all be thankful for the unsung police officers who work so hard to protect us all - I would propose that we all take 5% - 10% of whatever we get back and donate that to our local police benevolent association or see http://www.officer.com/ for some great ideas as to where to send the donation).  Anyway, on Friday 1/18/02, Mr. Trivedi and the prosecutors entered into a plea agreement. Mr. Trivedi plead guilty to 5 Felony counts (2 computer crime violations, 2 mock auctions and 1 grand larceny) and agreed to 3 years confinement and "global restitution." There will be a sentencing hearing in 60 days if Trivedi does not make the "global restitution." What does that mean? It means, at least so far, the best thing that could happen has happened. I spoke to the prosecutor a couple weeks ago and this is what she had hoped would happen but she was not sure she could get it done. Once I get her permission to publish her name I will do so as well - we all owe her a note of thanks and maybe a letter or 2 to her boss and the newspapers in San Diego as well. I will e-mail both the prosecutor and Mr. Trivedi's lawyer to see where they are getting the list of victims from and to assure all those who were victimized are made whole.

For those of you who have already e-mailed me, you do not have to so again but I remind everyone to make sure they fill out the ifcc complaint referral report - see www.ifccfbi.gov - I think that is where they are getting the list of victims. Please forward this to everyone you know who was victimized who is not on this string (I'm sorry for those of you who I have missed!). If Raj Trivedi does not make complete "global" restitution then we will re-examine whether a lawsuit would be an appropriate recourse. Again, we owe the police and the prosecutors our thanks and our support! Our judicial system may not be perfect, but I'll take it over any other system in the world!

Guilty plea in Internet fraud by NBC 7/39 News Staff

SAN DIEGO, Jan. 18 - A man who stole $800,000 from hundreds of victims worldwide by selling electronic goods on Internet auction sites, then failed to deliver the goods, pleaded guilty Friday to grand theft and fraud charges.

Raj Trivedi, 25, faces a stipulated sentence of three years in state prison when he goes before the court March 22, provided he makes restitution in full. Superior Court Judge Robert F. O'Neill also ordered Trivedi to forfeit his computer.

The defendant pleaded guilty to two counts each of grand theft and being a pretender on a mock auction, and a single count of computer fraud. As a result of the plea bargain, 91 other counts were dismissed.

"Mr. Trivedi was robbing Peter to pay Paul," said Deputy Attorney General Tawyna Boulan. "He intentionally defrauded people on the computer."

A number of victims lost between $20,000 and $30,000, but for most it was $1,800 to $2,000, the prosecutor said.

Trivedi's attorney, John Cleary, said his client was a baseball card collector who "got in over his head" with a computer business.

"For two years it was successful," Cleary said. Trivedi then got deep in debt and got "caught up in credit," his attorney said. "He was out of control," Cleary said. "He was totally irresponsible, there's no question about it."

Boulan said Trivedi could face a possible maximum sentence of six years and eight months behind bars if a judge determines he has not made every effort to pay back some 600 victims in the United States, Mexico, Canada and Great Britain.

"This case deserves every victim to be made whole," the prosecutor said.

Trivedi was arrested last month in Katy, Texas, a suburb just west of Houston. He had gone there after investigators in San Diego questioned him about his business, Boulan said.

Trivedi's personal assets are exhausted, but he still has between $150,000 and $200,000 worth of property in Texas and $93,000 in a bank account that will go toward restitution, Cleary said. The defendant's parents will also contribute another $57,000, the attorney said. But Boulan said authorities in Texas may not release the defendant's property while their investigation continues.

Trivedi doesn't face any criminal charges in Texas at this time, the prosecutor said.

Please add me to your list. 8/14/2001 I ordered a Apple iBook/DVD/+256MB from Rajsoftware thru Paypal and paid $1299.00 for it. After 6 weeks and no delivery and giving me constantly false tracking numbers I canceled the order and ask for a full refund but my refund has never arrived, or better has never been send. I filed a complaint at the BBB of San Diego 10/30/2001 but nothing has happened since then. I was in contact with Edward and Elizabeth from Rajsoftware by email and they promised me to send the money but you know ...Since they skipped town to Katy, TX I tried to find them by myself but there was just a mailbox. Now I read that the owner got arrested and I hope we all get our money back with your help. I also filed a complaint today at www.ifccfbi.gov for your records. Please let me know if there are any news about that case.

I am yet another who was scammed by Raj Trivedi. In August 2001 I
purchased a laptop computer via the UBid.com website. The cost was
$1215.00, which I paid on August 26, 2001 via business check.

Despite numerous emails and at least 3 ficticious USPS shipping numbers, I never received my merchandise.

I am very well documented with the emails and a copy of the check that was cashed. I did contact the San Diego District Attorney's office to offer any help and documentation they might want in their efforts to prosecute this case. They did not contact me afterwards, but I assume they had a whole lot of evidence to work with.

If the resolution in this case is such that it allows me to obtain any type of restituion, I would love to know what I need to do.

I sincerely appreciate all your efforts that you are making in this matter. If I can help in any way, please don't hesitate to ask.

I have also received a DEFENSE RESTITUTION CLAIM FORM form his attorney, i made a payment of $1216. I wanted to be a part of this group and help bring justice for myself and others who have given their hard earned money to this criminal. Like many people I purchased a Sony VAIO FX220 Notebook from the seller Raj Software through the Ubid.com( Lot #:520547250) on Sep.16th 2001, then made the payment through paypal for 1215.00. Not even I didn~{!/~}t get the notebook as their promise within two weeks, the truth is I never got the notebook. After I email to question them that why took so long to get my notebook, they claim that they would return money. I was very patient to wait for refund, but nothing came from them. Then I contacted them again, they claimed again that they are going to send me a check. Things were going on very nasty after that. The last time I try to contact them was Jan. 9 2002, I found out their email system and website were shut down already.

Dear Mr. O'Dea,

Pat asked me to email you regarding my case. A short note of gratitude for your time and efforts. I will be sure to earmark a percentage of my recovery (if there is a recovery), to be given to a local police fund as you have suggested.

I am so angry with this man. I feel as though more than money has been taken from me as I am sure other victims feel. I am also upset with myself for allowing Rajsoftware.com to get the best of me. This guy had no conscience and in my case used 9-11 to his advantage to keep me at bay for a few more weeks.

However, I do not think Rajsoftware.com is the only player in this fraud game. I blame Paypal which brings me to the reason why I am writing you. It is the consensus of many of the victims of Rajsoftware.com that Paypal knew months in advance of Mr. Trivedi's game. There is evidence to indicate that Paypal received many complaints about the company and Mr. Trivedi but, failed to act. I feel that the company enabled him to commit fraud in the interest of making money on his transactions.

Paypal should have terminated his account months in advance and in not doing so allowed Mr. Trivedi to swindle many more victims out of their hard-earned money.

I took this issue up with Paypal about the same time I filed all of my official complaints against Mr. Trivedi's company. Paypal indicated to me that I did not report the problem within their 30 day limitation. Therefore they could do nothing. I was extremely frustrated with this answer. I explained that Mr. Trivedi's scam was based on delaying the purchaser to avoid said purchaser from filing a complaint. Such a technique allowed him time to continue with his fraudulent behaviors. They had no sympathy or understanding for my position. Paypal sold their service to me on the concept that I would be protected against people like Mr. Trivedi. However, when it came time to ante up, Paypal failed me and hundreds of other clients.

I took this issue to my credit card company shortly after my conversation with Paypal. The credit card company asked that I forward all information concerning Paypal and Rajsoftware.com to them. I did so. To make a long story short, my credit card company found Paypal to be at fault and reversed the transaction that was used to pay Paypal so that Paypal could pay Rajsoftware.com.

Paypal immediately retaliated by restricting my account and freezing all assets in the account. I filed an appeal with Paypal. Paypal rejected the appeal. I called Paypal after receiving the appeal and re-explained the situation (10th time at the least), to include my reasoning as to why I felt they were at fault. The Paypal representative stated that they would not lift the restriction until such time they received their $1280.00, the amount of the chargeback by my credit card company. This is also the amount that I paid to Rajsoftware.com for a printer I never received.

I contacted my credit card company to see if they might be able to apply pressure to Paypal. The representative indicated to me that they dealt with Paypal's bank and not Paypal directly. The representative went on to say that they could not pressure Paypal into removing the restrictions on my account. I asked the representative if there is anything they could do. She stated that an investigation would only take place if Paypal received numerous chargebacks in a given period of time. Numerous chargebacks on a vendor send up red flags to a credit card company.

In closing, Paypal does have many contract limitations holding them in a "no harm/no liability" position should one Paypal client commit a fraudulent act against another Paypal client. However, I feel that these stipulations hold no water when Paypal demonstrated gross irresponsibility and negligence in investigating and suspending Trivedi's account. An account that had multiple complaints lodged against it.

All of this said, I am wondering if anyone is pursuing a suit against Paypal? If so, how do I become involved in such a suit? I would also be interested in any advice you might have for me.
